5568 Levy Assessments1 ORDINANCE NO. 5568 (Published in the Salina Journal 1951) AN ORDINANCE relating to and apportioning and levying special assessments on certain lots and pieces of ground in the City of Salina., Kansas, to pay the cost of curbing, guttering, paving and grading of Jewell Avenue from the east line of Osborne Avenue to the east line of Lots 33 and 3. on Je-"-well Avenue; for the curbing, guttering, paving and grading of Iron Avenue from the east line of Delaware Avenue to the east line of Mary - mount Road; forthe s'�rs -9966ndrg., paving and grading of Eleventh Street from the north line of Harsh Avenue to the south line of Hamilton Street; for a b4% paving and grading of Second Street from the north line of Elm Street to the south line of North Street; for tie pang and grading of Seventh Street from the south line of Woodland Avenue to the north line of Grand Avenue; and relating to and providing for the collection and payment of such assessments. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas; Section 1. That for the purpose of paying for that part of the cost of improvements of certain portions of certain streets as hereinafter set forth in the following sections of this ordinance which is chargeable to the private property in the assessments districts for each of such improvements, respectively, as set forth in the following sections of this ordinance with respect to each of such improvements there are hereby levied and assessed on the property liable therefor, being all the lots and pieces of ground lying on each or either side of said streets so improved, respectively, to the middle of the distance improved, with respect to the improvements mentioned in Sections 2, 3, 4, 5 and 6 of this ordinance, according to the appraised value of such lots and pieces of ground with respect to each such improvement, without regard to the buildings or improvements thereon, special assessments covering the cost of such work and improvements and said special assessments being based on the special valuation and appraisement of said lots and pieces of grofAnd heretofore made by three disinterested appraisers appointed by the Board of Commissioners of the City of Salina, Kansas, with respect to each such improve- ment, which said app raisements are hereby referred to and made parts of this ordinance, and the several amounts levied, apportioned and assessed against the lots and pieces of fround for each of such improvements, respectively, for the purpose aforesaid, are hereby found and determined to be the amounts set forth in the following sections of this ordinance with respect to each of said improvements. Section 2. There is hereby further levied and assessed against each lot and piece of ground described in this ordinance, interest at such rate per annum as shall be borne by the bonds hereafter to be issued for the payment of the remaining unpaid cost of such improvements, to be hereafter determined and fixed by ordinance when such bonds Lot 21, Block 15 _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ 233.85 Lot 22,Blockl5--------------.. 194.87 West 1/2 Lot 23, Block 15 - - - - - - - - - - _ 101.32 East 1/2 Lot 23, Block 15 - - - - .. - - _ - - - 101.32 Lot 24, Block 15 - - - - - - - - - - - - - - -- 194.87 Lot 25, Block l5---------------- 194.87 6789.36 Section 7_ Said amounts levied, apportioned and assessed aforesaid will be due and collectible in ten equal installments, falling due each and every year thereafter until all are paid, and all to be collected with interest as in this ordinance pro- vided, PROVIDED, HOy&TM- , that the owner of any piece of property liable for any assessment may redeem his property from such liability by paying into the City Treasury the entire amount chargeable against the same, as in this ordinance designated, at any time within thirty days after the publication of this ordinance and before the issuance of bonds of said city in payment of the balance of the cost of said improvements, and the property so paid on shall not thereafter be liable for any further assessments for the cost of said improvements nor for any part of said bonds. Section 8. There is hereby further levied and assessed against each lot and piece of ground described in this ordinance, interest at such rate per annum as shall be borne by the bonds hereafter to be issued for the payment of the remaining unpaid cost of such improvements, to be hereafter determined and fixed by ordinance when such bonds are issued, on all of said installments mentioned and provided for in this ordinance, from the date of the bonds which may be issued at the end of thirty days as specified in the proceeding sections hereof, as by law provided, to the time of collection of the last installment as provided by law, which said interest shall be collected annually at the same time and in the same manner as said installments are collected, and after the taking effect of this ordinance and the fixing of said interest rate when such bonds are authorized and issued, it shall be the duty of the City Clerk of said city to annually at the same time other taxes are certified and until all of said installments and assessments so apportioned and levied herein have been certified, to the County Clerk of Saline County, Kansas, a full list of all property liable to assessment and taxation for such work and improvement, except such property on which the special assessments aforesaid have been paid in full as hereinbefore provided, together with the respective amounts due on each of such lots and pieces of ground, which amounts shall include the annual, installments of such special assessments together with the interest for one year at the rate to be fixed as provided for in this ordinance, on all unpaid balances of such assessments, and such amounts so certified as herein provided shall be placed upon the tax roll by the County Clerk of Saline County, Kansas, and collected asother taxes are collected. Section 9. This ordinance shall take effect and be in force from and after its publication once in the official city paper. Introduced..
