AN ORDINANCE ratifying and confirming a contract with Cecil Saum and Arnold Saum, d/b/a Aaum Bros. for the construction of certain sidewalks in the City of Salina, Kansas, heretofore designated as Engineering Job Number 301, and providing for the issuance of temporary notes to pay the cost thereof, pending issuance and sale of bonds. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the acceptance of the City of Salina, Kansas, of the proposal of Cecil Saum and Arnold Saum, d/b/a Saum Bros., hereinafter referred to as the ttcontractor" as submitted to the Board of Commissioners on February 23, 1953, which is hereby found to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said city to said contractor and signed on behalf of the City by its Mayor on March 2, 1953, for the construction of certain public improve - ments in the City of Salina, Kansas, to -wit: Installation of sidewalks in the parking abutting Lots 2 to 19, inclusive, Block 3;'Lots 1 to 8, inclusive and Lots 10 to 12, inclusive, Block 4; Lots 16 to 18, incl- usive., and Lots 20 to 22, inclusive, Block 5; Lots 10 j to 14 inclusive, Block 1; all in Sunrise Addition to the City of Salina, Kansas, and in the parking of Lot 1 and Lot 15, Block 5, abutting Sunrise Drive and in the park- ing of Lots 9 and 15, Block 1, abutting Beloit Avenue, all in said Sunrise Addition, as provided for in Ordinance Number 5746 at and for the unit price for said work contained in said proposal, which proposal and contract are hereby referred to and made a part of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimates of the City Engineer on file in the office of the City Clerk, which estimate is hereby referred to and made a part of this ordinance. Section 2. Said improvements shall be built and constructed in accordance with the plans and specifications therefore prepared by the City Engineer on file in the i office of the City Clerk and in accordance with the proposal of said contractor and under the terms of said contract, all of which are hereby referred to and made a part of this ordinance. Section 3. That temporary notes signed by the Mayor and attested by the City Clerk be issued from time to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the contract price of $5,531.40 for such work, such notes to bear interest at not to exceed 42 per cent per annum and to mature not later than March 1, 1955, and to be issued in such amounts and at such times as may the money for the payment of the cost of such work be required, such notes to be issued to said contractor and to be redeemed and cancelled at the time that Internal Improverre nts Bonds are issued in lieu thereof. Section 4. That this ordinance shall take effect and be in full force from and after its publication once in the official city paper.
