AN ORDINANCE relating to and apportioning and levying special assessments on
certain lots and pieces of ground in the City of Salina, Kansas, to pay the
cost of curbing, guttering and grading of the north side of Charlotte Avenue
from the east line of Simmons Street to the west line of Fourth Street; for
the curbing, guttering and grading of Cloud Avenue from the west line of
Simmons Street to the west line of the Union Pacific Railroad right-of-way;
for the curbing, guttering and grading of Ellsworth Avenue from the east line
of Norton Street to the west line of Roach Street; for the curbing, guttering
and grading of Fourth Street from the south line of Cloud Street to the north
line of Charlotte Avenue; for the curbing, guttering and grading of Gebhart
Street from the south line of Cloud Avenue to the north line of Charlotte Street;
for the curbing, guttering and grading of Kenison Road from the south line of
McAdams Road to the north line of Wilson Street; for the curbing, guttering and
grading of Larson Street from the south line of Cloud Avenue to the north line
of Charlotte Avenue; for the curbing, guttering and grading of Minneapolis
Avenue from the east line of Quincy Street to the east line of Norton Street;
for the curbing, guttering and grading of Morningside Drive from the east line
of Kenison Road to the center line of Sunrise Drive; for the curbing, guttering
and grading of Norton Street from the north line of Minneapolis Avenue to the
north line of Ellsworth Avenue; for the curbing, guttering and grading of Rahm
Street from the west line of Front Street to the center line of Third Street;
and for the curbing, guttering and grading of Sunrise Drive from the south
line of Beloit Avenue to the south line of Ellsworth Avenue; and relating to and
providing for the collection and payment of such assessments*
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansass
Section 1. That for the purpose of paying for that part of the cost of
improving certain portions of certain streets as hereinafter set forth in the
following sections of this ordinance which is chargeable to the private property
in the assessment districts for each of such improvements, respectively, as set
forth in the following sections of this ordinance with respect to each of such
improvements, there are hereby levied and assessed on the property liable there-
for, being all of the lots and pieces of ground lying on either side of said
streets so improved, respectively, to the middle of the block for the distance
improved, with respect to the improvements mentioned in Sections 2, 3, 4, 5, 6,
7, 8, 9, 10, 11, 12 and 13, of this ordinance, according to the appraised value
of such lots and pieces of ground with respect to each such improvement, without
regard to the buildings or improvements thereon, special assessments covering
the cost of such work and improvemebts, and special assessments being based on the
special valuation and appraisement of said lots and pieces of ground heretofore
made by three disinterested appraisers appointed by the Board of Commissioners of
the City of Salina, Kansas, with respect to each such improve*ents, which said
appraisements are hereby referred to and made parts of this ordinance, and the
several amounts levied, apportioned and assessed against the lots and pieces of
ground for each of such improvements, respectively, for the purpose aforesaid as,
hereby found and determined to the amounts set forth in the following sections of
this ordinance with respect to each of such improvements.
Section 2. For that part of the cost of curbing and guttering of Charlotte
Avenue from the east line of Simmons Street to the west line of Fourth Street, in
which is chargeable against the private property within the district chargeable
therefor, and which cost is hereby determined to be 1025.44 there is hereby
levied, apportioned and assessed against the following described lots and pieces
of land as provided for in Section 1 of this ordinance the following amounts:

Section 14. Said amounts levied, apportioned and assessed aforesaid will be
due and collectible in four equal installments, the first becoming due with the

taxes for the year 1952 and one of said installments falling due each and every

year thereafter until all are paid, and all to be collected. with interest as in
I
this ordinance provided, PROVIDED, HOWEVER, that the owner of any piece of
I
I
property liable for any such assessment may redeem his property from such liabilli.ty
by paying into the City Treasury the entire amount chargeable against the same,
as in this ordinance designated, at any time within thirty days after the pub-
lication of this ordinance and before the issuance of bonds of said city in pay-
ment of the balance of the cost of said improvements, and the property so paid
on shall not thereafter be liable for any further assessments for the cost of
said improvements nor for any part of said bonds.
Section 15. There is hereby further levied and assessed against each lot
and piece of ground described in this ordinance, interest at such rate per annum
as shall be borne by the bonds hereafter to be issued for the payment of the

remaining unpaid cost of such improvements, to be hereafter determined and fixed
by ordinance when such bonds are issued, on all of said installments mentioned
and provided for in this ordinance, from the date of the bonds which may be

issued at the end of thirty days as specified in the preceding sections hereof,
as by law provided, to the time of the collection of the last installment, as
provided by law, which said interest shall be collected annually at the same
I
time and in the same manner as said installments are collected, and after the
taking effect of this ordinance and the fixing of said interest rate when such
bonds are authorized and issued, it shall be the duty of the CityClerk of said
city to annually at the same time other taxes are certified and until all of
said dasessments so apportioned and levied herein have been certified, to the
i
County Clerk of Saline County, Kansas, a full list of all property on which the
special assessment and taxation for such work and improvements is chargeable,
except such property on which the special assessments aforesaid have been paid
in full as hereinbefore provided, together with the respective amounts due on
each of such lots and pieces of ground, which amounts shall include the annual
installments of such special assessments together with the interest for one year
at the rate to be fixed as provided for in this ordinance, on all unpaid balances
of such assessments, and such amounts so certified as herein provided for shall
be placed upon the tax roll by the County Clerk of Saline County, Kansas,and
collected as other taxes are collected,

Section 16. This ordinance shall take effect and be in force from and
after its publication once in the official city paper.
