That there be and th;.-e is hereby created Lateral Sanitary Serer Listrict in the City of SaIJ na, IS=ansas, which shall be i and it :is hereby desi ;Hated as Lateral Sanitary Se-.er Listrict Number 2L,4 and which I :istrict shall include all the following described p_-operty in the City of Salina., Kansas, I to -wit: Benefit Listrict: All of Block 91 Sunrise Addition. Section 2. It is necessary and it is hereby ordered that an eight inch V. C. F. lateral sanitary sewer with all necessary connections,r.anlioles, flushing tank and other appurtenances be constructed and built in and to serve said Lateral Sanitary Se -,,Ter i Listrict Plumber 284 as created by Section 1 of this ordinance along .,rich the following course, to -wit: An 8 inch clay pipe sewer beginning at an b existing rnanhl of Sunrise Lrive and 165 feet north of the north line ofeep bl?ic;center thence northeasterly 31 feet to the center line of easement; thence east 203 feet, thence southeasterly 150 feet; thence southeasterly 50 feet inaere a clean - Out will be constructed i-rh ich will be the terminus of Lateral ?dumber 284. Section 3. That the City Lngineer shall on or before prepare and file in tae office of the City clerk, plans and specifications for the con- struction of the lateral sanitary sewer provided for in the preceding sections of this ordinance which shall be of proper character to serve the propertl7 lying within the dis- trict which such sewer is to be constructed and shall on or before the sane date prepare and submit to tr.e Board of COMIllissioners a detailed estimate under oath of the cost thereof. That hereafter the City Clerk sh�11 advertise for three consecutive days in the official city paper for sealed proposals for the building and construction of such sewer according to such plans and specifications, w:ich proposals shall ':)e filed with the City Clerk on or before the tLae fixed in such notice, at :aich time the Board of Comnissio.ers i may let a contract for the bailding and construction of such sewer to the lowest and best resl.onsible bidder or bidders therefor, if there be any whose bids do not exceed the esti':ated cost thereof, but said Board shall reserve the ri-ht to reject any or all such Proposals, and if no bi shall be received within such esti.i aate, the Board of COMmlissioners shall have the power to do such work and make such i_7provements within the esti a.teo: cost thereof as provided by law. Section 4. That for the cost of building and constructing such sezJer, special assessments shall be made for the full cost thereof on all lots algid pieces of land within and for which such sewer shall be b�:_.i_t, according to the appraised value thereof, wit^.out regard to the irnpy�vements or buildings thereon. 1 Section 5. After the passage and publicationof t.- ordiazance, the Board of Commissioners shall appoint three disinterested appraisers, W110 hEving taken oath to make a true and impartial appraisement of all lots and pieces of la_d to taxation Tor the cost of such improvements, shall within five days after hc:.ving been notified for t'rieir appointments proceed to appraise all of the lots and pieces of land within such district liable to a:ssess_:.ent and taxation as aforesaid, Without regard to the build- ings or improvements thereon, and after making such an raiserae P rrl s, shall return to the Board of Commissioners of said city and said Board shall designate a time for a special meeting of said Board for the purpose of hearing any co-: laints that mai% be made as to the value of any lot or piece of land appraised as aforesaid, of' rhich special session i due notice shall be riven in the official city paper, at rhi cYi special session said Board may alter any valuation of any lot or piece of land if, in their opinion,the same L:as been appraised too high or too low. Section 6. The special assessment herein provided for may 'be paid by the person liable therefor in four approximately equal annual installments but ti:e owner of any i property liable to such assessment may within thirty days fr<„:1 the date of determining the amount assessed against the property, pay the same in full and '_is property shall not be liable for any assessments for the: cost of such improvements, and bonds as herein- after provided for shall be issued in the amount of the cost of such improvements re- maining unpaid at the end of the thirty days from the time such assessment is fixed. Section 7. For the purpose of paying for the work r o k a zd ir.rprovements in this ordin- ance provided for, the Board of Commissioners may and are hereby authorized and directed � to issue ipjprovement bonds of the City of Salina, Kansas in an amount not to exceed the cost of such improvement, and to run for a period of four years and be payable in four approxi uately equal annual installments, together with interest not to exceed Live per cent per annum, which bonds shall be issued and payable according to law; and for the purpose ofair' P ying the principal and interest on said bonds as they severally become due and pay -able the Board of Corunissioners shall apportion and assess against the lots and pieces of land;-ithin the toxin” district of such improvenients, special assessments cover - Ing the cost of siich improvement and apportionment therein contained shall hold :_rood for all of the installments that are to be collected from the specific property chargeable 0 with such improvements; such assessment and apportionment ordinazzce shall contain the total amount of tax apportioned to such tract, piece or parcel of land vrithin the t axi ng istrict and shall state the number of a nz _ uel installraents in :Ylich such -`.:ax is to be collected; and t-ereafter the City Clerk shall annually, at the se ti taxes are certified -Lie that other , certify to the County Clerk of Salink County, Kansas, a full list of all property liable for such ,,ork and :iprovenents, together irith th4 respective numbered amounts due on each of said tracts, pieces or parcels of land, which a:,iounts shall include the mnual installments and interest on all unpaid balances for one year at the rate of not to exceed five per cent per annum, on such amounts so certified, which shall be collected as other taxes are collected. i Section 6.
