5746 Sidewalk Improvements - Sunrise Addition1 1 1 ORDINANCE NUMBER 5746 Published in the Salina Journal 4211 - s 1953) AN ORDINANCE providing for construction and installation of side- walks in the parking abutting Lots 2 to 19, inclusive, Block 3; Lots 1 to 8, inclusive and Lots 10 to 12, inclusive, Block 4; Lots 16 to 185, inclusive, and Lots 20 to 22, inclusive, Block 5; Lots to to 14, inclusive, Block 1; all in Sunrise Addition to the City of Salina, Kansas, and in the parking of Lot 1 and Lot 15, Block 5, abutting Sunrise Drive and in the parking of Lots 9 and 15, Block 1, abutting Beloit Avenue, all in said Sunrise Addition, and providing for the payment of the cost thereof and how the same shall be assess- ed and the manner of the payment of the cost thereof. WHEREAS, by Resolution Number 1333, adopted and passed on August 11th, 1952, published in the 19alina Journal August 19, 1952, the Board of Commissioners of the City of Salina, Kansas, deemed it hecessary that j sidewalks be constructed in accordance with approved plans and speci- fications on file in the office o f the City Engineer of Salina in the parking abutting Lots 1 to 19, inclusive, Block 3; Lots 1 to 12, inclusive, Block 4; Lots 16 to 22, inclusive, Block 5; Lots 10 to 14, inclusive, Block 1; all in Sunrise Addition to the City of Salina, Kansas, and in the parking of Lot 1 and Lot 15, Block 5, abutting Sunrise Drive and in the parking of Lots 9 and 15, Block 1, abutting Beloit Avenue, all in said Sunrise Addition; and WHEREAS, by said ordinance the owner or owners of each of said lots above described were directed to cause said sidewalks to be so con- structed in the parkin adjacent to each of said lots and pieces of land within thirty (30 days after the adoption and publication of said resolution; and WHEREAS, said sidewalks above described have not 'been so constructed by the owners of the lots and pieces of land above described; except- ing as to Lot 9, Block 4 and Lot 1, Block 3 and Lot 19, Block 5, afore- said; and WHEREAS, more than thirty (30) days have passed since the adoption and publication of said resolution. S0, NOW, THEREFORE, BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That it is necessary and it is hereby ordered that a sidewalks five (5) feet in width be constructed in the parking abutt- ing Lots 2 to 19, inclusive, Block 3, Sunrise Addition to the City j of Salina, Kansas. Section 2. That it is necessary and it is hereby ordered that a sidewalks five (5) feet in width be constructed in the parking abutt- ing Lots 1 to 8 inclusive, and 10 to 12, inclusive, Block 4, Sunrise I Addition to the City of Salina, Kansas. Section 3. That it is necessary and it is hereby ordered that a five sidewalk a i e (5) feet in width be constructed In the parking abutt- Lots 16 to 18, inclusive and Lots 20 to 22, inclusive, Block 5, Sun- rise Addition to the City of Salina, Kansas. Section 4. That it is necessary and it is hereby ordered that a sidewalk (5) five feet in width be constructed in the parking abutt- ing Lots 10 to 14, inclusive, Block 1, Sunrise Addition to the City i of Salina, Kansas. Section 5. That it is necessary and it is hereby ordered that a sidewalks five (5) feet in width be constructed in the parking of Lot 1 and Lot 15, Block 5, abutting Sunrise Drive, Sunrise Addition coNsouDATE' i to the City of Salina, Kansas. i i Section 6. That it is necessary and it is hereby ordered that i I j a sidewalk five (5) feet in width be constructed in the parking of I Lots 9 and 15, Block 1, abutting Beloit Avenue, in Sunrise Addition I to the City of Salina, Kansas. Section 7. That for the work and improvements herein provided for, the City Engineer shall, on or before the 2nd day of February 1953, submit to the B"oard of Commissioners under oath, detailed I estimates of the cost of such work and improvements. Section 8. That the work and improvements herein provided for shall be constructed in accordancd with the approved plans and speci- fications on file in the office of the City Clerk and the office of the City Engineer of the City of Salina, as made and provided by law and the ordinances of said city. Said plans and specifications are incorporated herein by reference. Section 9. That after the City Engineer has file the detailed ; estimate above ordered, the Board of Commissioners may advertise by advertisement published in the official city paper of the City of i Salina, Kansas, for three (3 ) consecutive days for the receipt of sealed proposals for constructing said sidewalks according to plans i and specifications set out in Sections 1 to 6, inclusive, hereof, and that said Board of Commissioners may and are hereby authorized and directed to let contracts for said sidewalk construction to the lowest i jresponsible bidder or bidders therefor as determined by said Board of Commissioners, said Board reserving the right to reject any and all bids. Section 10. That for the payment of the cost of the construction I of the abovementioned sidewalks, assessments in three (3) approximately I equal installments shall be made against the property abutting on the sidewalks. Section 11. That for the purpose of paying the cost of the work and improvements in this ordinance provided for the B oard of Commi- ssioners mml- ssioners are hereby directed and authorized to issue internal improve- ment bonds of the City of Salina in an amount not to exceed the con- tract price or cost of sucji improvements. Said bonds shall run for a period of three (3) years and be payable in three (3) equal install- ments, together with interest not to exceed five (5,,,'o') per centum per annum, wlich bonds shall be made payable at the Fiscal Agency of the State of Kansas and for the purpose of paying principal and interest N 1 1 1 CONSOLIDATED -S'Li- on said bonds as they severally become due and payable, the Board of j Commissioners shall apportion and assess against the lots and pieces I ' I of land within the taxing district of such improvements special assess- ments ments covering the cost of such improving and � P g the apportionment herein i contained shall hold good for all of the installments that are to be collected from the s I � pecific property chargeable with said improvements. � Such assessments a nd apportionment ordinance shall contain t � he total amounts of tax apportioned to each tractiece or P� parcel of land j within the taxing district and shall state the number of annual install4 i men -us in which such tax is to be • i I collected, and thereafter the City Clerk shall annually, at the same time other taxes are certified, I certify to the County Clerk ofX Saline County, Kansas, a full list of all property liable for such work and improvementstogether with � , I the respective amounts due on each of said tracts and pieces of land, I which amounts shall include the annual installments and interest on I all unpaid balances for one year at the rate not to exceed five q' per centum per annum on aUxxxpagjj such amounts so certified which shall be collected as other taxes are collected.
