Section 3. Lateral Sanitary Sewer District Number 263. That there be and there is hereby created Lateral Sanitr.2y Sewer Listrict in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer Listrict Number 263 and which district shall include all of the following described property in the City- of Salina, Kansas, to -..Tit: Benefit Listrict Lateral 263. Lots 5, 61 7, 10, Block 5 and all of Block 6, all in Horningside Addition, City of Salina, Kansas. Section 4. It is necessary and it is hereby ordered that an eiL-ht inch V. Section 5. That the City Engineer shall on or before March 26th1951 prepare and file in the office of the City Clerk., plans and specifications for the con- struction of the lateral sanitary sewers provided for in the preceding sections :)f this ordinance which shall be of proper character to serve the proper--ly lying within the dis- trict within which such sewers are to be constructed and shall on or before the same date prepaxe and subrait to the Board of Commissioners a detailed estLlate under oath of the co-st, thereof. That thereafter the City Clerk shall advertise for thrce consecu- tive days in the official CitV paper for sealed proposals for the building and construc- ti(-,,n of such sewers according to such plans and specifications i4iich proposals shall be filed with the City Clerk on or before the time fixed in such notice, at which time the hoard of Commissioners may let a contract for the b,.-ilding and construction of such s&_­erS to the lowest and best responsible bidder or bidders therefor., if there be any w,-iose bid does not exceed the estimated cost thereof but said Board shall reserve the right to reject any or F.11 such proposals, and If no bid shall be received within such estimate, the ,3oard of Commissioners shall have the -dower to do such work ana make such improvements within the estimated cost thereof as provided. by law. For the purpose of paving for the work and improvements in this ordinance provided for, the Board of Commissioners are hereby authorized and directed to issue bonds of the City of Salina in an amount not to exceed the cost of such improve- ments and to run for a period of four years and be payable in four approximately equal annual installments, together with interest not to dxceed five per cent per annum, which bonds shall be issued and payable according to law; and for the purpose of paying the principal and interest on said bonds as they severally become due and payable, the Board of Commissioners shall apportion and assess against the lots or pieces of land within the taxiing district of such improvements$ special assessments covering the cost of such improvement and apportionment therein contained shall hold `ood for all of the install- ments that are to be collected from the specific property chargeable with such improve- ments, such assessment and apportionment ordinance shall contain the total amount of tax apportioned to each tract, piece or parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected; and there- after the City Clerk shall annually, at the sane time other taxes; are certified, certify to the County Clerk of Saltine County, Kansas, a full list of all property liable to such work and improvements, lofether with the respective amounts due cn each of said tracts, pieces or parcels of land, which amounts shall include the annual installments and interest on all unpaid balances for one year at the rate of not to exceed five per cent per annum, on such aaount so certified, which shall be collected as other taxes are collected. Section 10. This ordinance shall take effect and be in force from and after its adoption and publication once in the official city paper.
