5748 Construct Sewer & Drainage - Franklin StORDINANCE NUMBER 5718 (Published in the Salina Journal 1953) AN ORDINANCE providing for the construction of a certain storm sewer and drainage in the City of Salina, Kansas to be designated as Franklin Street Storm Sewer, and pro- viding for the letting of contract for such construction and for the payment of the cost thereof. WHEREAS, at all times heretofore, the entire City of Salina has constituted a storm server and drainage district and, bonds issued to paythe cost thereof are payable b a general tax as provided by law; and y BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kaneass Section 1. That the premable of this ordinance is hereby incorporated herein. i That the entire City of Salina is hereby determined to be the benefit district for I I the purpose of the installation of a system of storm sewerage and drainage in the said city That the entire limits of said city has always constituted one distristt for said purpose. Section 2. That it is necessary and it is hereby ordered that a storm sewer i (described as a main sewer and certain laterals for convenience only), which is hereby designated as Franklin Street Storm Sewer, together with g all necessary inlets, inlet connections, manholes, connecting lines, sluice gates and other appurtenances, be constructed in the City of Salina along the following course, to --wits MAIN SEMI a 36 inch concrete pipe sewer beginning in the intersection of Osage Avenue and Franklin Street; thence east in Franklin Street, 330 feet more or less to the intersection of Franklin Street and Mohawk Avenue; thence east in Franklin Street, with a 30 inch concrete pipe sewer 280 feet, more or less to the intersection of Seminole Avenue and Franklin Street; thence east in Franklin Street with a 18 inch concrete pipe sewer 280 feet, more or less, to the intersection of Shaeimes Avenue and Franklin Streets thence south in Shawnee Avenue with a 12 inch concrete pipe sewer 430 feet to a mathole to be con- structed, which will be the terminus of said main sewer. Lateral No. 1. Beginning at the intersection of Mohawk Avenue and Franklin Street thence south in Mohawk Avenue with a 12 inch concrete pipe sewer 430 feet where a manhole will be con- structed, which will be the terminus of said Lateral Noe le lateral Noe 2. Beginning at the intersection of Franklin Street and Shawnee Avenue thence south along Shawnee Avenue with a 18 inch oonobete pipe sewer 1,000 feet more or less, to the interseetion of Seminole Avenue and Shawnee Avenue where a manhole will be constructed which will be the term- inus of Iateral No. 2• Section 3e That on or before the 16th day of February , 1963 the - - City Engineer shall prepare and file in the office of the City Clark, detailed plans and specifications for the construction of the storm sewers provided for in Section 2 of this ordinance with vitrified and/or corrugated metal pipe, bituminous coated, and/or concrete sewer pipe or any combination of such types of seweri e and p p on or before the same date shall prepare and file in the office of the City Clerk, under oath, a detailed estimate of the cost thereof. After such plans and specifications and estimate of cost shall have been filed, the City Clerk shall advertise by advert- isaments published in the official city paper for at least three consecutive days for sealed proposals for the building and construction of such storm sewers and at the time and place mentioned, the Board of Commissioners may leta contract with the -lowest and best responsible bidder therefor for the building and eonatruation of such storm and drainage sewers, but the right to reject any and all bids shall be f 11 and is hereby reservedg and provided further that if no responsible person shall purpose to enter a contract at a price not exceeding the estimated cost, then the Board of Commissioners may proceed to constructed said improvements within the estimated cost thereof and shall purchase the necessary tools, apparatus and mater- ials and employ the necessary labor for the purpose of constructing the same. Section 4. That for the payment of the cost of said work, the Board of Commissioners shall issue General Obligation and Improvement Bonds of the City of Salina, Kansas, in an amountnot to exceed the total cost of such work and improve- ments, to be payable in Z4 approximately equal annual installments and to bear interest at not to exceed five per cent per annum and from the date of such bonds, and for the purpose of paying such bonds and interest as they severally mature, the Board of Commissioners shall annually levy a tax upon all real and personal property in the City of Salina in an amount sufficient to pay the annual installments of such principal and interest, and that pending the issuance of such bonds, temporary notes shall be issued according to law, to pay the cost of such work* Section 5. This ordinance shall take effect and be in force from and after its publication in the official city paper.
