5615 Levy AssessmentsBE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That for the purpose of paying for that part of the cost of improving certain portions of cektain streets as hereinafter set forth in the following sections of this ordinance which is chargeable to the private property in the assessment districts for each of such improvements, respectively, as set forth in the following sections of this ordinance with respect to each of such improvements, there are hereby levied and ORLINANCE N0. 5615 AT (Published in the Salina Journal of, 1952) AN ORLINANCE relating to and apportioning and levying special assessments on certain lots and pieces of ground in the City of Salina, Kansas, to pay the cost of curbing, guttering and grading of north side of Claflin Avenue from the west line of Pershing Street to the east line of Funston Streetq- cMing, guttering and grading of Cloud Avenue from the east line of Ninth Street to the west line of Simmons Street and curbing, guttering and grading of the north side of Cloud Avenue from the west line of Highland Avenue to the west line of Simmons Street extended north; curbing, guttering and grading of Charlotte Street in Kraft Manor Addition from the east line of Highland Avenue to the west lineof Simmons Street; curbing, guttering and grading of west side of Highland Avenue in Kraft Manor Addition from the south line of Cloud Avenue to the south line of Charlotte Street and the curbing, guttering and grading of the east side of Highland Avenue in Kraft Manor Addition from the south line of Cloud Avenue to the north line of Charlotte Street; curbing, guttering and grading of Jewell Avenue from the east line of Quincy Street to the east line of Sunrise Drive; coming, guttering and grading of Lamar Street from the west line of Third Street to the center line of Fourth Street; curbing.,'r guttering and grading of Republic Avenue from the east line of Quincy Street to the east line of Sunrise Drive; curbing., guttering and grading of Simmons Street in Kraft Manor Addition from the south line of Cloud Avenue to the north line of Charlotte Street; and relating to and providing for the collection and payment of such assessments. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That for the purpose of paying for that part of the cost of improving certain portions of cektain streets as hereinafter set forth in the following sections of this ordinance which is chargeable to the private property in the assessment districts for each of such improvements, respectively, as set forth in the following sections of this ordinance with respect to each of such improvements, there are hereby levied and assessed on the property liable therefor, being all of the lots and pieces of ground lying on either side of said streets so improved, respectively, to the middle of the block for the distance improved, with respect to the improvements mentioned in sections 2, 3, 4, 5, 6, 7, 8 and 9 of this ordinance, according to the appraised value of such lots and pieces of ground with respect to each such improvement without regard to the buildings or improvements thereon, special assessments covering the cost of such work and improvements, and special assessments being based on the special valuation and appraisement of said lots and pieces of ground heretofore made by three disinterested appraisers apppinted by the Board of Commissioners of the City of Salina., Kansas, with respect to each such improve- ment, which said appraisements are hereby referred to and made parts of this ordin=e, and the several amounts levied, apportioned and assessed against the lots and pieces of ground for each of such improvements, respectively, for the purpose aforesaid as hereby found and determined to be the amounts set forth in the following sections of this ordinance with respect to each of such improvements. Section 2. Said amounts levied, apportioned and assessed aforesaid will be due and collectible in four equal installments falling due each and every year thereafter until all are paid, and all to be collected with interest as in this ordinance provided, PROVIDED HOI.-JEVER, that the owner of any piece of property liable .for any such assessment I � may redeem his property from such liability by paying into the City Treasury the entire I amount chargeable against the same, as in this ordinance designated, at any time within t_lirty days after the publication of this ordinance and before the issuance of bonds of said city in payment of the balance of the cost of said improvements, and the property I so paid on shall not thereafter be liable for any birther assessments for the cost of said improvements nor for any part of said bonds. Section 11. There is hereby further levied and assessed against each lot and piece of ground described in this ordinance, interest at such rate per annum as shall be borne by the bonds hereafter to be issued for the payment of the remaining unpaid cost of such improvements, to be hereafter determined and fixed by ordinance when such bonds are issued, on all of said installments mentioned and provided for in this ordinance, from the date of the bonds which may be issued at the end of thirty days as specified in the preceding sections hereof, as by law provided, to the time of the collection of the last installment as provided by law, which said interest shall be collected annually at the i same time and in the same manner as said installments are collected, and after the taking effect of this ordinance and the fixing of said interest rate when s2.ch bonds are author- ized and issued, it shall be the duty of the City Clerk of said city to annually at the same time other taxes are certified and until all of said assessments so apportioned and levied herein have been certified, to the County Clerk of Saline County, Kansas, a full list of all property liable to assessment and taxation for such work and improvement, except such property on which the special assessments aforesaid have been paid in full as hereinbefore provided, together with the respective amounts due on each of such lots and pieces of ground, which amounts shall include the annual installments of such special assessments toge6her with the interest at one year at the rate to be fixed as provided for in this ordinance, on all unpaid balances of such assessments, and such amounts so certi- fied as herein provided for shall be placed upon the tax roll by the County Clerk of Saline ,County, Kansas, and collected as other taxes are collected. Section 12. This ordinance shall take effect and be in force from and after its ;publication once in the official city paper.
