5629 Utility Improvements - Kraft Manor Addition1 1 1 ORDINANCE N0. 5629 AN ORDINANCE creating and g a certain lateral sanitary sewer districts in the City of Salina, Kansas, designated as Lateral Sanitary Sewer Districts number 269, 270 and 271 and providing for the construction of lateral sanitary sewers in said Lateral Sanitary Sewer Districts number 269, 270 and 271, so created., and providing for the payment of the cost thereof and for the levying of special assessments against the property in said district for the payment of the cost of such construction and for the issuing of bonds to pay the cost thereof. BE IT ORDAINED by -the Board of Commissioners of the City of Salina, Kansas: Section 1. Lateral Sanitary Sewer District 269. That there be and there is hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District Number 269 and which district shall include all the following described property in the City of Salina, Kansas, to -wit: Benefit District Lots 1 to 22 inclusive Block 4 Kraft Manor Addition City of Salina, Saline County, Kansas. Section 2. It is necessary and it is hereby ordered that an eight inch V. C. F. lateral sanitary sewer with all necessary connections, manholes, flushing tanks, and other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District 269 as created_ by Section 1 of this ordinance along with the following course, i to -wit: An eight inch (bit) clay pipe sanitary sewer in ten foot easement (101) running north and south through Block Four (4) in Kraft Manor Addition to the City of Salina, Kansas, beginning at an existing manhole in Cloud Street, thence south seven hundred and fifty feet (7501) to a manhole to be constructed in Charlotte Street, Section3. Lateral Sanitary Sewer District 270. That there be and there is hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District 270 and which district shall include all the following described property in the City of Salina, Kansas, to -wit: Benefit District Lots 1 to 22 inclusive, Block 5 Kraft Manor Addition City of Salina, Saline County, Kansas. Section 4. It is necessary and it is hereby ordered that an eight inch V. C. p. lateral sanitary sewer with all necessary connections, manholes, flushing tanks, and other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District 270 as created by Section 3 of this ordinance along with the following course, to -wit: An eight inch (819 clay pipe sewer in ten foot (101) easement running north and south through Block Five (5) in Kraft Manor Addition to the City of .Salina, Kansas, beginning at an existing manhole in Cloud Street, thence south seven hundred and fifty feet (7501) to a manhole to be constructed in Charlotte Street. Section 5. Lateral Sanitary Sewer District 271. That there be and there is hereby 'created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District 271 and which district shall include all the following described property in the City of Salina, Kansas, to -wit: Benefit District Lots 1 to 10 inclusive, Block 6 Kraft Manor Addition City of Salina, Saline County, Kansas. ----- ------ Section 6. It is necessary and it is hereby ordered that an eight inch V. C. p. lateral sanitary sewer with all necessary connections, manholes flushing ng tanks, and other appurtenances be constructed and built in and to serve said Lateral SanitarySewer District 271 as created by Section 3 of this ordinance alongwith the following course, to -wit: An eight inch (811) clay pipe sanitary sewer in ten foot (101) easement running north and south on east property line of Block Six (6) in Kraft Manor Addition to the City of Salina, Kansas, beginning at an existing manhole in Cloud Street thence south in (101) ten foot easement seven hundred and seventy feet (7701) more or less, to a manhole to be constructed on the soutix property line of Lot Tbn (10) in Block Six (6) Kraft I I Manor Addition. Section 7. That the City Engineer shall on or before March 17th, 1952 prepare and file in the office of the City Clerk, plans and specifications for the construction of the lateral sanitary sewer provided for in the preceding sections of this ordinance which shall be of proper character to serve the property lying within the district which such I sewer is to be constructed and shall on or before the same date prepare and submit to i the Board of Commissioners a detailed estimate under oath of the cost thereof. That here- i after the City Clerk shall advertise for three consecutive days in, the official cit j y paper for sealed proposals for the building and construction of such sewer according to such Plans and specifications which proposals shall be filed with the City Clerk on or before i the time fixed in such notice, at which time the Board of Commissioners may let a contract for the building and constructi n of such sewer to the lowest and best responsible bidder or bidders therefor, if there be any whose bids do not exceed the estimated cost thereof, but said Board shall reserve the right to reject any or all such proposals, and if no bid shall be received within such estimate, the Board of Commissioners shall have the power to do such work and make such improvements within the esti,-nated cost thereof as provided by law. Section 8. That for the cost of building and constructing such sewer, special assess- faents shall be made for the full cost thereof on all lots and pieces of land within and for which such sewer shall be built, according to the appraised value thereof, without regard to the improvements or buildings hereon. Section 9. Alter the passage and publication of this ordinance, the Board of com- m missioners missioners shall appoint three disinterested appraisers, who having taken oath to make a true and impartial appraise ment of all lots and pieces of land to taxation for the cost of such improvements, shall within five days after having been notified for their appointments proceed to appraise all of the lots and pieces of land within such dzs tx is t liable to assessment and taxation as aforesaid, without regard to the buildings improve- or ments thereon, and after making such appraisements, shall return to the Board Com- of missioners of said city and said Board shall designate a time for a special meeting of said Board for the purpose of hearing any complaints that may be made as to the value Of any lot or piece of land appraised as aforesaid, of which special session due notice 1 shall be given in the officia$ city paper, at which special session said Board may alter any valuation of any lot or piece of land, if in their opinion, the same has been i appraised too high or too low. Section 10. The special assessment herein provided for may be paid by the person liable therefor in four approximately equal annual installments but the owner of any property liable to such assessment may within thirty days from the date of determining i the amount assessed against the property, pay the same in full and his property shall not be liable for any assessments for the cost of such improvements, and bonds as herein after provided for shall be issued in the amount of the cost of such improvements remain- ing unpaid at the end of the thirty days from the time such assessment is fixed. Section 11. For the purpose of paying for the work and improvements in this ordinance Provided for., the Board of Commissioners may and are hereby authorized and directed to issue improvement bonds of the City of Salina, Kansas in an amount not to exceed the cost of such improvement, and to run for a period of four years and be payable in f ; our approxi.- j mately equal annual installments, together with interest not to exceed five pEr centr pe nnum1 which bonds shall be issued and payable according to law; and for the purpose of paying the principal and interest on said bonds as they severally become due and payable the Board of Commissioners shall apportion and assess against the lots and pieces of land within the taxing district of such improvements, special assessments covering the cost of such improvement and apportionment therein contained shall hold good for all of the in- stallments that are to be collected from the specific Property P Y chargeable with such im- provements; such assessment and apportionment ordinance shall contain the total amount of tax apportioned to such t ract piece or parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected and there- after the City Clerk shall annually, at the same time that other taxes are certified, certify' to the Count Clerk of 3' Saline County, Kansas, a full list of all property liable for such work and improvements, together with the respective numbered amounts due on each of tracts said , pieces or parcels of land, which amounts shall include the annual installments and interest on all unpaid balances for one year at the rate of not to exceed five per cent per annum, on such amounts so certified, which shall be collected as other taxes are collected. Section 12. This ordinance shall take effect and be in force from and after its Publication once in the official city paper.
