5554 Confirm Street ImprovementsORDINANCE NOS (First Published in the Salina Journal r� l� 1951) AN ORDINANCE ratifying and confirming a contract with the H. J. Taylor Construction Company for the construction of certain curbing, guttering, and grading improvements on certain streets in the City of Salina, and providing for the issuance of Temporary Notes to pay the cost thereof pending the issuance and sale of bonds. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas, Section 1. That the acceptance by the City of Salina of the proposal of the H. J. Taylor Construction Coipany, hereinafter referred to as the "Contractor" as sub- mitted to the Board of Commissioners on April 9, 1951, which is hereby found to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said city to said contractor and signed on behalf of the City of Salina by the Mayor on April 16, 1951 for the construction of certain public improvements in the City of Salina, Kansas, to wit: Curbing, guttering and grading of the north side of Claflin Avenue from the west line of Pershing Street to the east line of Funston Street, as provided by Ordinance No. 5543• Curbing, guttering and grading of Cloud Avenue from the east line of Ninth Street to the west line of Simmons Street and the north side of Cloud Avenue from the west line of Highland Avenue to the west line of Simmons Street extended north, as provided by Ordinance No. 5543. Curbing, guttering and grading of Charlotte Street in Kraft Manor Addition from the east line of Highland Avenue to the west line of Simmons Street, as provided by Ordinance No. 5543. Curbing, guttering and grading of Highland Avenue in Kfaft Manor Addition from the south line of Cloud Avenue to the south line of Charlotte Street and the east side of Highland Avenue in Kraft Manor Addition from the south line of Cloud Avenue to the north line of Charlotte Street, as pro- vided by Ordinance No. 5543• Curbing, guttering and grading of Jewell Avenue from the east line of Quincy Street to the east line of Sunrise Drive, as provided by Ordinance No. 5543• Curbing, guttering and grading of Lamar Street from the west line of Third Street to the center line of Fourth Street, as provided by Ordinance No. 5543• Curbing, guttering and grading of Republic Avenue from the east line of Quincy Street to the east line of Sunrise Drive as provided by Ordinance No. 5543• Curbing, guttering and grading of Simmons Street in Kraft Manor Addition from the south line of Cloud Avenue to the north line of Charlotte Street, as provided by Ordinance No. 5543 at and for the unit price for said work contained in said proposal, which proposal and contract are hereby referred to and made parts of this ordin aice be and the same is ratified and confirmed, said proposal being within the estimated cost of said improve- ments as shown by the sworn estimated cost of the City Engineer on file in the office of the City Clerk, which estimates are hereby referred to and made a part of this ordinance. Section 2. Said improvements shall be built and constructed in accordance with the plans and specifications therefore prepared by the City Engineer on file in the office of the City Clerk and in accordance with the proposal of said contractor and under the terms of said contract, all of which are hereby referred to and made a part of this ordinance. Section 3. That temporary notes signed by the Mayor and attested by the City Clerk be issued from t:Lie to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the contract price for such work, such notes to bear interest not to exceed 41 per cent per annum, and to mature not later than December 1, 1952, and to be issued in such amounts and at such times as money for the payment of the cost of such notes to be issued to said contractor and to be redeemed and cancelled at the time that permanent bonds are issued in lieu thereof.
