AN ORDINANCE relating to and apportioning and levying special assessments on certain
lots and pieces of ground in the City of Salina, Kansas, to pay the cost of con-
structing lateral sanitary sewers in Lateral Sanitary Sewer Districts numbered
2553 2563 257, 258 and 259, and relating to andproviding for the collection and
payment of such assessments.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That for the purpose of paying for the cost of building and constructing
lateral sanitary sewers in Lateral Sanitary Sewer Districts numbered 255, 256, 257, 258
and 2594 as authorized by the provisions of Ordinances number 5521, 5532 and 5527, the
cost of which has been duly ascertained as shown by the City Engineer's Final Estimate
of Cost, which has been duly approved by the Board of Commissioners, there are hereby
levied and assessed on the property liable therefor, being all the lots and pieces of
ground lying in the sewer district mentioned above as created by Ordinances nuijber
5521, 5532 and 55273 according to the appraised value of such lots and pieces of ground
without regard to the buildings or improvements thereon, special assessments covering
the cost of such improvements constructed in said sewer district, said special assess-
ments being based on the special valuation and appraisement made by three disinterested
appraisims appointed by the Board of Commissioners of the City of Salina.. Kansas, which
said appraisement is hereby referred to and made a part of this ordinance, and the several
amounts levied and apportioned against the lots and pieces of ground in said sewer dis-
trict for the purpose of paying the cost of the improvements constructed in such district
being hereby found and determined to be as set forth in the following sections of this
ordinance.
Section 2. That for the payment of the cost of construction of Lateral Sanitary
Sewer Number 255, an eight inch clay pipe sewer, beginning at an e:d sting manhole which
is 23 feet south of the north property line of Crawford Avenue and 132.5 feet east of the
east property line of Second Street; thence west 3.0.0 feet on Crawford Avenue to a man-
hole to be constructed which is 127.5 feet east of the east line of Third Street extended
south; thence north 912.5 feet on a line parallel with and 127.5 feet east of the east
line of Third Street where a manhole will be constructed which will be terminus of said
sewer, the amount levied, apportioned and assessed against the lots and pieces of ground
in said district are found and determined to be at; follows:

Sewer Number 256, an eight inch clay pipe sewer, beginning at a manhole in the inter-
section of Crawford Avenue and Second Street; thence north in Second Street 912.5 feet
to a manhole to be constructed which will be terminus of said sewer, the amount levied,
apportioned and assessed against the lots and pieces of ground in said district are found
and determined to be as follows:

Section 7. Said amounts levieds apportioned and assessed as aforesaid shall be due
and collectible in four equal installments, the first becoming due with the taxes levied
for the year 19522 and one of said installments falling due each and every year thereafter
until all are paid, all to be collected with interest as in this ordinance provided,
however, that the owner of any piece of property liable for any such assessment may
redeem his property from such liability by paying into the City Treasury the entire
amount chargeable against the same as in this ordinance designated, at any time within
thirty days after the publication of this ordinance, and before the issuance of the bonds
of said city in payment of the cost of said improvements, and his property so paid on
shall not thereafter be liable for any further assessment for the cost of said improve-
ments nor for any part of said bonds.
Section 8. There is hereby further levied and assessed against such lots and pieces
of ground described in this ordinance interest at such rate per annum as shall be borne
by the bonds hereafter to be issued for the payment of the remaining unpaid cost of such
improvements, such rate to be hereafter determined and fixed by ordinance when such bonds
are issued, on all of said installments mentioned and provided for in this ordinances
from the date of the bonds which may be issued at the end of thirty days as specified in
the preceding section hereof as by law provided, to the time of collection of the last in-
stallment as provided by law, which said interest shall be collected annually at the same
time and in the same manner as said installments are collected, and after the taking
effect of this ordinance and the fixing of the interest
rate when such bonds are author-
i_zed and issued, it shall be the duty of the City Clerk of said city to annuallyat tile

, a full list of all property liable to assessment and taxation for such work and
improvements, except such property on which the special assessments aforesaid have been
paid in full as hereinbefore provided, together with the respective amounts due on each
of such lots and pieces of grounds which amounts shall include the annual installments
of such special assessments together with the interest for one year at the rate to be
fixed and provided for in this ordinance, being the rate borne by the bonds to be issued
on all unpaid balances of such assessments, and such amount so certified as herein pro-
vided shall be placed upon the tax roll by the County Clerk of Saline County, Kansas and
collected as all other taxes are collected.
Section 9. This ordinance shall take effect and be in force from and after
publication in the official city paper.the
