AN ORDINANCE providing for the appropriation and condemnation of certain land within.
the City of Salina and for the improvement of the same for off-street parking facili-
ties and further providing for the payment of the cost thereof.
SAS, the Board of Commissioners of the City of Salina, Kansas, heretofore duly
adopted and caused to be duly published that certain Resolution No. 1369 , which
was a resolution "determining (1) it to be advisable for, and of bene t , the City
of Salina, Kansas, to acquire certain lands hereinafter described and to improve for

off street parking facilities; (2) theaggregate amount of money to be expended for
such acquisition and improvement; and ( that it is necessary to issue revenue bonds
of the said city, in the manner and form provided by law, for the purpose of paying

a part of such aggregate cost;" and
WMEAS, thereafter that certain Resolution No. 1369 was duly likewise adopted,

whish resolution provided for "(1) for the appropr at on of certain land for public
use and (2) for the filing of a, plat and survey thereof."; and
WHEREAS, it is deemed advisable for the City to proceed to carry out the acquisition
of such land and the improvements thereof for the purposes aforesild; and
S0, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMARISSIONERS OF THE CITY OFSALI4

Section 1. The following described land is hereby condemned and appropriated
for the use of the City of Salina, Kansas, for use and improvement as an off-street

parking facility, to -"it:
STJDBMRF-STEVMMN TRAM Lots 81, 838 85, 87 and the
North Half of Lot 89, all on Fifth Street in the Original
Town (now city) of Salina, Saline County, Kansas.
Section 2. That it is hereby determined to be necessary to improve the lands,
aforesild, as an off-street parking facility and the City Engineer of the City of
Salina, Kansas, is hereby directed to file detailed plans and specifications for the

improvement thereof and that said City Engineer is further directed to file a detailed
estimate under oath of the cost of the improvement and acquisition of the lands, as
gforesaid, with the City Clerk of said city, all on or before the day of
1953. That the general nature of the imprsrvemaent, aforesaid,
sball be the surfacing of said lands with six (6) inch reinforced concrete, the
lighting and marking and necessary improvements to adopt the said lands to use for
such purpgse.
Section 3. That after such plans and specifications have been made and filed
as aforesaid, and the acquisition of said lands as herein provided, the Board of
Couni.ssioners shall advertise, by advertisement published in the official cit r
Y paper,,
for three consecutive days for the receipt of sealed bids and proposals for the con-
pletion of said work and improvements as providided for in Section thereof, and after
the receipt of bids and proposals, the said Board is hereby authorized to let a con.
tract for the completion of said improvements. Said Board of Commissioner$ hereby
reserves the right to reject all bids and to cause said work and improvement to be
done force account as by lair made and provided and within the detailed estimate of
cost, aforesaid*
Section 4. That for the payment of the cost thereof the Board of Commissioners

of the City of Salina, Kansas, shall malt® available the sum of X300000.00, now on
hand in the treasury of said city, to apply on the cost thereof, and that thereupon
the Board of Commissioners of said City shall issue revenue bonds for such purpose,
as to be hereafter provided by ordinance, in the manner and form as made and provided

by law for such bonds. That the total of the $300000.00 on hand, as aforesiad, and
of the revenue bonds, as aforesaid, shall not wooed the estimate of cost, afvnesaid.
Section S. That upon the issuance of the bonds, as aforesaid, that C. L. Clark,

City Attorney, is hereby ordered to forthwith prepare and present in the name of the
Board of Commissioners of the City of Salina, a written application to the Judge of
the District Court of Saline County, Kansas, praying for an order of appointment of
Conmissioners to make an appraisement of all damages, as made and prodded by law,

from the appropriation and eondetimnation of said lauds described in Section 1 hereof
and to do and perform all things in and about the procurbing and recording of said
order and subsequent proceedings to be had, as authorizid and required by law.
Section 6. This ordinance shall take effect and be in full force and effect
from and kk after its publication once in the official city paper.
