AN OREF-U-SCE creating and defining a certain lateral sanitary sewer districts in the
City of Salina, Kansas, designated as Lateral Sanitary Sewer Districts number 278,
279, 280, 261, 282 and 283, and providing for the construction of lateral sanitary
sewers in said Lateral Sanitary Sewer Dist-,icts number 278, 279, 280/2242 and 283,
so created, and providing for the payment of the cost thereof and for the levying
of special assessments against the propehty in said district for the payment of the
cost of such construction and for the issuing of bonds tb pay the cost thereof.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas.
Section 1. Lateral Sanitary Seiner District 278. That there be and there is hereby
created Lateral Sanitary Sewer District in the City of Salina, Kansas, -which shall be and
it is hereby designated as Lateral Sanitary Sewer District Number 278 and which district
shall include allthe following described property in the City of Salina, Kansas, to -wit:
Benefit District: All of Block 1, Kraft Manor Addition, No. 2, City of
Salina, Saline County, Kansas.
Section 2. It is necessary and it is hereby ordered that an eight inch V. C. P.
lateral sanitary sewer with all necessary connections manholes, flushing tanks, and
other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer
District 278 as created by Section 1 of this ordinance along with the following course.,
to -wit:
An eight inch clay pipe sewer beginning at an existing manhole in Charlotte
Avenue and on line north of right-of-way first east of Ninth Street Place,
thence south along said right-of-way 675 feet, more or less, to the center
line of Leslie Avenue at which place a manhole will be constructed which
will be terminus of Lateral Sewer 278.
Section 3, Lateral Sanitary Sewer District 279. That there be and there is hereby
created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be
and it is hereby designated as Lateral Sanitary Sewer District 279 and which district
shall include all the following described property in the City of Salina, Kansas, to -wit:
Benefit District: All of Block 22 Kraft Manor Addition No. 2, City of
Salina, Saline County, Kansas.
Section 4. It is necessary and it is hereby ordered that an eight inch V. C. P.
lateral sanitary sewer with allnecessary connections, manholes, flushing tanks, and
other appurtenances be constructed and built in and to serve Laid Lateral Sanitary Sewer
District 279 as created by Section 3 of this ordinance along with the following course,
to -wit:
An eight inch clay pipe sewer beginning at an existing manhole in Charlotte
Avenue and in line north of right-of-way first east of Highland Avenge; thence
south along said right-of—,gay 675 feet, more or less, to the center line of
Leslie Avenue, at which y"lace a manhole will be constructed which will be
'terminus of Lateral Sewer 279.
Section 5. Lateral Sanitary Sewer District 280. That there be and there is hereby
created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be and
it is hereby designated as Lateral Sanitary Sewer District 280 and wZich district shall
include all the following described property in the City of Salina, Kansas, to—wit:
Benefit District: All of Block 31 Kraft Ianor Addition No. 2, City of
Salina, Saline County, Kansas.
Section 6. It is necessary and it is hereby ordered that an eight inch V. C. P.
lateral sanitary sewer with all necessary connections' manholes, flushing tanks, and
other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer
District 260 as created by Section 5 of this ordinance along with the following course,
to -wit:
An eight inch clay pipe sewer beginning at an existing manhole in Charlotte
Avenue and on line north of right-of-way first east of Simmons Street; thence
south along said right -of -sway 675 feet, more or less, to the center line of
Leslie Avenue, at which place a manhole will be constructed which will be
terminus of Lateral Sewer 280.
Section 7. Lateral Sanitary Sewer uistrict 281. That there be and there is hereby
created Lateral Sanitary Sewer Listrict in the City of Salina, Kansas, which shall Ce
and it is hereby designated as Lateral Sanitary Sewer bistrict 2E1 and which district
shall include all the following described property in the City of Salina, &„nsas, to -wit:
Benefit Listrict: All of Block 41 Kraft Aanor Addition No. 2, City of
Salina, Saline County, Kansas,
Section 8. It is necessary and it is hereby ordered that an eight inch V. C. P.
lateral sanitary sewer with all necessary connecti:,ns, na.nholes, flushing tan's, and
other appurtenances be constructed and built in and to serve said Lateral Sanitary Scwer
District 261 as created by Section 7 of this ordinance along with tie following course,
to -wit:
An eight inch clay pipe seer beginning at an existing manhole in Charlotte
Avenue and on line north of right-of-way first east of Larson Street; thence
south along said right-of-way 675 feet, more or less, to the center line of
Leslie Avenue, at which place a manhole will be constructed which will be
terminus of Lateral Sewer 261.
Section 9. Lateral Sanitary Sewer Listrict 262. That there be and there is hereby
created Lateral Sanitary Sewer District in the City of Sali.L, Kansas, which shall be
and it is hereby designated as Lateral Sanitary Sewer District 282 and wizich district
shall include all the following described property in the City of Sala, Kansas to -wit:
Benefit District: All of Block 5, Kraft Manor Addition No. 2, City of
Salina, Saline County, Kansas.
Section 10. It is necessary- and it is 1icreby ordered that an eight inch V. C. P.

