Taylor Construction Company for the construction of certain curbing, guttering and grading improve- meats on certain streets in the City of Salina, and providing for the issuance of temporary notes to pay the cost thereof pending the issuance and sale of � bonds. i BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansast Section le That the acceptance by theCit f Salina of Y othe proposal of the H. J. Taylor Construction Company, hereinafter referred to as the "Con - I i tractor" as submitted to the Board of Commissioners on April 21, 1952, which I is hereby found to the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said city to said contractor and signed on behalf of the City of Salina by the Mayor on April 22, 1952 for the constr- uction of certain public improvements in the City of Salina, Kansas, to-wit.- Curbing, o-wvit: Curbing, guttering and grading of Martin Avenue from the center line of Sunrise Drive to the center line of Roach Street, as provided by Ordinance Number 5634. Curbing, guttering and grading of Norton Street from the north line of Jewell Avenue to the South line of Ellsworth Avenue, as provided by Ordi- nance Number 5634. Curbing, guttering and grading of West side of Roach Street from the center line of Kirwin - Avenue to the center line of Ellsworth Avenue, r as provided by Ordinance Number 5634. Curbing, guttering and grading of Sunrise Drive from the north line of Kirwin Avenue to the south line of Ellsworth Avenue, as provided by Ordinance Number 5634* at and for the unit price for said work contained in said proposal, which proposal and contract are hereby referred to and made a part of this ordinance be and the same is hereby ratified and confirmed, said proposal being within the esti- mated cost of said improvements as shown by the sworn estimated of the City Engineer on file in the office of the City Clerk, which estimates are hereby referred to and made a part of this ordinance. Section 2. Said improvements shall be built and constructed in accordance with the plans and specifications thereforre p pared by the City Engineer on file in the office of the City Clerk and in accordance with the proposal of said I contractor and under the terms of said contract, all of which are referred to I and made parts of this ordinance. Section 3. That temporary notes signed by the Mayor nand attested by the City Clerk be issued from time to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the contract price for such work, such notes to bear interest not to exceed 42 per cent per annum and to mature not later than December 1, 1953 and to be issued in such i amounts and at such time as money for the payment of the cost of such notes to be issued to said contractor and to be redeemed and cancelled at the time that Permanent bonds are issued in lieu thereof.
