ORDINANCE NLU4BER 5555

AN ORDINANCE creating and defining a certain lateral sanitary sewer district in the
City of Salina, Kansas, designated as Lateral Sanitary Sewer District Number 264
and providing for the construction of a lateral sanitary sewer in said lateral
Sanitary Sewer District Number 264, so created, and providing for the payment of
the cost thereof and for the levying of special assessments against the property
in said district for the payment of the cost of such construction and for the
issuing of bonds to pay the cost thereof.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. Lateral Sanitary Sewer District 264, That there be and there is here-
by created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall
be and it is hereby designated as Lateral Sanitary Sewer District Number 264 and which
district shall include all the following described property in the City of Salina,
Kansas, to wit:
Benefit Districts All of Block 31 Kraft Manor Addition,
Section 2. It is necessary and it is hereby ordered that an eight inch V. C. P.
lateral sanitary sewer with all necessary connections, manholes, flushing tanks, and
other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer
District Number 261 as created by Section 1 of this ordinance along the following course,
to -wit:
An 8 inch clay pipe sewer beginning at an existing manhole
at the center line of Cloud Street and the center line of
right-of-way for utilities just east of Simmons Street;
thence south along center line of said right -of -,:ay to the
center line of Charlotte Street where a manhole will be
constructed which frill be the t erminus of Lateral 264.
Section 3. That the City Engineer shall on or before ___May 7th
prepare and file in the office of the City Clerk, plans and specifications for the con-
struction of the lateral sanitary sewer provided for in the preceding sections of this
ordinance which shall be of proper character to serve the property lying within the dis-
trict which such sewer is to be constructed and shall on or before the same date prepare
and submit to the Board of Commissioners a detailed estimate under oath of the cost there-
of. That hereafter the City Clerk shall advertise for three consecutive days in the
official city paper for sealed proposals for the building and construction of such sewer
according to such plans and specifications, which proposals stall be filed with the City
Clerk on or before the time fixed in such notice, at which time the Board of Commissioners
may let a contract for the building and construction of such sewer to the lowest and best
responsible bidder or bidders therefor, if there be any whose bids do not exceed the es-
timated cost thereof, but said Board shall reserve the right to rE!ject any or all such
proposals, and if no bid shall be received within such estimate, the Board of Commissioners
shall have the power to do such work and make such improvements within the estimated cost
thereof as provided by law.
Section 4, That for the cost of building and constructing such sewer, special assess-
ments shall be made for the full cost thereof on all lots and pieces of land within and for
which such sewer shall be built, according to the appraised value thereof, without regard
to the improvements or buildings thereon.
Section 5e After the passage and publication of this ordinance, the Board of Com-
missioners shall appoint three disinterested appraisers, who having taken oath to make
a true and impartial appraisement of all lots and pieces of land to taxation for the
cost of such improvements, shall within five days after having been notified for their
appointments proceed to appraise all of the lots and pieces of land within such district
liable to assessment and taxation as aforesaid, without regard to the buildings or im-
provements thereon, and after making such appraisements, shall return to the Board of
Commissioners of said city and said. Board shall designate a time for a special meeting
of said Board for the purpose of hearing any complaints that may be made as to the value
of any lot or piece of land appraised as aforesaid, of which special session dye notice
shall be given in the official city paper, at which special session said Board may alter
any valuation of any lot or piece of land if, in their opinion, the same has been appraised
too high or too low.
Section 6. The special asUessment herein provided for may be paid by the person
liable therefor in four approximately equal annual installments but the owner of any
property liable to such assessment may within thitty days from the date of determining
the amount assessed against the property, pay the same in full and his property shall
not be liable for any assessments for the cost of such improvements, and bonds as herein-
after provided for shall be issued in the amount of the cost of such improvements remain-
ing unpaid at the end of the thirty days from the time such assessment is fixed.
Section 7. For the purpose of paying for the work and improvements in this ordinance
provided for, the Board of Commissioners may and are hereby authorized and directed to
issue improvement bonds of the City of Salina, Kansas in an amount not to exceed the cost
of such improvement, and to run for a period of four years and be payable in four approxi-
mately equal annual installments, together with interest not to exceed five per cent per
annum, which bonds shall be issued and payable according to law; and for the purpose of
paying the principal and interest on said bonds as they severally become due and payable
the Board of Commissioners shall apportion and assess against the lots and pieces of land
within the taxing district of such improvements, special assessments covering the cost of
such irprovement and apportionment therein contained shall hold good for all of the install-
ments that are to be collected from the specific property chargeable with such improvements;
such assessment and apportionment ordinance shall contain the total amount of tax
appor-
tioned to such tract, piece or parcel of land within the taxing district and shall state
the number of annual installments in which such tax is to be collected; and thereafter
the City Clerk shall annually, at the same time that other taxes are certified, certify
to the County Clerk of Saline County, Kansas, a full list of all property liable for such
work and improvements, together with the respective numbered amounts due on each of said
tracts, pieces or parcels of land, which amounts shall include the annual installments and
interest on all unpaid balances for one year at the rate of not to exceed five per
cent per annum, on such amounts so certified., which shall be collected as other taxes
are collected.
Section 8. This ordinance shall take effect and be in force from and after its
publication once in the official city paper.
