AN ORDINANCE relating to and apportioning and levying special assessments on certaLn
lots and pieces of ground in the City of Salina, Kansas, to pay the cost of con-
struction of lateral sanitary sewers in Lateral Sanitary Sewer Districts numbered
DH -1 to DH -32, inclusive, and relating to and providing for the collection and pay-
ment of such assessments.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas
Section 1. That for the purpose of paying for the cost of building and con-

stracting lateral sanitary sewers in Lateral Sanitary Sewer Districts numbered
DH -1 to DH -32, inclusive, as authorized by the provisions of Ordinance Number 5671
the cost of which has been duly ascertained as shown by the City Engineerts Final
Estimate of Cost, which has been duly approved by the Board of Commissioners, there

are hereby levied and assessed on the property liable therefor, being all the lots
i
i
and pieces of ground lying in the sewer districts mentioned above as created by
Ordinance Number 56711, according to the appraised value of such lots and pieces of
ground without regard to the buildings or improvements thereon, special assessments

covering the cost of such improvements constructed in said sewer districts, said
special assessments beim based on the
p g special valuation and appraisement made by
three disinterested appraisers appointed by the Board of Commissioners of the City
of Salina, Kanaeis, vVeli said appraisement is hereby referred to and made a part
of this ordinance, and the several amounts levied and apportioned against the lots
and pieces of ground in said sewer districts for the purppse of paying the cost of

the improvements constructed in such district being hereby found and determined to
be as set forth in the following sections of this ordinance.
Section 2. That for the purpose of the payment of the construction of Lateral
Sanitary Sewer Number DH -1, an eight inch clay pipe sewer, beginning at a manhole
to be constaucted in Crawford Street approximately 300 feet east of the iriersection
of Crawford Street and Seneca Avenue; thence south approximately 75 feet; thence

southwesterly approximately 185 feet; thence north approximately 90 feet where a
manhole will be constructed which will be the terminus of Lateral Number DH -1,
the amount levied, apportioned and assessed agiinkt the lots and pieces of ground

Section 34. Said amounts levied, apportioned and assessed as aforesaid shall
be due and coll.ectiUs in ten equal installments, the first becoming due with the
taxes levied for theyear 1953, and one of said installments falling due on each
and every year thereafter until all are paid, all to be collected with interest
as in this ordinance provided, provided however, that the owner of any property
liable for any such assessment may redeem his property from such liability by
paying into the City Treasury the entire amount chargeable against the same as in
j
this ordinance provided and designated, at any time within thirty days after the
publication of this ordinance, and before the issuance of the bonds of said city
in payment of the cost of said improvements, and his property so paid on shall
not thereafter be liable for any further assessment for the cost of said improvement
nor for any part of said bonds.

Section 35. There is hereby levied and assessed against such lots and pieces
of ground described in this ordinance interest at such rate per annum as shall be
borne by the bonds hereafter to be issued for the payment of the remaining unpaid
cost of such improvements, such rate to be hereafter determined and fixed by
ordinance when such bonds are issued, on all of said installments mentioned and
provided for in this ordinance, from the date of the bonds which may be issued at
the end of thirty days as specified in the preceding section hereof as by law
provided, to the time of collection of the last installment as provided by law,
i
which said interest shall be collected annually at the same time and in the same
i
manner as said installments are collected, and after the taking effect of this j
j ordinance and the fixing of the interest rate when such bonds are authorized and
issued, it shill be the duty of the City Clerk of said city to annually at the
same time other taxes are certified, and until all of said installments so
apportioned and levied herein have been certified, to certify to the County Clerk
of Saline County, Kansas, a full list of all property liable to assessment and
i
taxation for such work and improvements, except such property on which the speciX1
assessment aforesaid have been paid in full as hereinhefore provided, together with
the respective amounts due on each of such lots and pieces of ground, which amounts
shall include the annual installments of such special assessments together with
the interest for one year at the rate to be fixed and provided for in this ordianence,
being the rate borne by the bonds to be issued on all unpaid balances of such
i
assessments, and such amounts so certified as herein provided shall be placed upon
i
the tax roll by the County Clerk of Saline County, Kansas, and collected as all other
taxes are collected.
Section 36. This ordinance shall take effect and be in force from and after
its publication once in the official city paper.
