AN ORDINANCE condemning certain land within the city limits of the City of Salina for
the use of said city in the construction of maintenance and replacement of a cer-
tain lateral sanitary sewer known as Lateral Sanitary Seger No. 255, and fixing
a benefit district therefore.
AREAS, the governing body of the City of Salina, Kansas, on February 5, 1951, by
Resolution 1209 found it necessary to appropriate certain property located in Saline
County, Kansas, as described in said Resolution for the use of said city in construc-
tion, maintenance and replacement of a lateral sanitary sewer to serve the said des-
cribed property, and directed that a survey, description and plat of said land so re-
quired be made.
WHEREAS, on the 12th day of February 1951, a survey, description and plat of the land
referred to in said resoltition was duly filed, SO NOW THM- FORE
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:

Section 1. The following described land is hereby condemned and appropriated for
the use of the City of Salina, Kansas, for the construction, maintenance and replacement

of a lateral sanitary sewer Down as Lateral Sanitary Sewer 255.
The west five (5) feet of Lots 6, 8, 10, 12,
14, 16, 18, 20, 22, 24, 26, 28, 30, 32, 34,
36, 38, 40 and 42 in Block 2, VanTrines Addi-
tion to the City of Salina, Kansas, and the
East five (5) feet of Lots 5, 7, 9, 11, 13,
15, 17, 19, 21, 232 25, 27, 29, 31, 33, 35,
37, 39 and 41 in said Block 2 in said Addition
to the City of Salina
now a part of the City of Salina, Kansas.
Section 2. It is found that the following described property within the present
city limits of the City of Salina, Kansas, will be specifically benefitted by reason
i of the acquisition of said land and the proposed improvement:
Lots 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16,
17, 18, 19, 20, 21, 22, 23, 24, 25, 26, 27,
28, 29, 30, 31, 32, 33, 34, 35, 36, 37, 38,
39, 40, 41 and 42 in Block 2, VanTrine's
Addition to the City of Salina, Kansas, Saline

County,
and that said described property shall be known as the benefit district.
Section 3. That C. L. Clark, City Attorney of said city is hereby ordered and
directed to forthwith prepare and present in the name of the Board of Commissioners
of the City of Sal'.na, Kansas, a written application to the Judge of the District Court
of Saline County, Kansas, praying for an order of appointment of commissioners to make
appraisement and assessment of damages arising from the appropriation of said real estate
described in Section 1 hereof and do and perform all things in and about procuring
and recording said order of appointment required by law.
Section 4. This ordinance shall take affect and be in force from and after its
publication in the official city paper.
