5637 Utility Improvements - Rplt Blk 5 Claflin's Addition- - - - - --- - ORDI1,1ANC O._ 563 - .. ---- - - -- - (Published in the Salina Journal RA !1_ 152) AN ORDINANCE creating and defining a certain lateral sanitary sewer districts in the City of Salina, Kansas, designated as Lateral Sanitary Sewer Districts number 273, 274 and 275, and providing for the construction of lateral sanitary sewers in said Lateral Sanitary Sewer Districts number 273, 274 and 275, so created, and providing for the payment of the cost thereof and for the levying of special assessments against the property in said district for the payment of the cost of such construction and for the issuing of bonds to pay the cost thereof. BE IT ORDADIED by the Board of Commissioners of the City of Salina, Kansas: Section 1. Lateral Sanitary Sewer District 273. That there be and there is hereby created Lateral Sanita -r Sewer District in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District Number 273 and which district shall include all the following described property in tl.e City of Salina, Kansas, to -wit: Benefit District: Lots 1 to 18 inclusive in Block 5, Replat of Block 5 Claflin Addition, City of Salina, Saline County, Kansas. Section 2. It is necessary and it is hereby ordered that an eight inch V. C. F. lateral sanitary sewer with all necessary connections, manholes, flushing tanks, and other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District 273 as created by Section 1 of this ordinance along with the following course, to -wit: An eight inch clay pipe sewer beginning at an existing manhole which is in right-of-way first south of Republic Avenue and 27 feet west of the west line of Roach Street, thence east 60 feet more or less, to the center line of Roach; thence south along the center line of Roach 326 feet; thence east along right-of-way 663 feet to the center line of Lewis Avenue there a man- hole to be constructed which will be terminus of Lateral 273. Section 3. Lateral Sanitary Sewer District 274. That there be and there is hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District 274 and which distfict shall include all the following described property in the City of Salina, Kansas, to -frit: Benefit District: All of Block 11 Replat of Blocks 3, 4, 5 and 61 Hageman Park Addition, City of Salina, Saline County, Kansas. Section 4. It is necessary and it is hereby ordered that an eight inch V. C. P. lateral sanitary sewer with all necessary connections, manholes, flushing tanks, and other oppurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District 274 as created by Section 3 of this ordinance along with the following course, to -wit: An eight inch clay pipe sewer beginning at an existing manhole in center line of Roach Street and center line of first right-of-way south of Republic Avenue extended east; thence north 158 feet, more or less, to the center line of Re- public Avenue; thence east 175.66 feet to center line of right-of-way in Replat of Block 11 Hageman Park Addition; thence north along said right-of-way 660 feet to the center line of r1artin Avenue, there a manhole to be constructed which will be terminus of Lateral 274. Section 5. Lateral Sanitary Sewer District 275. That there be and there is hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District 275 and which district shall include all the following described property in the Cittr of Salina, Kansas, to -wit: Benefit Listrict: All of Block 2, Replat of Blocks 3, 4, 5 and 6, Hageman Park Addition, City of Salina, Saline County, Kansas. Ir I Section 6. It is necessary and it is hereby ordered that an eight inch V. C. F. lateral sanitary sewer with all necessary connections,, manholes, flushing tanks, and other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District 275 as created b Section Y 3 of this ordinance along with the following course, � to -wit: An eight inch clay pipe sewer beginning at an existing manhole which is in the center line of Republic Avenue and center line of first right-of-way east of Roach Street; thence east along center line of Republic 306 feet to the center line of right-of-way in Block 2, Replat of Hageman Park Addition; thence north along said right-of-way 660 feet to the center line of Martin Avenuetheffie a manhole to be constructed which will be terminus of Lateral 275. , Section 7. That the City Engineer shall on or before nprii 4, 1952 re P are P and file in the office of the City Clerk, plans and specifications for the construction of the lateral sanitary sewer provided for in the preceding sections of this ordinance which shall be of proper character to serve the property lying within the district which such sewer is to be constructed and shall on or before the same date prepare and submit to the Board of Commissioners a detailed estimate under oath of the cost thereof. That hereafter the City Clerk shalladvertise for three consecutive days in the official city paper for sealed proposals for the building and construction of such sewer according to such plans and specifications, which proposals shall be filed with the City Clerk on or before the t:e fixed in such notice, at which time the Board of Commissioners may let a contract for the building and construction of such sewer to the lowest and best responsible bidder or bidders therefor, if there be any whose bids do not exceed the estimated cost thereof, but said Board shall reserve the right to reject any or all such proposals, and if no bid shall be received within such estimate, the Board of Commissioners shall hz;ve the power to do such work and make such improvements within the estimated cost thereof as provided by law. Section 8. That for the cost of building and constructing such sewer, special assess- ments shal:L be made for the full cost thereof on all lots and pieces of land within and for which such sewer shall be built, according to the appraised value fxereof, without :,regard to the improvements or buildings thereon. Section 9. After the passage and publication of this ordinance, the Board of --------------- Com- missLoners shall appoint three disinterested appraisers, i,zilo having taken oath to make a true and impartial appraisement of all lots and pieces of lend to taxation for the cost of such ::provements, shall within five days after having been notified for their appointments proceed to appraise all of the lots and pieces of laid within such district !liable to assessment and taxation as aforesaid, w"Lthout regard to the buil_aings or u-;1 ro - ments thereon, and after making such az:praisements, shall return to the Board of CorIMI io Of said city and said Board shall designate a time for a special meetingof said F;oarc`ss�oners g P ,, the Purpno(d of 1 �.rl`1, an-, Le made as to the value of any lot or piece 4f land appraised as aforesaid, of which special session due notice shall be given in the .r • 1 1 1 official city paper, at which special session said Board may alter any valuation of any lot or piece of land, if in their opinion, the same has been app.caised too high or too low. Section 10. The special assessment herein provided for may be paid by the person liable therefor in four approxi:iately equal annual installments but the oi-,ner of any property liable to such assessment may within thirty days from the date of determining the Errnount assessed against the pronerty, pay the same in full and :pis property shall not be Liable for any assessments for the cost of such improvements, and bonds as herein i after provided for shall be issued in the amount of the cost of such improvements remain- ing unpaid at the end of the thirty days fro:: the time such assessment is :axed. Section 11. For the purpose of paying; for the work and d-mprovements in this ordinance provided for, the Board of Commiss,_ ners may and are hereby authorized and directed to issue improvement bonds of the City of Salina, Kansas in an amount not to exceed the cost i of such improvement, and to run for a period of four years and bepayable in four approxi- mately equal annual installments, together with interest not to exceed five per cent per annum, which conds shall be issued and payable according to law; and for the purpose of paying the principal and interest on said bonds as they severally become due and payable the Board of Commissioners shall apportion and assess against the lots and pieces of land within the taxing district of such improvements, special assessments covering the cost of such improvement and apportionment therein contained shall hold good for all of the in- stallments that are to be collected from the specific property chargeable with such improvements; such assessment and apportionment ordinance shall contain the total amount of tax apportioned to such tract, piece or parcel of land w_thin the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually, at the s ---ie time that other taxes are certified, certify to t:e County Clerk of Saline County, Kansas, a full list of all property liable for such work and improvements, together with the respective numbered amounts due on each of said tracts, pieces or p�xcels of land, which amounts shall include the annual install- ments and interest on all unpaid balances for one year at the rate of not to exceed five percent per annum, on such amounts so certified, which shall be collected as other taxes are collected. Section 12. This ordinance shall take effect and be in force fro ,, and after its publication once in the official city paper.
