AN ORDINANCE ratifying and confirming the contract of Frank Fessler for the
alterations and equipping of the Salina Public Library for the City of
Salina, Kansas.
j BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas

I Section 1. That the acceptance by the City of Salina, Kansas of the
proposal of Frank Fessler, hereinafter referred to as "Contractor" as sub-
mitted to the said Board of Commissioners on May 26, 1952, is found tobe

the lowest and best bid for the work to be performed, and the contract award-
ed by the Board of Commissioners of said city to said contractor and signed
on behalf of the City of Salina by its Mayor on May., 1952, for the alter-

ations and equipping of the Salina Public Library, at and for the unit prices
for said work contained in said proposal, which proposal and contract is hereby
referred to and made part of this ordinance, be and the same is hereby rati-
fied and confirmed, said proposal being within the estimated cost of said
i
improvements as shown by the sworn estimates of a competent engineer for such
purpose and being on file in the office of the City Clerk, which estimates
i
are hereby referred to and made parts of this ordinance,
Section 2. Said improvements shall be built, constructed and completed
in accordance with the plans and specifications therefor prepared by the City
Engineer for such and on file in the
purpose office of the City Clerk and in
accordance with the respective proposal of said contractor and under the terms
of said contract, all of which are incorporated by reference in this ordinance.
Section 3. That temporary notes signed by the Mayor and attested by the
City Clerk be issued from time to time as the work progresses in the manner
and form as required by law, the total amount thereof not to exceed the con-
2pertract price for such work, such notes to bear interest at not to exceed 4-2;-
percent per annum and to mature not later than December 1, 1953, and to be
issued in such amounts and at such times as the money for the payment of the
cost of such work be required, such notes to be issued to said contractor and
to be redeemed and cancelled at the time that Internal Improvement Bonds are

issued in lieu thereof.
Section 4. This ordinance shall take effect and be in force from and after
its publication once in the official city paper.
