AN ORDINANCE creating and defining a certain lateral sanitary sewer districts in
the City of Salina, Kansas, designated as Lateral Sanitary Sewer Districts DH -33
to DH -41, inclusive, and providing for the construction of lateral sanitary sewers
in said Lateral Sanitary Sewer Districts DH -33 to DH -41 Inclusive, so created,
and providing for the payment of the cost thereof and for the levying of special
assessments against the property in said district for the payment of the cost of
such construction and for the issuing of bonds to pay the cost thereof.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. Lateral Sanitary Sewer District DH -33. That there be and there is
hereby created Lateral Sanitary Sever District in the City of Salina, Kansas, which
shall be and it is hereby designated as Lateral Sanitary Sewer District DH -33 and
which district shall include all the following described property in the City of
Salina, Kansas, to -wit:

Benefit District: All of Block 1; and Lots 1, 2, 3, 4, 5,
6, 7, 8, 9, 10, 11, 12, 14, 15, 16, 18, 19, 20, 21, 22, 23,
24, 25, 26, 27, 28, 29, 30, 31, 32, 33, 34, 35, 36, 37, 38,
39, 40, 41, 42, 43, 44, 45, 46, 47, 48, 49, 50, 51 and 52
of Block 6, Edgemere Addition.
Section 2. It is necessary and it is hereby ordered that an eight inch V.C.P.
lateral sanitary sewer with all necessary connections, manholes, flushine tanks, and
other appurtenances be constructed and built in and to serve said Lateral Sanitarj
Sewer District Number DH -33 as created by Section 1 of this ordinance along the follow-
ing course, to -Twit:

terminus of Main Sewer DH -A and located in the intersection of
Crawford Avenue and Choctaw Drive and running south approximately
170 feet; thence west approximately 850 feet; thence south approx-
imately 105 feet; thence southwesterly approximately 120 feet;
thence south ao,!�-roximately 2,340 feet; thence east approximately
890 feet where a manhole will be constructed which will be the
terminus of Lateral DH -33,
Section 3. Lateral Sanitary Sewer District Number DH -34. That there be and
there is hereby created Lateral Sanitary Sewer District in the City of Salina, Kai sas,
which shall be And it is hereby designated as Lateral Sanitary Sewer District Number
DH -34 and which district shall include all the followin- described property in the
City of Salina, Kansas, to -wit:
Benefit District: Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11,
12, 14, 15, 16, 17, 18, 19, 20 & 21, Block 2, Edgemere Addition.
Sectign 4. It is necessary and it is hereby ordered that an eight inch V. C.P.
lateral sanitary sewer with all necessary connections, 211anholes, flushing tanks
and other appurtenances be constructed and built in and to serve said Lateral Sanitary
Sewer District Number DH -35 as created by Section 3 of this ordinance along the
following course, to -,sit:
An 8 inch clay pipe sewer beginning in a manhole to be con-
structed in Cypress Drive, midway between Commanche Drive and
Birch Drive and running south approximately 105 feet; thence
east approximately 275 feet; thence southeasterly approximately
580 feet; where a manhole will be constructed which will be the

Section 5. Lateral Sanitary Sewer District NLrnbor DH -35. That there be and
there is hereby created Lateral Sanitary Sewer District in the City of Salina,
Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District
Number DH -35 and which district shall include all the following described property
in the City of Salina, Kansas, to -wit:
Benefit District: Lot 13 of Block 2, Edgemore Addition.

Section 7. Lateral Sanitary Sewer District Number DH -36. That there be and

there is hereby created Lateral San itary Sewer District in the City of Salina, Kansas,
which shall be and it is hereby designated as Lateral Sanitary Sewer District Number

DH -36 and which district shall include all the following described property in the

City of Salina, Kansas, to -wit:
Benefit District: All of Block 8; and Lots 1, 2, 3, 4,
5, 6, 7, 8, 90 10, 11, 12, 13, 14, 15, 160 17, 18, 19,
20, 210 22, 23, 24, 25, 26, 27, 31, 32, 33, 34, 35, 36, 37,
38, 39 and 40 of Block 4, Edgemere Addition.
Section 8. It is necessary and it is hereby ordered that an eight inch V.C.P.
lateral sanitary sewer with all necessary connections, manholes, flushing tanks,
and other appurtenances be constructed and built in and to serve said Lateral San-
itary Sewer District Number DH -36 as created by Section'? of this ordinance, along
the following course, to -wit:
An 8 inch V. C. P. clay pipe sewer beginning in a manhole to
be constructed in the center of the easement and located at
the southwest corner of Lot 21, Block 4, Edgemore Addition,
and running south approximately 1800 feet; thence southwesterly
approximately 70 feet, where a manhole will be constructed
which will be the terminus of Lateral DH -36.
Section 9. Lateral Sanitary Sewer District Number DH -37. That there be and
there is hereby created Lateral Sanitary Sewer District in the City of Salina,
Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District
Number DH -37 and which district shall include all the following described propery
in the City of Salina, Kansas, to -wit:
Benefit District: All of Block 3 and all of Block 9 and
Lots 28, 29 and 30 of Block 4, Edgemere Addition.
Section 10. It is necessary and it is hereby ordered that an eight inch V.C.P.

