shall be and .it is hereby designated as Lateral Sanitary Sewer iristrict Number 262 and

Selina, Kansas, to -wit:

18, Block 5 and all of Block 7, all in rlorningside
Additio-i, City of Salina, Kansas.
Section 2. It is necessary and i -v is hereby ordered that an eight inch V. C. P.
lateral sanitary sewer rrith all necessary connections, manholes, flushing tanks and
other appurtenances be constructed and k;;.i.lt in and to serve said Lateral Sanitary
Sewer Listrict 262 as created by Section 1 of this ordinance alon.n- the following
course, to -wit:
An 8 inch clay ipesewer, beginning; at an existing
sewer in center of right-of-way for utilities at the
northwest corner of Lot 11, Block 5, ,iorningside
Additiol, thence east along center line of said right-
of-way to the southwest corner of Lot 6, Block '�, in
'ornin;side Add:it on,tier,- a manhole to be constructed
which will be terminus of Lateral 262.
Section 3. Lateral Sanitary Sewer District Number 263. That there be and there is
hereby created Lateral Sanitr.2y Sewer Listrict in the City of Salina, Kansas, which
shall be and it is hereby designated as Lateral Sanitary Sewer Listrict Number 263 and
which district shall include all of the following described property in the City- of
Salina, Kansas, to -..Tit:
Benefit Listrict Lateral 263. Lots 5, 61 7, 10,
Block 5 and all of Block 6, all in Horningside
Addition, City of Salina, Kansas.
Section 4. It is necessary and it is hereby ordered that an eiL-ht inch V. C. p.

other appurtenances be constructed and built in and to serve said Later, -,l Sanitary
Sewer ]Listrict: 263 as created by Section 3 of this ordinance alone; tine following
course, to -wit:
An 8 inch clay pipe sewer, beFinning at an existing
manhole in the intersection of 'Wilson Street and Sun-
rise Lrive, thence south to the intersection of Sunrise
Drive and martin Avenue, thence east along center line
Of Martin Avenue 160 feet; thence north and easterly
along center line of right-of-way for utilities to the
southwest corner of Lot 7, Block 63

there a manhole to be constructed which will be tcriii.inu.s
of Lateral 263.
Section 5. That the City Engineer shall on or before March 26th1951
prepare and file in the office of the City Clerk., plans and specifications for the con-
struction of the lateral sanitary sewers provided for in the preceding sections :)f this
ordinance which shall be of proper character to serve the proper--ly lying within the dis-
trict within which such sewers are to be constructed and shall on or before the same
date prepaxe and subrait to the Board of Commissioners a detailed estLlate under oath
of the co-st, thereof. That thereafter the City Clerk shall advertise for thrce consecu-
tive days in the official CitV paper for sealed proposals for the building and construc-
ti(-,,n of such sewers according to such plans and specifications i4iich proposals shall
be filed with the City Clerk on or before the time fixed in such notice, at which time
the hoard of Commissioners may let a contract for the b,.-ilding and construction of such
s&_erS to the lowest and best responsible bidder or bidders therefor., if there be any
w,-iose bid does not exceed the estimated cost thereof but said Board shall reserve the
right to reject any or F.11 such proposals, and If no bid shall be received within such
estimate, the ,3oard of Commissioners shall have the -dower to do such work ana
make such
improvements within the estimated cost thereof as provided. by law.
Section 6. That for the cost of b;--Lldin�.T and constructing such sei,)ers3 special assess-
ments sllall be made for the full cost thereof on all lots and pieces of land within the
sewer districts -vit})in an(-' for which
such sewers shall be built3 according to the appraised
value thereof, without regard to the improvements or b,__'Lldings thereon.
Secti�,-,n 7. After the passage and ;-.ublicetion of t"is ordinance

Section 8. The special assessment herein provided for may be by the
paid person liable
therefor in four aPProxLaately equal annual install.-c-iients but the
o-w-ner of any property
liable to such assessment may within thirty days fro the date of determining
the amount
assessed against the property pay the sum in full and his property- shall not be liable
for assessment for the cost Of such improvements., and bonds as hereinafter
provided for
shall be issued in the amount of the cost of such improvements remaining unpaid at the
end of thirty days from the time such assessment is fixed.

Section 9. For the purpose of paving for the work and improvements in this
ordinance provided for, the Board of Commissioners are hereby authorized and directed
to issue bonds of the City of Salina in an amount not to exceed the cost of such improve-
ments and to run for a period of four years and be payable in four approximately equal
annual installments, together with interest not to dxceed five per cent per annum, which
bonds shall be issued and payable according to law; and for the purpose of paying the
principal and interest on said bonds as they severally become due and payable, the Board
of Commissioners shall apportion and assess against the lots or pieces of land within
the taxiing district of such improvements$ special assessments covering the cost of such
improvement and apportionment therein contained shall hold `ood for all of the install-
ments that are to be collected from the specific property chargeable with such improve-
ments, such assessment and apportionment ordinance shall contain the total amount of tax
apportioned to each tract, piece or parcel of land within the taxing district and shall
state the number of annual installments in which such tax is to be collected; and there-
after the City Clerk shall annually, at the sane time other taxes; are certified, certify
to the County Clerk of Saltine County, Kansas, a full list of all property liable to such
work and improvements, lofether with the respective amounts due cn each of said tracts,
pieces or parcels of land, which amounts shall include the annual installments and
interest on all unpaid balances for one year at the rate of not to exceed five per cent
per annum, on such aaount so certified, which shall be collected as other taxes are
collected.
Section 10. This ordinance shall take effect and be in force from and after its
adoption and publication once in the official city paper.
