5564 Storm Sewer Improvements - Grounds of KWU- ORDMA rCE NO* - 5564 Published in the Salina journal 1951) AN ORDINANCE providing for the construction, development and installation of a certain storm sewer and conduit in the City of Salina, providing for the preparation of plans and specifications therefor, the filing of a detailed estimate of cost thereof and for the payment of the cost thereof. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas Section 1. That it is necessary and it is hereby ordered that a storm sewer and conduit, together with all necessary inlets, inlet connections, manholes, connecting lines, sluice gates and other appurtenances, be constructed in the City of Salina along the following course, to -wits Commencing at a point eight feet east of the west line on the south line of Lot 30 on Cloud Avenue in the Addition to the Grounds of Kansas Wesleyan University, an addition to the City of Salina, Kansas, thence in a northerly direction along the extreme botto Ae"from at certai-n draw, through which certain flood and surface ;to the � a point where the bottom of said draw inter- sects With the south line of Crawford Street in said city. Section 2, That on or before the 10thday of September 19513 the Cit —� y Engineer shall prepare and file in the office of the City Clerk, detailed plans and specifications for the construction of the storm sewer and conduit provided for in Section 1 of this ordinance, and that a detailed survey of the course of said drag be prepared and filed with said clerk within said time and on or before the same date said engineer shall prepare and file in the office of the City Clerk, under oath detailed estimates of cost thereof. After such plans, specifications and surveys and estimate of cost shall have been filed, the City Clerk shall advertise by advertisements published in the official city paper for at least three consecutive days for sealed Proposals for the building and construction of such storm saver and conduit and at the time and place mentioned,, the Board of Commissioners may contract with the lowest and best responsible bidder therefor for the building and construction of such storm sewer and conduit, but the right to reject any and all bids shall be and is hereby reserved; and provided further that if no responsible person shall propose to enter into a con- tract at a price not exceeding the estimated cost, then the Board of Commissioners may proceed to construct said improvements within the estimated cost thereof and shall pur- chase the necessary tools, apparatus and materials and employ the necessary labor for the purpose of constructing the same. Section 3e That for the payment of the cost of 'such work, th)a Board of Cam- missioners shall issue Improvement Bonds of the City of Salina, Kansas, in an amount not to exceed the total cost of such work and improvements, including the cost of acquiring land therefor, except as herein provided, to be payable in four (4) approxi- mately equal annual installments and to bear interest at not to exceed 5% per annum from the date of such bonds, and for the purpose of paying such bonds and interest as they severally mature, the Boakd of Commissioners shall annually levy a tax upon all real and personal property in the City of Salina in an amount sufficient to pay the annual. installments of such principal and interest, and that pending the issue of such bonds, ora to temporary ry notes shall be issued according to law, Jim pay the cost of such work.
