ORDINANCE X10. 5577
AN ORDINANCE providing for the repair and reconstruction of a certain portion of that
certain outfall sewer in Ash Street in the City of Salina and providing for the
payment of the cost of such improvement by the city at large and for the issuance
j of general improvement bonds of said city to pay such cost.
WHEREAS] a certain portion of the main outfall sewer and appurtenances thereto in Ash
Street in the City of Salina Bring between Columbia Avenue and Kansas Avenues for a
distance of approximately 190 feet., is in need of repair and reconstruction by reason
of damage caused by flood waters; and
WHEREAS, in the judgment of the governing body of the City of Salina such portion of
said sewer and appurtenances thereto should be repaired and reconstructed in the manner
provided by law; and
EASs said sewer serves a substantial portion of said city and in the judgment of
the governing body of said city the cost of repairing and reconstructing the same should
be borne by the city at large; and
WHEREAS, the general fund of said city is insufficient to pay such cost and such govern-
ing body deems it necessary to issue general improvement bonds of said city in the
manner provided by law to pay such cost; NOW THEREFORE
BE IT ORDAINED by the Board of Commissioners of the City of Salina., Kansas:
Section 1. That the foregoing preambles be and they are hereby adopted as a part
of this ordinance and that a certain portion of the outfall sewer in Ash Street in
the City of Salina lying between Columbia Avenue and Kansas Avenues approximately 190
feet in lengths and the necessary appurtenances thereto, be repaired and reconstructed
to such extent as will be necessary within the limits herein mentioned.
Section 2. That on or before the 13th day of Augusts 1951 the City Engineer shall
prepare and file with the City Clerk plans and specifications for the repair and re-
constructing of the portion of said sewer and appurtenances described in Section 1 here-
of., together with a detailed estimate of the cost thereof, under oaths and thereafter
the City Clerk shall advertise in the official city paper for three consecutive days
for sealed proposals for the construction of such work according to the plans and speci-
fications of the City Engineer* upon receipt of such proposals the governing body
shall let a contract for such work and improvements to the lowest responsible bidder
therefore., if there be any whose bid does not exceed the estimate of the City Engineers
but the city shall reserve the right to reject any or all bids and if no bid shall be
received within such estimate the governing body shall have the power to do such work
and make such improvements within the estimated cost thereof as provided by law.
Section 3. That for the purpose of paying the cost of said work and improvements.,
general improvement bonds in an amount not to exceed the contract price for such work or
the cost thereof if done by the city, shall beissued as provided by law and ordinances
hereafter adopted and sold in the manner provided by law and for the purpose of paying
such bonds and interest as the same become due and payable., the Board of Commissioners
shall levy a general tax upon all taxable property in the City of Salina in the time and
manner provided by law.
Section 4* This ordinance shall take effect and be in force from and after its
publication in the official city paper.