and other appurtenances be constructed and built in and to serve said Lateral Sanitary
District Number DH -37 as created by Section 9 of this ordinance along the follow#Ig

constructed in the center of the easement and located at
the southeast corner of Lot 12, Block 4, Edgemere Addition,
and running east approximately 160 feet; thence southeasterly
approximately 230 feet; thence southwesterly approximately
165 feet; thence south approximately 1360 feet; where a manhole
will be constructed which will be the terminus of Lateral DH -37.

Section 11. Lateral Sanitary Sewer District Number. That there be and there
is hereby created Lateral Sanitary Sewer District in the City of Salina, Kansps,
which shall be and it is hereby designated as Lateral Sanitary Sewer District Number
DH -38 and which district shall include all the following described property in the City
of Salina, Kansas, to -Twit:
Benefit District: All of Block 5 and all of Block 7, Edgemere
Addition.
Section 12. It is necessary and it is hereby ordered that an eight inch V.C.P.
lateral sanitary sewer with all necessary connections, manholes, flushing tanks, and
other appurtenances be constructed and built in and to serve said Lateral Sanitary

District Number DH -38 as created by Section 11 of this ordinance along the following
course, to - wi. t :
An 8 inch clay pipe sewer beginning in a manhole to be con-
structed in Cypress Drive, midway between Birch Drive and
Willowy Drive and running south approximately 1920 feet; thence
southeasterly approximately 400 feet; thence east approximately
80 feet, where a manhole will be construction which will be
the terminus of Lateral DH -38.
Section 13. Lateral Sanitary Sewer District Number DH -39. That there be and
there is hereby created Lateral Sanitary Sewer District ih. the City of Salina, Kansas,
which shall be and it is hereby designated as Lateral Sanitary Sewer District Number
DH -39 and which district shall include all the following described property in the

Benefit District: Lots 53, 54 and 55, Block 6, Edgemere Addition
Section 14. It is necessary and it is hereby ordered that an eight inch V.C.P.

lateral sanitary sewer with all necessary connections, manholes, flushing tanks, and
other appurtenances be constructed and built in and to serve said Lateral Sanitary
Sewer District Number DH -39 as created by Section 13 of this ordinance along the follow-
ing course, to-wit.-

constructed in the center of the easement and located at the
southwest corner of Lot 53, Block 6, Edgemere Addition, and
running north approximately 220 feet, where a manhole will be
constructed which will be the terminus of Lateral DH -39,
Section 15. Lateral Sanitary Sewer District Number DH -40. That there be and there
is hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which
shall be and it is hereby designated as Lateral Smi.tary Sewer District DH -40, and which
district shall include all the following described property in the City of Salina,
Kansas, to -wit:
Benefit District: Lot 17, Block 6, Edgemere Addition
Section 16. It is necessary and it is hereby ordered that an eight inch V.C.P.
lateral sanitary sewer with all necessary connections, manholes, flushing tanks, and
other appurtenances be constructed and built in and to serve said lateral sanitary
sewer District Number DH -40 as created by Section 15 of this ordinance along the follow-
ing course, to -Twit:.
Section 21. That for the cost of building and constructing such sewers, special
assessments shall be made for the full cost thereof on all lots and pieces of land
within and for which such sewers shall be built, according to the appraised value

mately 50 feet; thence southeasterly approximately 50 feet, where
a manhole will be constructed which will be the terminus of Lateral
DH-40.
Section 17. Lateral Sanitary Sewer District Number DH-41. That there be and there
is hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall
be and it is hereby designated as Lateral Sanitary Sewer District DH-40, and which

district shall include all the following described property in the City of Salina,
Kansas, iro-wit
Benefit District: Lot 13, Block 6, Edgemere Addition
Section 18. It is necessary and it is hereby ordered that an eight inch V.C.P.
lateral sanitary sewer with all necessary connections, manholes, flushing tanks and

