That it is necessary and it is hereby ordered that the north side of Claflin Avenue from the wrest line of Pershing Street to the east line of Funston Street, in said city be curbed and guttered with encavation necessary therefore and graded and to the established paving trade to each side thereof,, as may be necessary for the completion of said work. Section 2. That it is necessary and it is hereby ordered that Cloud Avenue from the east line of Ninth Street to the wrest line of Simmons Street and the north side of Cloud Avenue from the wrest line of Highland Avenue to the west line of Sim- mons Street extended north, in said city be curbed and guttered with excavation nec- essary therefore and graded and to the established paving grade to each side thereof, as may be necessary for the completion of saidwork. Section 3. That it is necessary and it is hereby ordered that Charlotte Street in Kraft Manor Addition from: the east line of Highland Avenue to the wrest line of Si dons Street, in said city be curbed and `uttered with excavation necessary there- fore and graded to the established paving grade to each side thereof, as may be nec- essary for the completion of said work. For the work improvements herein provided for the City Engineer shall make and file with the City Clerk on or before the 26th day of liarch 1951, complete plans and specifications for the curbing, guttering and grading (with excavation necessary therefore) of each of the streets or portions thereof described in Sections 1 to 6 inclusive of this ordinance, T•rith the following type of improve;ients; Concrete combined curb and gutter on each side thereof 30 inches T._ide from back of curbing to navi _g line curb 12 inches deep at back, ly,gutter 6 inches deep, and the necessary grading of each to the established peving grade between the curb and gutter lines on each side thereof and within the limits of sa_"_d streets hereinbefore described, and said engineer shall on or before the same date, submit to the Board of Commissioners under oath, detailed estimates of the cost of s--ich work for such impzvvements. Section 10. That after such plans and s ecifi_ t' V ca ions SIZE ll have been :rade and prepared by the City Lngineer and filed with the City Clerk as aforesaid, the Board of Commissioners may advertise by advertisement puclished in the of city paper of the City of Salina, Kansas, for three consecutive days for the receipt of sealed Proposals for the improving of said streets with the Kind of material named and speci- fied in the preceding sections hereof, and for the excavation and grading necessary :or the caapleti n of such work, and after the receipt of such proposals the said Board of Commissioners may and are hereby authorized to let contracts for the improving of said streets with materials selected by them to the lowest responsible bidder or bidders thereof, as determined by said Board of Co:amissioners and for such excava.ti;n and grading. :paid board of Cormli.ssioners reserve the right to reject any and all bids. Section 11. That for the ihnproving of the above mentioned streets each assess- I ments shall be made for the full costs thereof according to Jai,-, on all lots andi;=. p ces of land to the center of the block on either side or both sides of the streets to be improved according to the appraiser's valuation thereof without regard to the buildings or improvements thereon for the distance to be improved. Section 12. After the passage of publication of this ordinance, the Board of COMMissioners shall appoint three disinterested appraisers, householders, who after having taken an oath to make a true and gimpartial appraisement for all lots and pieces of land liable to assessments and taxation for the cost of the improveiments herein pro- vided for, shall within five days from having been notified of their appointment, pro coed to appraise said lots and pieces of land liable to assessment and taxation as aforesaid, as may be designated by the Board of Co,;_._issioners of said city and said Board of COITII'iss Loners shall designate a time and place for the hearing of any com laints p that may be made as to the value of any lots and pieces of laud appraised as aforesaid, Of which due notice shall be given in the official city paper, at which hearing the Board of Commissioners may Ater any valuation of any lot or piece of land, if, in tzeir opinion, the same has been appraised too high or too low. Section 13. That for the purpose of paying the cost of the work and improve- ments in this ordinance, provided for, the Board of Commissioners are hereby- authorized and directed to issue internal improvement bonds of the City of Salina in an amount not to exceed the contract price or cost of such improvements and to run for a period of four years and be payable in four egiu.al installments, together with interest not to exceed five per cent per aiuzum, which bonds shall be made payable at the fiscal agency of the State of Kansas, and for the purpose of paying principal and interest on said bonds as they severally become due and payable, the Board of Corr,:issioners shall apportion and assess against the lots and pieces of land within the taxing district of such i:::provem ents, special assessments covering the cost of such improvements and the apportionment Herein contained shall hold good for all the instL;llilents that are to be toll cted from the specific property chargeable with said 'unprovements.
