Lateral Sanitary Seaer District Number 255. That there be and there is hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which sha.i_1 be and it is hereby desi5nated as Lateral Sanitary Sewer Listrict Humber 255 and which district shall include all of the following described property in the City of Salina, Kansas, to -wit: Benefit District - Lots 5, 7, 9, 11, 13, 15, 17, 19, 21, 23, 25, 27, 29, 31, 33, 35, 37, 39 and 41 Block 3 and Lots 6, u, 10, 12, 14, 16, 18, 20, 22, 2 ) 26, 23, 30, 32, 34, 36, 38, 40 and 42, Block 2, all in VanTrines Addition, City of Salina, Kansas. Section 2. It is necessary and it is hereby ordered that an eight inch V. C. P. lateral sanitary sewer with all necessary connections, manholes, flushing tanks and other appurtenances be constructed and built in and to serve said Lateral Sanit_,ry Sewer District 255 as created by Section 1 of this ordinances along the following course, to-:^rit : An 8 inch clay pipe sevyer beginning at an existing manhole 23 feet south of the north property line of Cran-Cord Avenue and 132.5 feet east of the east propert, line of Second Street; thence west on Crawford Avenue to a manhole to be constructed in the intersection of Crawford Avenue and Second Street; thence north in Second Street 912.5 feet i,.here a man- hole will be constructed thus which will be the t=erminus of lateral. Section 3. Lateral Sanitary Sever District Number 256. That there beand there is hereby created Lateral Sanitary Sevier District in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Se>>rer District Number 256 and which district shall include all of the following described property in the City of Sal na, Kansas, to-wit.- Benefit o-wit. Benefit District - Lots 5, 72 91 11, 13, 15, 17, 19, 21, 23, 25, 27, 29, 31, 33, 35, 37, 39 and 41., Block 2, VanTrine Addition, City -of Salina, Kansas. Section 4. That the City Engineer shall on or before �clOber 1950, prepare prepare and file in the o--+' 'ice of the City Clerk, plans and specifications for the con- struction of the lateral sanitary severs provided for in the preceding sections of this ordinance Maich shall be of proper character to serve the property lyin; within the dis- trict v.rithin -which such sewers are to be constructed and shall on or before the same date prepare and submit to the Board of: Commissioners a detailed estimate under oath of the cost thereof. That thereafter the City Clerk shall advertise for three conse- cutive days in the o ficial city paper for sealed proposals for the budding and con- struction of such sewers according to such plans and specifications, v,>hich proposals shall be filed vdth the City Clerk on or before the time fixed in such notice, at v,,hich time the Board of Commissioners may let a contract for the bu_i.lding and construction of such setivers to the lovwest and best res;-),-,nsible bidder or bidders therefor, if there be any :;hose bid does not exceed the estimated cost thereof., but said Board shall reserve the ri,_ht to reject any or all such proposals, and if no biu shall be received within such estimate, the Board of. Commissioners shall have thepower to do such v;ork and make such improvements within the esti:ated cost thereof as provided b lava. Section 6. That for the cost of bu_1din- and constructing such se-.,(rs, special assessments shall be made for the full cost thereof on all lots and pieces of land -cwithin the sewer districts within and 'or -which such sewers shall be bu:_lt, according to the appraised value thereof, -vwithout regard to the irprovements or buildings thereon Section 7. After the passaTe andprblication of this ordinance, the Board of Com- missioners shall appoint three disinterested appraisers, echo having taken an oath to make a true and impartial appraisement of all lots and pieces of land to taxation for the cost of such improvements, shall veLthin five days after having been notified of their appointment proceed to appraise all of the lots and pieces of land vrithin such districts liable to assessment and taxation as aforesaid, without regard to the bu_.ld- Ings or ireprovements thereon, and after making such appraisements shall return to the Board of Commissioners of said city and said Board shall designate a time for holding a special meeting of said Board for the purpose of hearing any complaints that may be made as to the value of any lots or pieces of land appraised as aforesaid, of -which special session due notice shall be ,_given in the official city paper, and at Vihich special session said Board may alter any valuation of any lot or piece of land, if, in their opinion, the same has been appraised too high or too low. Section 8. The special assessment herein provided :for may be paid by the person liable there"or in four appro_}_imately equal annual installments but the ovMer of any property liable to such assessment may vd.thin thirty days from the date of determining the amount assessed against the pro;;erty pa,7 the sum in full and his property shall not be liable for assessment for the cost of such improvements, and bonds as hereinafter provided for shall be issued in the amount of the cost o. - such improvements remaining unpaid at the end of thirty da -,,7s from the time such assessment is Fixed. Section 9. For the purpose of paying; for the work and imp ,ovements in this ordinance provided for, the Board. of Commissioners are hereby authorized and directed to issue bonds of the City of Salina in an amount not to exceed} the cost of such improvements and to run for a period of four years and be payable in four approximately equal annual installments, together m1th interest not to exceed five per cent per annum, which bonds shall be issued and payable according to law; and for the purpose of paying the principal and interest on said bonds as they severally become due and payable, the Board of Commissioners shall apportion and assess against the lots or pieces of land-vdthin the taxing district of such improvements, special assessments covering the cost of such improvement and apportionment therein con- tained shall 'hold good for all of the instalments that are to he collected from the specific property chargeable vrith such improvements, such assessment and apportion- ment ordinance shall contain the total amount of ta: apportioned to each tract, piece or parcel of land within the taxing, district and shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually, at the same time other taxes are certified, certify to the County Clerk of Saline County, Kansas, a full list of all property liable to such -work and improve - menta, together -with the respective amounts due on each of said tracts, pieces or parcels of land, :hich arounts shall include the annual installments and interest on all unpaid balances for one gear at the rate of not to exceed rive per cent per =um, on such amount so certified, :-hich shall be collected as other taxes are collected. Section 10. This ordinance shall take effect and be in Force from and after its adoption and publication once in the official city paper.
