5639 Utility Improvements Pershing Heights Addition- - _---ORL�INArICE No. (Published in the Salina Jo.rnal AN ORDNANCE creating and defining a certain lateral sanitary sewer districts in the City of Salina, Kansas, designated as Lateral Sanitary Sewer Districts number 276 and 277 and providing for the construction of Lateral Sanitary sewers in said Lateral Sanitary Sew:r Districts number 276 and 277, so created, and providing for the payment of the cost thereof and for the levying of special assessments against the property in said district for the payment of the cost of such construction and for the issuing of bonds to pay the cost thereof. BE I1ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. Lateral Sanitary Sewer District 276. That there be and there is hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which stall be and it is hereby designated as Lateral Sanitary Serer District Ilumber 276 and which district shall include all the folloTAring described property in the City of Salina, Kansas, to -wit: Benefit District: All of Block 1, Pershing Heights Addition to the City of Salina, Saline County, Kansas. Section 2. It is necessary and it is hereby ordered that an eight inch V. C. P. lateral sanitary sewer with allnecessary connections, manholes, flushing tanks, and other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District 276 as created by Section 1 of this ordinance along with the following course, t o -l�ri t : An eLght inch clay pipe sewer beginning at an existing matiliole L alley first north of idoodlawn <.nd 50 feet west of the east line of Pershing Street; thence west in right-of-way on north line of Lot b, Block 1, Pershing Heights Addition 228 feet, more or less, to the northwest corner of said Lot b; thence south a- long right-of-way 270 feet, mope or less, to the northwest corner of Lot 16 of said Block and Addition; thence west along right-of-way 60 feet, more or less, to the northwest corner of Lot 15, of said Lot of said Addition; thence south along right--of-way 205 feet, :more or less, to the center line of Cloud Avenue -�rhere a manitole will be constructed T•faich will be tenilnus of sciier lateral 276. Section 3. Lateral Sanitary Sewer Listrict 277. That there be and there is hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, tirhich shall be and it is hereby designated as Lateral Sanitary Scwer District 277 and which district shall include all the following described property in the City of Salina, Kansas, to -wit: Benefit District: Lots 2, Z;_, 61 81 10, 12, 14, 16 and 18, Block 2, and Lots 1, 3, 5, 71 93 11, 13, 15 and 17, Block 4, all in College View Addition, City of Salina, Saline County, Kansas. Section 4. It is necessary and it is hereby ordered that an eight inch V. C. P. ---�` lateral sanitas•y sewer with all necessary connections, manholes, flushing tanks, and other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District 277 as created by Section 3 of ttis ordinance along with the following course, to -wit: An eight inch clay pipe sewer beginning at an 8 inch sewer stub 'which exists in Rahm Street and 50 feet west of the center line of Rahm; thence west along the center line of Rahm Street )�45 feet, :^ore or less, to the center line of Third Street where a mar -hole will be constructed which will be the terminus of Lateral Sewer 277. Section 5. That the City Engineer shall on or before _ -�" Iq brepare and ,file in the office of the City Clerk, plans and specifications for the construction of the lateral sanitary sewer provided for in the preceding sections of this ordinance which sila 1 be of proper character to serve the property lying within the district which such sewer is to be constructed and shall on or before the same date prepare and submit to the Board of Coivaissioners a detailed estimate under oath of the cost thereof. That hereafter the City Clerk shall advertise for three consecutive days in the official city paper for sealed proposals for the building and construction of such sewer according to such plans and specifications, which proposals shall be filed with the City Clerk on i or before the time fixed in such notice, at which time the Board of Commissioners may let a contract for the building and construction of such sewer to the lowest and best responsible bidder or bidders therefor, if there be any whose bids do not exceed the estimated cost thereof, but said Board shall reserve the right0to reject any or all such proposals, and if no bid shall be received within such estimate, the Board of Commissioners' shall have the power to do such work and make such improvements within the estimated cost thereof as provided by law. Section 6. That for the cost of building and constructing such sewer, special assess- ments shall be made for the full cost thereof on all lots and pieces of land within and for which such sewer shall be built, according to the appraised value thereof, without regard to the improvements or bulding thereon. Section 7. After the passage and publication of this ordinance, the Board of Com- missioners shall appoint three disinterested apIr aisers, who having taken oath to make a true and impartial aper aisement of all lots and pieces of land to taxation for the cost of such improvements, shall zri- thin five days after having been notified for their appointments proceed to appraise all of the lots and pieces of land within such district liable to assessment and taxation as aforesaid, without regard to the buildings or i„�brove- ments thereon, and after making such appraisements, shall return to the Board of Com- missioners of said city and said Board shall designate a time for a special meeting of said Board for the purpose of hearing any complaints that :nay be made as to the value of any lot or piece of land appraised as aforesaid, of which special sessio_. due notice shall be given in the official city paper, at which special session said Board may alter any valuation of any lot or piece of lana, if in their opinion, the sarr.e has been appraised too high or too low. Section $. The special assessment herein provided for may be paid by the person liable therefor in four approximately equal annual installments but the ownerof any property liable to such assessment may within thirty days from the date of determining the amount assessed against the property, pay the same in full and his property shall not be liable for any assessments for the cost of such improvements, and bonds as herein after provided for shall be issued in the amount of the cost of such improvements remaining unpaid at - -- -,Y —Q,YO L.iv-:1 Ufle Lime such assessment is fixed. Section 9. For the purpose of paying for the work and improvements in this ordinance provided for, the Board of Commissioners may and are hereby authorized and directed to uilC ULLy oI balina, Kansas in an amount not to exceed the cost of such improvement, and to run for a period of four years and be payable in four approxi- mately equal annual installments together with interest not to exceed five per cent per annum, which bonds shall be issued and payable according to law; and for the purpose of paying the principal and interest on said bonds as they severally become due and payable the Board of Commissioners shall apportion and assess against the lots and pieces of land w-Lthin the taxing district of such improvements, special assessments covering the cost of such improvement and apportionment therein contained shall hold good for all of the installments that are to be collected from the specific property chargeable with such improvements; such assessment and apportionment ordinance shall contain the total amount of tax apportioned to such tract, piece or parcel of land within the taxing dis- trict and shall state the number of annual installments in which .such tax is to be collected; and thereafter the City Clerk shall annually, at the same time that other taxes are certified, certify to the County Clerk of Saline County, Kansas, a full list of all property liable for such work and improvements, together with the respective numbered amounts due on each of said tracts, pieces or parcels of land, which amounts shall include the annual installments and interest on all unpaid balances for one year at the rate of not to exceed five percent per annum, on such amounts so certified, which shall be collected as other taxes are collected. Section 10. This ordinance shall take effect and be in force from and after its publication once in the official city paper.
