paving; of certain streets in the City of Saline., K -nsas, described as follows:
.for the paving and grading of Johnstown Avenue from the east line of Penn Avenue
to the west line of Columbia Avenue; Lincoln Street from the west line of Reynolds
Street to the east line of Broa.dwa� Boulevard; Pershing Street frog_ the north line
of Beloit Avenue to the center line of Republic Avenue; and for the curbing,
guttering, paving and grading of Smoky Hill Lrive from the east line of Oakdale
Avenue to the east line of Penn Avenue, and providing for the payment of the cost
thereof, how the same shall be assessed, and the mannerof the payment of the cost
thereof.
1VT11ILREAS, by Resolutions numbered 1196, 11982 1199 and 1208, di.:_ly adopted September 1E,
1950, December 4, 1950 and February 5, 1951, respectively, the Board of Commiissioners
of the City of Salina, Kansas have declared that they deem it necessary to pave and
grade of Johnstown Avenue from the east line of Penn Avenue to the west line of Colur.i_0ia
Avenue; Lincoln Street from the -v.-est line of Reynolds Street to the east line of Broad-
way Boulevard; Pershing Street frori the north line of Beloit Avenue to the center line
of Rep,lblic Avenue; and for the curbing, guttering, paving and. Brading of Smoky Hill
Drive from the east line of Oakdale Avenue to the east line of Penin Avenue, all together
with such excavation and grading as may be necessary= and for the grading of each thereof.
rIi_I 'iS, each of the said resolutions were published for six days in the Salina Journal,
a daily newspaper published in said city, and being the official city paper, and the
majority of the resident property owners owning a majority of square feet of the lots
or real estate liable to taxation for the cost of said improveaents did not withintwenty days from the date of the last pu'_lication thereof file with the City Clerk a
sufficient protest in writing against the making of said improvements, no protests of

BE IT 011MAlNED by the Board of Co ar-iissioners of the City of Sal:sna., Kahsas.
Section 1. That it is necessary and :it is hereby ordered that Johnstovm Avenue
from the east line of Penn Avenue to the west line of Colum":;ia Avenue, in said city
be paved and graded tirith excavation necessary therefor, and graded to the established
paving grade and paved between the guttering lines thereof.
Section 2. That it is necessary and it is hereby ordered that Lincoln Street
from the west line of Reynolds Street to the east line of BroUcii•.ay Boulevard in said
city be paved and graded with excavation necessary therefor, arra graded to the es-
tablished paving grade and paved between the guttering lines thereof.
Section 3. That it is necessary and it is hereby ordered that Perbhing Street
from the north line of Beloit Avenue to the center line of Reprblic Avenue, in said
city be paved and graded ti�th excavation neces -ary therefor, ar.a graded to the
established paving grade and paved between the guttering lines thereof.
Sect'_on 4. That it is necessary and it is hereby ordered that Sljolcy Hill Lrive
from the east line of Oakdale Avenue to the east l=ine of Penn Avenue in ;:aid city
be curbed, guttered and paved with excavation necessary therefor, ani graded to the
established paving grade and paved between the guttering lines thereof.
Section 5,. That for the work and improvements herein P_-olil ed for the City
Engineer shall snake and .rile with tiie City Clerk on or before tiro 26th day of March ,
1951, complete plans and specifications for the curbin,,,, utter_ng, pa—vin aha ;riding
with excavation necessary therefor, of each of the streets or portions thereof Ces-

Concrete combined curb and ;utter on each side thereof,
30 inches bride from back to curb to pavin'-; line, curb
12 inches deep at back, gutter 6 inches deep, and the
necessary grading of each to the established paving
grade, within the limits of said streets hereinbefore
prescribed.
Section 6, That for the work and improvements herein provided for the City
Engineer shall make and file with the City Clerk on or before the 26th day of March ,