Section ll. Lateral-anitary Sewer Listrict 263. That there be and there is hereby=

and it is hereby designated as Lateral Sanitary Sewer District 263 and which district
shall include all t_e following described property in the City of Salina, Kansas, to -grit:

Benefit District: All of Block 61 Kraft Manor Addition No. 2, City of
Salina, Saline County, Kansas.
Section 12. It is necessary and it is hereby ordered that an eight inch V. C. P.
lateral sanitary sewer with all necessary connectionsp manholes, flushing tanks, and
other appurtenances be constructed and b�-I It in and to serve said Lateral Sanitary Sewer
District Io. 283 as created by Section 11 of this ordinance along with the following course,
to -wit:
An eight inch clay pipe sewer begin ing at an existing manhole on south line
of Charlotte Avenue extended east and on line north of right-of-way first east
of Fourth Street; thence south along said right-of-way 550 feet; thence east
17 feet; thence south 130 feet to the south line of Leslie Avenue at which
place a manhole ,.Till be constructed which will be terminus of Lateral Sewer
283.
Section 13. That the City Engineer shall on or before �� �''(�� prepare
and file in the office of the City Clerk, plans and specifications for the construction
of the lateral sanitary sewer provided for in the preceding sections of this ordinance
which shall be of proper character to serve the property lying within the district which
such sewer is to be constructed and shall on or before the same date prepare and submit
to the E)oard of Commissioners a detailed estimate under oath of the cost thereof. That
hereafter the City Clerk shall advertise for three consecutive days in the official city
paper for sealed proposals for the building and construction of such sewer according to
such plans and specifications, which proposals shall be filed tiri.th the City Clerk on or
before the tune fixed in such notice, at which time the Board of Commissioners may let a
contract for the building and construction of such sewer to the lowest and best responsible
bidder or bidders therefor, if there be any whose bids do not exceed the estimated cost
thereof, but said $oard shall reserve the right to reject any or all such proposals, and
if no bid shallbe received within such estimate, the Board of Commissioners shall have
the power to do such work and make such improvements within the estimated cost thereof as
provided by law.
Section 149 That for the cost of building and constructing such sewer, special assess-
ments sha_1 be made for the full cost thereof on all lots and pieces of :Land within and
for which such sewer sha..l be built, according to the appraised value thereof, without
regard to the improvements or buildings thereon.
Section 15. After the passage and publication of this ordinance, the Board of Com-
missioners shall appoint three disinterested appraisers, who having tarsen oath to make
a true and impartial appraisement of all lots and pieces of land to taxation for the
cost of such improvements, shall within five days after having been notified for their
appointments proceed to appraise all of the lots and pieces of land within such district
jliable to assessment and taxation as aforesaid, without regard to the buildings or improve-
ments thereon, and after making such app raisements, shall return to the Board of Commissioners
of said city and said Board shall designate a brae for a special meeting of said 3oard for

as to the value of any lot or piece

of land appraised as aforesaid, of which special session due notice shall be given in the
official city paper, at which special session said Board may alter any valuation of any j
lot or piece of land, if in their opinion, the same has been appraised too high or too low.
Section 16. The special assessment herein provided for may be paid by the person
liable therefor in four approximately equal annual installments but the owner of any
property liable to such assessment may within thirty days from the date of determining

the amount assessed against the property, pay the same in full and his property shall
not be liable for any assessments for the cost of such improvements, and bonds as herein
after provided for shall be issued in the amount of the cost of such inrpvuvements remain-
ing unpaid at the end of the thirty days from the time such assessment is fixed.
Section 17. For the purpose of paying for the work and improvements in this ordinance
provided for, the Board of Commissioners may and are hereby authorized and directed to
issue improvement bonds of the City of Salina, Kansas in an amount not to exceed the cost
of such improvement, and to run for a period of four years and be payable in four apprixi-
mate!-,r equal annual installments, together with interest not to exceed five per cent per
annum, which bonds shall be issued and payable according to law, and for the
purpose of
paying the principal and interest on said bonds as they severally become due and payable
the Board of Commiss *oners shall apportion and assess against the lots cad pieces of land
,within the taxing district of such imp ovements, special assessments covering the cost of
such improvement and apportionment therein contained shall hold good for all of the in-
stall.ments that are to be collected from the specific property chargeable with such
improvements; such assessment and apportionment ordinance shall contain the total amount
of tax apportioned to such tract, piece or parcel of land within the tax:', -ng district and
shall state the number of annual installments in which such tax is to be collected; and
thereafter theCity Clerk shall annually, at the same time that other taxes are certified,
certify to the County Clerk of Saline County, Kansas, a full list of all property liable
for such work and improvements, together with the respective numbered amounts due on each
of said tracts, pieces or parcels of land, tlichanounts shall include the annual install-
ments and interest on allunpaid balances for one year at the rate of not to exceed five
;percent per annum, on such amounts so certified, which shallbe collected as other taxes
,are collected.
Section 18. This ordinance shall take effect and be in force from and after its
';publication once in the official city paper.
