AN ORDIiIANCE creating and defining certain Interceptin ewer Lstrict in the City of
Salina, designated as Intercepting Sewer District "AA";providing for the paying of
the cost thereof and for the levying of special assess,:ents against the property in
such district for the payment of such cost, and -for t' -,e issuing of bonds therefor.

BE IT ORDA7IIED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. Intercepting Sewer District 11AA11. That the preli.inary recitals, afore-
said, are hereby made a part of t -pis ordinance. That there be and there is hereby
created, an intercepting sewer district in the City of Salina, which shall be designated
as Intercepting Sewer District t1AAi1, which shall include all of the following desctibed

Listrict, together with all necessary connections, maniiol;s and other appurtenances, be
constructed and built as Intercepting Sewer Listrict "AA", along t'.e following described

Beginning in the intersection of Ash Street and Ohio Street in the City of
Salina at a point intercepting the Ash Street main sanitary sewer, thence
proceeding south in Ohio Street as a 24 -inch sewer 4j4OO feet where the 24 -
inch seTrer terminates at a ,anhole to be there orstructed in that street;
then continuing south in said street as a 16 -inch sanitary sewer force main
a distance of 471 feet to a point where a sewage pumping station is to be
constructed, thence continuing south from said pumping station in said street
as a 24 -inch sewer a distance of 552.3 feet terminating at a manhole to be
there const-•ucted at the point thereof, being located approximately 185 feet
north of the center of Crawford Street, thence proceeding west from said Pan -
hole in and through utility right-of-way, alleys and streets as a 21 -inch sewer,
a distance of 1,832 feet to the center line of Amore Drive, thence south 175
feet as a 21 -inch sewer to a point in Crawford Street, thence west 611 feet as
a 21 -inch sewer to the point of the intersection of the center line of Front
Street and Crawford Street to an existing manhole and at a point of the inter-

sha'l be constructed as a 12 -inch sewer commencing at an existing manhole at
the intersection of Fifth Street and Bond Street, being at a point of inter --
section with main sewer "K", thence east in Bond Street 253 feet, to an exist-
ing manhole at the intersection of Fourth Street and Bond Street where said
12 -inch line will intercept main sewer "X".
Section 3. That Murray A. Wilson, a duly qualified civil engineer, sh�_.11 on or before
the th day of Duly , 1952, prepare and file in the o:::fice of the
City Clerk plans and specifications for the construction of the Intercepting Sewer
Listrict "AA", provided for in the preceding section of this ordi,.ance, wiich shall be
of the proper character and d ong the proper course and at the proper grade to serve
the property lying; within the district within which such sewer is to be constructed,
and shall on or before said date, prepare and submit to the Board of Commissioners
detailed estimates, under oath, of the cost thereof. That thereafter the City Clerk

shall advertise for three consecutive days in the City paper for sealed proposals, for
the building and cons:_-,uction of such a sewer according to such plans and specifications,
which proposal shall be filed with the City `'lerk on or before the ti.je fixed in such
notice, at which time the Board of Commissioners may let a contract for the bui._ding

and construction of such a sewer to the lowest responsible bidder or bidders therefor;

provided that the cost thereof shall not exceed the estimated cost thereof and provided
further that said Board shall reserve the right to refuse any and a=1 such proposals;
j
and that if no responsible bids shall be received within said est'L:iated cost, said Board
jmay proceed and build such sewer within such estimated cost.
Section 4, That for the cost of building and constructing such a sewer, special
assessments shall be made for the full cost thereof, on all lots or pieces of land with-
in the Intercepting Sewer Listrict within which such ;Hain sewer shall be bullt, accord -

Section 5. After the passage and publication of this ordinance, the Board of Com-
missioners shall a point three disinterested appraisers who after having taken an oath
to make a true and impartial appraisement of all lots or pieces of land liable to taxa-
tion for the cost of such improvements, shall within five days after having been notified
of their appointment proceed to appraise all of the lots or pieces of land within such
district, liable to assessment and taxation as aforesaid, without regard to the build-
ings or improvements thereon, and of er making said appraisements shall return the same
to the .Board of Com:,rissioners of said city and said Board shall designate a time for
holding a special meeting of said Board for the purpose of hearing any complaints that
may be made as to the value of any lot or piece of land appraised as aforesaid, of which
special session due notice shall be riven in the official city paper, and at which
special session said Board may alter any valuation of any lot or piece of land, if, in

j their opinion, the same had been a -:praised too high or too low.
Section 6. The special assessments herein provided for may be paid by the person

liable therefor in four approximately equal annual instalments but tiie owner of any

Section 7. For the purpose of paying for the work and improvements in this Ordinance
provided for, the said Board of Coluiissioners are hereby authorized and directed to issue
improve' --lent bonds of the City of Salina in an amount not to exceed the cost of such
i:provement, and to run for a period of Fuur and be payable in Four
approximately equal annual installrlents, together with interest not to exceed b ve
per cent per annum, which bonds shall be issued and payable according to law; and for

due and payable, the Board of Commissioners shall apportion and assess against the
lots mui or pieces of Land within the taxing districts of such improvements, special

assessments covering the cost of such improvements and the ap)o t_onment therein con-
tained shall hold good for all of the installments that are to be collected from the
specific property chargeable with said improvements. S -..ch assessment and apportionment

ordinance shall contain the total amount of tax apportioned to each tract, piece or
parcel of land within the taxing district and shall state the number of annual in-
stallments in which such tax is to be collected; and thereafter the City Clerk shall
annually, at the same time other taxes are certified, certify to the County Clerk of
Saline County, Kansas, a full list of all property liable for such work and improvements,
together with the respective amounts due on each of said tracts, piece or parcels of
land, utiich amounts shall include the annual installments and interest on all unpaid
balances for one year at the rate of not to exceed Fid ve per cent per annum, on such
amounts so certified, which shallbe collected as other taxes are collected.
Section 8. This ordinance s=-la.11 take effect and be in full force fro n and after
