5619 Utility Improvements - Stack Addition1 OR I dANCE NO. 5619__ (Published in the Salina Journal �:Ph, 1�) 1952) AN ORDINANCE creating and defining a certain lateral sanitary sewer district in the City of Salina, Kansas, designated as Lateral Sanitary Sewer District Number 268 and providing for the construction of a lateral sanitary sewer in said Lateral Sanitary Sewer District Number 268, so created, and providing for the payment of the cost thereof and for the levying of special assessments against the property in said district for the payment of the cost of such construction and for the issuing of bonds to pay the cost thereof. BE IT ORDAINED by the Board of Commissioners of the City of Salina., Kansas: Section 1. Lateral Sanitary Sewer District 268. That there be and there is hereby created Lateral Sanitary Sewer District in the City of Salida, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District Number 268 and which district shall include all the following described property in the City of Salina, Kansas, to -wit: Benefit District: Lateral 268. All of Block 7, Stack Addition, City of Salina, Saline County, Kansas. Section 2. It is necessary and it is hereby ordered that an eight inch V. C. F. lateral sanitary sewer with all necessary connections, manholes, flushing tanks, and other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District 268 as created by Section 1 of this ordinance along with the following course, to -wit: An eight inch clay pipe sewer, beginning at an existing manhole in Stack Avenue and on the center line of first alley east of Delaware Avenue ex- tended north, thence south along center line of said alley 555 feet more or less, to the center line of an east and west alley first north of Greeley Avenue, at this point a manhole to be constructed and a branch line both east and west along center line of alley 105 feet both east and west which will be terminus of said sewer. Section 3. That the City Engineer shall on or before Febrijary 18th 1952 prepare and file in the office of the City Clerk, plans and specifications for the con- struction of the lateral sanitary sewer provided for in the preceding sections of this ordinance which shall be of proper character to serve the property lying within the dis- trict which such sewer is to be constructed and shall on or before the same date prepare I and submit to the Board of Commissioners a detailed estimate under oath of the cost there- of. That hereafter the City Clerk shall advertise for three consecutive days in the official city paper for sealed proposals for the building and construction of such sewer laccording to such plans and specifications, which proposals shallbe filed with the City i Clerk on or before the time fixed in such notice, at which time the Board of Commissioners may let a contract for the building and construction of such sewer to thelowest and best responsible bidder or bidders therefor, if there be any whose bids do not exceed the esti- ,mated cost thereof, but said Board shall reserve the right to reject any or M such pro- posals, and if no bid shall be received withii such estimate, the Board of Commissioners :;shall have the power to do such work and make such improvements within the estimated cost ,thereof as provided by law,, Section 4. That for the cost of building and constructing such sewer, special assessments shall be made for the full cost thereof on all lots and pieces of land within and for which such sewer shall be built, according to the appraised value thereof, without regard to the improvements or buildings thereon. Section 5. After the passage and publication of this ordinance, the Board of Commissioners shall appoint three disinterested appraisers, ti&,o having taken oath to make a true and impartial appraisement of all lots and pieces of :Land to taxation for the cost of such improvements, shall within five days after havin:�; been notified for their appointments proceed to aLpraise all of the lots and pieces of land within such district liable to assessment and taxation as aforesaid, without regard to the buildings or improve- ments thereon, and after making such appraisements., shall return to the Board of Com- missioners of said city and said Board shall designate a tine for a special meeting of said Board for the purpose of hearing any complaints that may be made as to the value of any lot or piece of land appraised as aforesaid, of which special session due notice shall be given in the official city paper, at which special session said Board may alter any valuati_n of any lot or piece of land, if in their opinion, the same has been appraised too high or too low. Section 6. The special assessment herein provided for may be paid by the person liable therefor in four approximately equal annual installments but the oTmer of any property liable to such assessment may T-rithin thirty days from the date of determining the w o unt assessed against the property, pay the same in full and his property shall not be liable for any assessments for the cost of such improvements, and bonds as herein after provided for shall be issued in the amount of the cost of such improve_ients remain- ing unpaid at the end of the thirty days from the ti.~.e such assessment is fixed. Section 7. For the purpose of paying for the work and improvements in this ordinance provided for, the Board of Commissioners may and are hereby authorized and directed to issue improvement bonds of the City of Salina, Kansas in an amount not to exceed the cost j of such improvement, and to run for a period of four years and be payable in tour approxi- mately equal annual installments, to.!;ether with interest not to exceed five per cent per annum, which bonds shall be issued and payable according to law; arid for the purpose of paying the principal arid interest on said bonds as they severally beco_ee due and payable the Board of Commissioners shall apportion and assess against the Lots and pieces of land wittri_n the taxing district of such improvements, special assessments covering the cost of such improvement and apportio.ument therein contained shall hold gocd for all of the in- stallments that are to be collected fror the specific property chargeable i'rith such im- provements; such assessment and apportionment ordinance shall contain the total amount of tax apportioned to such tract, piece or parcel of land within the taxing district and shall ,state the number of annual installments in which such tax is to be --ollected; and there- after the City Clerk shall annually, at the same time that other taxes are ce;,tified, certify to the County Clerk of Saline County, Kansas, a full list of all property liable for such work and ir;7provements, together Tri th the respective numbered amounts due on each of said ,tracts, pieces or parcels of land, which amounts shall include the annual installments and 'interest on all unpaid balances for one year at the rote of not to exceed five per cent per 'annum, on such a..ounts so certified, which shall be collected as other taxes are collected.