1951, complete plans and specifications for the curbing, guttering, paving• and grading
with excavation necessary therefor, of each of the streets or portions thereof des-
cribed in Section 1 to 3 of this ordinance, with the following type of improvement;

and within the limits of said street hereinbefore pre-
scribed,
anc! said Engineer shall on or before the same sate, submit to the Board of Com-
missioners under oath, detailed estimates of the cost of such work and improvements.
Section 7. That after such plans and specifications have been made andP re-
pared by the City Lngineer and filed with the City Clerk as aforesaid, the Board of
Commissioners may advertise by advertisement published ih the official cit;, paper of
t:e Cite of Salina, Kansas, for three consecutive days for the receipts of sealed
proposals for the improving of said streets with the kind of material named and
specified in the preceding sections hereof, and for the excavation and grading nec-
essary for the completion of such ?,ork, ana after the receipt of such proposals,
the said Board of Coni!issioners may and are hereby authorized ana directed to let
contracts for the improving of said streets with the materials selected by thew to
the lowest resr,onsible bidder or bidders therefor, as determined by said Board of;
COPUlissioners, and for such excavations and grading. ng. Said Board reserves the right
to reject any and all bids.
Secti_n 8. That for the improving of the above mentioned str_ets, such assets-
ments shall be made for the full costs thereof according to labs, on all lots and
pieces of land to the center of the block on either side of the streets to be i;-_-
proved according to the appraisers valuation thereof, without regard to the buildings
or improvements thereon for the distance to be improved.
Section 9. After passage and publication of this ordinance, the Board of Com-
miss_toners shall appoint three disinterested appraisers, householders, who after
having*, taken oath to make a true and impartial appraisement of all lots ana pieces of
land liable to assessment and taxation as aforesaid, as may be designated by the Loard
Of Cor-Tilissioners of said city, without regard to the building or improvements thereon
and after malting such a;:praisement shall r�_.turn the same to the F3oard of CWLiissioners
of said city and said Board of Com:-,issioners shall designate a time andplace for the
hearing of any complaints that may be made as to the value of any lots or pieces of
land app 'ui.sed as aforesaid, of t,rrich c=ue notice shall be given in the official city

paper, at ,ihich hearing the Board of Coimi issioners may alter any valuation of any lot
or piece of land, if, in their opinion, the same has been appraised too high or too low.
Section 10. That for the purpose of paying the cost of the work and improve-

m.ents in this ordinance provided for, the Board of Commissioners are hereby authorized
and directed to issue internal improvement bonds of the City - of Salm

not to exceed the contract price or cost of such improvements and to run for a period
of ten y( -:ars and be payable in ten equal installments, together with interest not to
exceed five per cent per annum, which bonds shall be made payable at the Fiscal
Agency of the State of Kansas, and for the purpose of paying principal and interest
on said bonds as they severally become due and payable, the Board of CoMrnissioners
shall apportion and assess against the lots and pieces of lane within the taxing
district of such improvements special assessments covering the cost of such improving
and the apportionment herein con'_ained shall hold good for all the installments that
are to be collected from the specific property chargeable with said improvements. Such
assessment and apportionment ordinance shall contain the total amounts of tax appor-
tioned to each tract, piece or parcel of land within the taxing district and shall
state the number of annual installments in which such tax is to be collected; and,
therefor the City Clerk shall annually, at the same time other taxes are certified,
certify to the County Clerk of Saline County, SalLna, Kansas, a full list of all
property liable for such work and improvements, together with the respective amounts
due on each of said tracts, pieces of land, which amounts shall include the annual
installments and interest on all unpaid balances for one year at the rate of not to
exceed five per cent per annum on such amounts so certified which shall be collected
as other taxes are collected; Provided, that t::e purpose of defraying the cost of
improving the intersections and areas formed by the crossing of streets and alleys,
and for the grading of said str:ets where the sa,,,e is provided for in this ordinance
as well as wl.ere the improver::ent is through or adjacent to property of the city for
which the city liable, the assessments will be made against all taxable property of
the city and paid by the city at large.
