5758 Levy AssessmentsORDINANCE NUMER 5758 (Published in the Salina Journal j , 1953) AN ORDINANCE relating to and apportioning and levying special assessments on certain lots and pieces of ground in the City of Salina, Kansas, to pay the cost of con- struotion of lateral sanitary sewers in Lateral Sanitary Sewer Districts numbered DH -33 to DH -41 inclusive, and relating to and providing for the collection and pay- ment of such assessments. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas Section 1. That for the purpose of paying for the cost of building and aon- structing lateral sanitary sewers in Lateral Sanitary Sewer Districts numbered DH -33 to DH -41 inclusive, as authorized by the provisions of Ordinance Number 5682 the cost of which has been duly ascertained as shown by the City Engineerts Final Estimate of Cost, which has been duly approved by the Board of Commissioners, there jare hereby levied and assessed on the property liable therefor, being all the lots and pieees of ground lying in the sewer districts mentioned above as created by I Ordinance Number 5682, according to the appraised value of such lots and pieces of ground without regard to the buildings or improvements thereon, special assessments covering the cost of such improvements constructed in said sewer districts, said special assessments being based on the special valuation and appraisement made by three disinterested appraisers appointed by the Board of Commissioners of the City of Salina, Kansas, which said appraisement is hereby referred to and made a part I of this ordinance, and the several amounts levied and apportioned against the lots and pieces of ground in said sewer districts for the purpose of paying the cost of the improvements constructed in such district being hereby found and determined to be as not forth in the following sections of this ordinance. Said amounts levied, apportioned and assessed as aforesaid shall be due and collectible in ten equal installments, the first becoming due with the taxes levied for the year 1953, and one of said installments falling due each and every year thereafter until all are paid, all to be collected with 1 1 interest as in this ordinance provided, provided however, that the owner of any property liable for any such assessment may redeem his property from such liability by paying into the City Treasury the entire amount chargeable against the same as in this ordinance designated, at any time within thirty days after the publication of this ordinance, and before the issuance of the bonds of said city in payment of the cost of said improvements, and his property so paid on shall not thereafter be liable for any furthdr assessment for the cost of said improvement nor for any part of said bonds. Section 12, There is hereby levied and assessed against such lots and pieces of ground described in this ordinance interest at such rate per annum as shall be borne by the bonds hereafter to be issued for the payment of the remain - Ing unpaid cost of such improvements, such rate to be hereafter determined and fixed by ordinance when such bonds are issued, on all of said installments mentioned and provided for in this ordinance, from the date of the bonds which may be issued at the end of thirty days as specified in the preceding section hereof as by law i provided, to the time of collection of the last installment as provided by law, which said interest shall be collected annually at the same time and in the same manner as said installments are collected, and after the taking effect of this ordinance and the fixing of the Interest rate when such bonds are authorized and issued; it shall be the duty of the City Clerk of said city to annually at the same time other taxes are certified, and until all of said installments so apportioned and levied herein have been certified, to certify to the County Clerrk of Saline County, Kansas, a full list of all property liable to assessment and taxation for such work and improvements, except such property on which the special assessment aforesaid have been paid in full as hereinbefore provided, together with the respective amounts due on each of such lots and pieces of ground, which amounts shall include the annual installments of such special assessments together with the tt interest for one year at the rate to be fixed and provided for in this ordinance, being the rate borne by the bonds to be issued on all unpaid balances of such assessments, and such amounts so certified as herein provided shall be place upon the tax roll by the County Clerk of Saline County, Kansas, and collected as all other taxes are collected.
