AN ORDI ,LA dCE creating and defining a certain lateral sanitary sewu-er district in the
City of Salina, Kansas, designated as Lateral Sanitary Seiver District Number 257
and providing for the construction of a lateral sanitary sewer in said lateral
Sanitanr Sei%;er ilistrict number 257, so created, and providing for the payment of
the cost thereof and for the levzring of special assessments anainst the property
in said district for the pa�Tnent of the cost of such construction and for the
issuing of },onds to pay the cost thereof.

BE I1 ORDAI ?ED by the Board of Coy ,issi oners of the Cit;- of Salina, Kansas:
Section 1. Lateral Sanitary Sewer District 257. That there be and there is here-
by created Lateral Sanitar7r Sewer District in the Ci t7T of Salina, Kansas, ,: iich shall
be and it is hereby desig-Fated as Lateral SanitarT Server District rTumber 257 and 7.7hich
district shall include all the following described propertir in the Citi- of Salina,
Kansas, to -i -%it :
Benefit District: Lots 8, 9, 10, 11, 12, 13 and lb
all in Block 7, Sunrise Addition in City of Salina,
Saline Count-,-, Kansas.
Section 2. It is necessary and it is hereby ordered that an eight inch V. C. P.
literal sanitar-., seti^rer :%rith all necessary connections, manholes, flushing: tanks, and
other appurtenances be constructed and hu_It in and to serve s�_:.id Lateral Sanitary Se-er
District Number 257 as created by Section 1 of this ordinance along, the follo7.ing course,
to-v,it :
An 8 inch clay pipe sevrer, beginning at an existing
manhole-v.rhich is located at the southwest corner of
Lot 13, Block 8, Sunrise Addition, thence southeast
along right -of -xray for utilities to the northeast
corner of Lot 1-2, Block 7, Sunrise Addition, where
a manhole will be constructed; thence northeast along
ri,7ht-of-J; v for utilities to the southwest corner of
Lot 8, Block 7, Sunrise Addition where a manhole mill
be constructed which will be te-^minus of lateral. 257.
Section 3. That the City Ens ineer shall on or bef ora lanuary- 15,} k951,� y repare
and file in the office of the City Clerk, plans and specifications for the construction
of the lateral sanitai, ,T sewer provided for in the preceding sections of t fiis ord nance
1-:riich shall be of prayger character to serve the property lying -ithin the district
which such sewer is to be constructed and s-iall on or before the same date prepare and
submit to the Board of Commissioners a detailed estimate under oath of the cost t}:ereof.
That hereafter the City Clerk shall advertise for three consecutive days in ti -Ile official
city paper for sealed Proposals for the building and construction of such server accord-
ing to such plans and specifications, v.hich proposals shall be ;
Section 4. That for the cost of building and construcinsr, such sewer, special
assessments shall be made "or the full cost Hereof on a]_1 lots and pi: ces of land

zithin and for i-onich such sewer shall be built, according to the appraised value there-
of wJthout regard to the improvements or bi,ii.lciings thereon.
Section 5. After the passage and ublication of this ordinance, the Board of Com-
missioners shall appoint three disinterested appraisers, who h:_,vi.ng taken oath to make

a. true: and impartial appraisement of all lots and pieces of land to taxation for the
cost of such improvements, shall within five days after having been notified for their

appointments proceed to appraise all of the lots and nieces of land lithin such district
liable to assessment and taxation as a.foresai(a, wri.thout regard to the buildings or im-
provements thereon, ala after making such appraisements, shall return to the Board of
Co.missioners of said city and said Board shall designate a time for a special meeting
of said Board for the purpose of hearing an-,,- complaints that may be made as to the value
of amr lot or piece of _land appraised as aforesaid, of which special session due notice

shall be iven in the official city paper, at which special session said Board may alter
any valuat=ion of any lot or piece of land if, in their opinion, the same has been appraised
too high or too lour.
jSection 6. `Die special assessment herein provided for ma -:T be paid by the person
liable therefor in four approximately equal annual instar_lments but the o.�,-ner of any
property liable to .such assessment may 7,ithi n thirty days from the date of determ_ning
the amount assessed against the property, pay tfle same in full and his property shall
not be liable for any assessments for the cost of such improvements, and bonds as here-
inafter provided for shall be issued in the amount of tlL-, cost of such im, rovements re-
main -n,- unpaid at the end of the thirty dans from the time such assessment is fixed.
Section 7. For the purpose of paying for the work and improvements in this ordinance
provided for, the Board of Conimiss'_oners may and are herebir authorized and directed to
issue improvement ,bonds of the City of Salina., Kansas in an amount not to exceed the
cost of such improvement, and to run for a period of four years and be payable in four
approximately equal annual installments, tosret:er with interest not to exceed five per

cent per annum, Teich bonds shall be issued and payable according to la,:,; and for the
purpose of paying the principal and interest on aid bonds as the7T ses.-erallsT become due
and payable the Board of Commissioners shall apportion and assess 7,ainst the lots and

pieces of land vri_thin the taxing, district of such improvements, special assessments
covering the cost of such improvement and apportionment therein contained shall hold
good for 1 of the installments that are to be collected from the s )edfic property

chargealbe with such improvements; such assessment and apportionment ordinance shall

contain the total amount of tax apportioned to such tract, piece or parcel of land

within the taxinc district and shall state the number of annual installments in i^nick
such tax is to be collected; and thereafter the City Clerk shall annually, at the same
time that other taxes are certified, certifl -v to the Counter Clerk of Saline County,
Kansas, a full list of all. property lia'.5le for such ti;ork and improvements, together v.:ith
the respective num'^eyed amounts due on each of said tracts, pieces or parc.ls of land,

nnich amounts shall include tae annual installments and interest on all unpaid balances
for one v:_,ar at the rate of not to exceed five per cent per annusl, on such amounts so
certified, v,dhich shall be collected as other taxes are collected.
Section 8. This ordinance shall take effect and be in force from and after kkK its
