5757 Utility Improvements - Jones Addition1 1 ORDINANCE NUMBER 5757 ao_ DArE --a ,4 (Published in the Salina Journal �7 , 1953) AN ORDINANCE creating and defining a certain lateral sanitary sewer district in the City of Salina, Kansas, designated as Lateral Sanitary Seiner District Number 294, and providing for the construction of a lateral sanitary sewer in said lateral Sanitary Sewer District Number 294, so created, and providing for the pay- ment of the cost thereof and for the levying of special assessments against the property in said district for the payment of the cost of such construction and for the issuing of bonds to pay the cost thereof. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. Lateral Sanitary Sewer District 294. That there be and there is I hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which j shall be and it is hereby designated as Lateral Sanitary Sewer District Number ! 294 and which district shall include all the followingdescribed property in the City of Salina, Kansas, to -wits Lots 12, 14, 160 18, 20, 22, 23, 26, 28 and 30 on North Fourth Street and Lots 13, 15, 17, 190 21, 23, 25, 27, 29, 31, 33, 35, 37, 39, 41, 43, 45, 47 and 49 on North Third Street, all in Jones Addition to the City of Salina, Saline County, Kansas. Section 2. It is necessary and it is hereby ordered that an eight inch V.C.P. lateral sanitary sewer with all necessary connections, manholes, flushing tanks, and other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District Number 294 as created by Section 1 of this ordinance along the following course, to -wit: An eight inch clay pipe sewer beginning at a mento le in the intersection of the center line of Lincoln Avenue and the center line of the first alley east of Third Street; thence gest 330 feet to the center lineof first alley east of Fourth Street; thence south along said alley east of Fourth Street, 220 feet to the north right -of -sway line of Atchison, Topeka and Santa Fe Railway, there a manhole to be constructed and beginning again at the intersection of the center line of Lincoln Avenue and the center line of said first alley east of Fourth Street; thence north along center line of said alley 315 feet to the south line of Union Pacific Railroad right -of -away where a manhole will be constructed which will be the terminus of Lateral San- itary Sewer District Number 294 Section 3. That the City Engineer shall on or before February 23rd s 1953, prepare and file in the office of the City Clerk, plans and specifications for the construction of the lateral sanitary sewer provided for in the preceding sections of this ordinance which shall be of the proper character to serve the property lying within the district for which such sewer is to be constructed and shall on or before the same date prepare and submit to the Board of Commissioners a detailed estimate under oath of the cost thereof. That thereafter the City Clerk shall advertise for three consecutive days in the official city paper for sealed proposals for the building and construction of such sewer according to such plans and specifications, which proposals shall be filed with the City Clerk on or before the time fixed, in such notice, at which time the Board of Commissioners may let a contract for the building and construction of such surer to the lowest and best responsible bidder or bidders therefor; if there be any whose bids do not exceed the estimated cost thereof, but said Board shall reserve the right to reject any or all such proposals, and if no bid shall be received within such estimate, CONS _I DATED -SAL:;.:. C the Board of Commissioners shall have the power to do such work and make such improvements within the estimated cost thereof as provided by law. Section 4. That for the cost of building and constructing such sewer, special assessments shall be made for the full cost thereof on all lots and pieces of land j within and for which such sewer shall be built according to the appraised value thereof, without regard to the improvemieats or buildings thereon. Section 5. After the passage and publication of this ordinance, the Board of Commissioners shall appoint three disinterested appraisers, who having taken oath to make a true and impartial appraisement of all lots and pieces of land to taxation for the cost of such improvements, shall within five days after having been notified of their appointments proceed to appraise all of the lots andpieces Of land within such district liable to assessment and taxation as aforesaid, with- out regard to the buildings or improvements thereon, and after making such appraise - =onto, shall return to the Board of Commissioners of said city and said Board shall I � j designate a time for the special meeting of said Board for the purpose of hearing j any complaints that may be made as to the value of any lot or piece of land appraised i as aforesaid, of which special session due notice shall be given in the official i city paper, at which special session said Board may alter any valuation of any lot of piece of land, if, in their opinion, the same has been appraised too high or I too low. ' Section 6. The special assessment herein provided for may be paid by the I person liable therefor in four approximately equal annual installments but the owner of any property liable to such assessment my within thirty days from the date of determining the amount assessed against the property, pay the same in full and his property shall not be liable to any assessments for the cost of such improvements, and bonds as hereinafter provided for shall be issued in the amount i of the cost of such improvements remaining unpaid at the end of thirty days from the time such assessment is fixed. Section 7. For the purpose of paying for the work and improvements in this i i ordinance provided for, the Board of Commissioners may and are hereby authorized and directed to issue improvement bonds of the City of Salina, Kansas, in anamount I not to exceed the cost of such improvements, and. to run for a period of four ears Y j and be payable in four approximately equal annual installments, together with interest not to exceed five per cent per annum, which bonds shall be issued and payable according to law; and for the purpose of paying the principal and interest on said bonds as they severally become due and payable for the Board of Commi- sai.oners shall apportion and assess against the lots and pieces of land within jthe taxing district of such improvements, special assessments covering the cost of said improvement and apportionment therein contained shall hold good f orall of the installments that are to be collected from the specific property chargeable; i, such assessment and apportionment ordinance shall contain the total amount of tax apportioned to such tract, piece or parcel of land within the taxing dis* is t and shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually, at the same time that other taxes are certified, certify to the County Clerk of Saline County, Kansas., a full list of all property liable for such work and improvments, together with the respective numbered amounts due on each of said tracts, pieces or parcels of land, which amounts shall include the annual installment and interest on all unpaid balances for one year at the rate of not to exceed five per cent per annum, on such amounts so certified, which shall be collected as other taxes are collected. Section 8* This ordinance shall take effect and be in force from and after its publication once in the official city paper.
