AN ORDINANCE ratifying and confirming a contract with the H. J. Taylor Construction
Company for the construction of certain curbing, guttering, paving and grgding
improvements on certain streets in the City of Salina, and providing for the
issuance of Temporary Notes to pay the cost thereof pending the issuance and
sale of bonds.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That the acceptance by the City of Salina, Kansas, of the proposal
of the H. J. Taylor Construction Company, hereinafter referred to as the Y1Contractor«
as submitted to the Board of Commissioners on April 9, 1951, which is hereby found to
be the lowest and best bid for such work, and the contract awarded by the Board of Com-
missioners of said city to said contractor and signed on behalf of the city by its
Mayor on April 16, 1951 for the construction of certain public improvements in
the City of Salina.. Kansas, to -wit:
Paving and grading of Johnstown Avenue from the east line of Penn Avenue
to the west line of Columbia Avenue, as provided by Ordinance Number 5544,
Paving and grading of Lincoln Street from the west line of Reynolds Street
to the east line of Broadway Boulevard, as provided by Ordinance Number 5544.
Paving and grading of Pershing Street from the north line of Beloit Avenue
to the center line of Republic Avenue, as provided by Ordinance Number 5544.
Curbing,
Guttering, Paving and grading of Smoky Hill Drive from the east line of Oakdale Avenue
to the east line of Penn Avenue, as provided by Ordinance Number 554.,
at and for the unit prices for said work contained in said proposal, which proposal and
contract are hereby referred to and made parts of this ordinance, be and the same is here-
by ratified and confirmed, said proposal being within the estimated cost of said improve-
ments as shown by the sworn estimates of the City Engineer in the files of the office of
the City Clerk which estimates are hereby referred to and made a part of this ordinance.
Section 2. Said improvements shall be built and constructed in accordance with
the plans and specifications therefore prepared by the City Engineer on file in the office
of the City Clerk and in accordance with the proposal of said contract and under the
terms of said contract, all of which are hereby referred to and made parts of this ordinance.
Section 3. That Temporary Notes signed by the Mayor and attested by the City
Clerk be issued from time to time as the work progresses in the manner and form as pro-
vided by law, the total amount thereof not to exceed the contract price for such work,
such notes to bear interest at not to emeed 42 per cent per annum and to mature not later
than December
1, 19522 and
to be issued in such amounts and at such times
as
money for
the payment of
the cost of
such notes be issued to said contractor and to
be
redeemed
and cancelled at the time that permanent bonds are issued in lieu thereof.
Section 4* This ordinance shall take effect and be in force from and after its
Publication once in the official city paper.
