AN ORDINANCE providing for the vacation and abandonment of certain streets,, drives,
alleys, rights and easments of the City of Salina, Kansas.
WHEREAS, the Board of Commissioners of the City of Salina, Kansas find a certain
twenty (201) foot drive in Leavenworth Addition to the City of Salina, Kansas, ad-
joining Block Eleven (11) and Park No. 3 in said Leavenworth Addition, between the
south line of University Place and the north line of Walnut Street should be vacated;
and,
WHEREAS, the Board of Commissioners of the City of Salina, Kansas, find that a cer-
tain Fifteen (151) foot east -west alley located in Block Elevent(11) in Leavenworth.
Addition to the City of Salina,Kansas, should be vacated; and
WfMW,v the City of Salina, Kansas, aequi"d certain easements, rights and interests
forthe City of Salina, Kansas by virtue of a certain condemnation ordinance No. 3828
and as shown by Case No. 125!4 in the District Court of Saline County, Kansas; and
WHERBAS, the City of Salina acquired certain easements, rights and interests in all
that part of Park No. 3 and all that part of Block Eleven (11) all in Leavenworth
Addition to the City of Salina, Kansas, lying west of the west line of Olive Street
by virtue of a certain condemnation Ordinance No. 3828 ,and as shown by Case No.
14779 in the District Court of Saline County, Kansas; an
WHEREAS, the Board of Commissioners of the City of Salina,Kansas find that all the
easements, rights and interests of the City of Salina, Kansas, in Park No. 3 in
Leavenworth Addition to the City of Salina, Kansas, and further find that all the
easements, rights and interest of the City of Salina, Kansas', in all that part of
Park No. 3 and all that part of Block Eleven (11) in Leavenworth Addition in the
City of Salina, Kansas, lying west of the west line of Olive Street, also known as
South Broadway Boulevard, have been abandoned by the City of Salina, Kansas, for a
number of years and that the City of Salina, Kansas, has no further use or need for
said easements, rights and interests; and SO NOW THEREFORE,
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That a certain twenty (20) feet drive in Leavenworth Addition in
the City of Salina, Kansas, lying west of the west line of said Olive Street, adjoining
Block Eleven (11) and Park No. 3 in said Addition, between the south line of University
Place and the north line of Walnut Street according to the recorded plat thereof, be
and it is hereby vacated.
Section 2. That a certain fifteen (15) foot east -west alley in Block Eleven (11)

in Leavenworth Addition to the City of Salina, Kansas be and it is hereby vacated.
Section 3. That all the easements, rights and interests of the City of Salina,
Kansas, in Park No. 3 in Leavenworth Addition to the City of Salina,Kansas, acquired
by condemnation the said city by virtue of Ordinance No. 3828 and as shown by Case
No. 12544 in the District Court of Saline County, Kansas, be and it is hereby abandoned,
tacated and relinquished.
Section 4* That all the easements, rights and interests of the City of Salina,
Kansas in all that part of Park No. 3 and all that part of Block Eleven (11) all in
Leavenworth Addition to the City of Salina, Kansas, lying west of the west line of
Olive Street acquired by condemnation by said city by virtue of Ordinance No. 3828
and as shown by Case No. 14779 in the District Court of Saline County, Kansas, be
and it is hereby abandoned, vaeat4d and relinquished.
Section 5. This ordinance shall take effect and be in force from and after its
publication once in the official city paper.
