5612 Surety Bond / Deposit1 1 ORDINANC!Z1,1 5612 (Published in the Salina Journal i , ^ A Z, 1952) AN ORDINANCE providing for the amendment of Section 15-103 Revised Ordinances of the City of Salina, 19148, and repealing the original of said amended section. BE IZ ORDAINED by the Board of Commissioners of the City of Salina: Section 1. Ate. That Section 15-103 of the Revised Ordinances of the City of Salina, 1948, be and it is hereby amended to read as follows: 1115-103. BOND OR DEPOSIT. That a good and sufficient surety bond, signed by applicant and by a corpora a surety authorized to do business in the State of Kansas, or a cash deposit, in such amount as deemed sufficient by the Board of Commissioners of the City of Salina, but in no event less than One Thousand Dollars ($1000.00),shall be tendered to said Board and approved by the City Clerk prior to the issuance of a permit pursuant to the terms of this article, conditioned upon faithful compliance with the terms and conditions of this article, and further conditioned upon saving and hold- ing the city free and harmless from any damage resulting to said city as a result of drilling, pumping, repairing or other operations by permittee, the laying of pipe lines, the setting of tanks or as result of moving of machinery and equipment over any street of the City of Salina; provided, however, that the permitee or his or its assign shall pay the annual premium due upon said surety bond within ten days .following expiration of each annum and file a receipt therefor in the office of the City Clerk of the City of Salina; and provided further, that each permittee shall carry and maintain public liability insurance on each well or group of wells indemnifying payment of not less than Twenty Thousand ($20,000.00) Dollars property damage for any one accident and file good and sufficient proof thereof and payment of renewal premiums thereon with the City Clerk of said City; and provided further, that upon default by permittee in complying with any provisions of this article, the said Board may revoke any such permit, after five days' notice to permittee by registered mail and thereupon permittee shall cease and desist from all operations under the pursuant to any such permit; and provided further that any person or persons that have heretofore obtained permits under Ordinance No. 5128 may apply to the City Clerk of said City for authority to substitute One Thouaand Dollars ($1000.00) surety bond or bonds in lieu of the bond or bonds heretofore required and that upon satisfying the City Clerk that the liability insurance herein required has been obtained then the City Clerk is authorized to permit the substitution.', Section 2. REPEAL. That the original of Section 15-103, Revised Ordinances of the City of Salina, Kansas, 19148 be and it is hereby repealed. Section 3.