other appurtenances be constructed and built in and to serve said Lateral Sanitary
Sewer District Number DH-41 as created by Section 17 of this ordinance along the follow-
ing course, to-wit:
An 8 inch clay pipe sewer beginning in a manhole to be constructed
in the center of the easement and located at the southeast corner
of Lot 12, Block 6, Edgemere Addition, and running north approxi-
mately 75 feet; thence northwesterly approximately 40 feet, where
a manhole will be constructed which will be the terminus of Lateral
DH-41.
Section 19. That the courses of each of the lateral sanitary sewers, as aforesaid,
are within the confines of public streets and utility rights-of-sway, all of which are
dedicated to the public in perpetuity.
Section 20. That Murray A. Wilson, a duly qualified Civil Engineer, shall on or

before the n clay of August , 1952, prepare and file in the office of the City
Clerk, }dans and specifications for the construction of the lateral sanitary sewers
provided for in the preceding sections of this ordinance which shall be of proper
character to serve the property lying within the district for which such sewer is to be
constructed and shall on or before the same date prepare and submit to the Board of
Commissioners a detailed estimate under oath of the cost thereofq That thereafter,
the City Clerk shall advertise for three it consecutive days in the official city paper
for sealed proposals for the building and construction of such sewers according to such
plans and specifications, which proposals shall be filed with the City Clerk on or before
the time fixed in such notice, at which time the Board of Commissioners may let a contract
for the building and construction of such sewers to the lowest and best responhible
bidder or bidders therefor, if there be any whose bids do not exceed the estimate cost
thereof, but said Board shall reserve the right to reject any or all such proposals, and
if no bid shall be received within such estimate, the Board of Commissioners shall have
the power to da such work and make such improvements within the estimated cost thereof
as provided by law.
Section 21. That for the cost of building and constructing such sewers, special
assessments shall be made for the full cost thereof on all lots and pieces of land
within and for which such sewers shall be built, according to the appraised value
thereof, without regard to the improvements or buildings thereon.
Section 22. After the passage and publication of this ordinance, the Board of
Commissioners shall appoint three disinterest appraisers, who having taken oath to
make a true and impartial appraisement of all lots and pieces of land to taxation for
the cost of such improvements, shall within five days after having been notified for
their appointments proceed to appraise all of the lots and pieces of land within such
district liable to assessment and taxation as aforesaid, without regard to the buildings
or improvement s thereon, and after making such appraisement, shall return to the Board

of Commissioners of said city and said Board shall designate a time for a special meet-
i
ing of said Board for the purpose of hearing any complaints that may be made as to the
value of any lot or piece of land appraised as aforesaid, of which special session due
notice shall be #iven in the official city paper, at which special session said Board
may alter any valuation of any lot or piece of land, if, in their opinion, the same
has been appraised too high or too low.

Section 23. The special assessment herein provided for may be paid by the person
i
liable therefor in ten approximately equal annual installments but the owner of
any property liable to such assessment may within thirty days from the date of deter-
mining the amount assessed against the property, pay the same in full and his property
shall. not be liable for any assessments for the cost of such improvements, and bonds
as hereinafter provided for shall be issued in the amount of the cosi of such improve-
ments remaining unpaid at the end of the thirty days from the time such assessment is
fixed.
Section 24. For the purpose of paying for the work and improvements in this
ordinance provided for, the Board of Commissioners may and are hereby authorized and
directed to issue improvement bonds of the City of Salina, Kansas, in an amount not to
exceed the cost of such improvement, and to run for a period of ten years and be
payable in-t,,,_� approximately equal annual installments, togehter with the interest
not to exceed five per cent per annum, which bonds shall be issued and payable accord-
ing to law; and for the purpose of paying the principal and interest on said bonds as
they severally become due and payable the Board of Commissioners shall apportion and
assess against the lots and pieces of land within the taxing district of such improve-

ments, special assessments covering the cost of such improvements and apportionment there
in contained shall hold good for all of the installments that are to be collected from
the specific property chargeable with such improvements; such assessment and apportionment
ordinance shall contain the total amount of tax apportioned to such tract, piece or
parcel of land within the taxing district and shall state the number of annual install-
ments in which such tax is to be collected; and thereafter the City Clerk shall annually,
at the same time that other taxes are certified, certify to the County Clerk of Saline
County, Kansas, a full list of all property liable for such work and improvements,
together vrith the respective numbered amounts due an each of said tracts, pieces or parcels
of land, which amounts shall include the annual installments and interest on all unpaid
