5737 Issue Improvement Bonds, Series P-156ORDINANCE NUMBER 5737 E (Published in the Salina Journal 1952) AN ORDINANCE authorizing and providing for the issuance of Improvement Bonds of the City of Salina, Kansas, in the sum of $58,085.99 to pay the cost of improving certain streets in said city to be designated as Series Number P-156. W[3EREAS, pursuant to proceedings duly had according to law, contracts have been let and performed for the construction of the following street improvements in the City of Salina, Kansas, to -wit t Curbing, guttering and grading of the north side of Claflin Avenue from the west line of Pershing Street to the east line of Funston Street, as providing by Resolution Number 1192 and Ordinance Number 5543. i Curbing, guttering and grading of Cloud Avenue from the east line of Ninth Street to the west line of Simmons Street and curbing, guttering and grading of the north side of Cloud Avenue from the west line of Highland Avenue to the west line of Simmons Street extended north, as provided by Resolution Number 1204 and Ordinance Number 5543. Curbing, Guttering and grading of Charlotte Street in Kraft Manor Addition from the east line of Highland Avenue to the west line of Simmons Street, as provided for by Resolution Number 1206 and Ord-- inance Number 5543. Curbing, guttering and grading of the west side of Highland Avenue in Kraft Manor Addition from the south line of Cloud Avenue to th e south line of Charlotte Street and the curbing, guttering and grading of the east side of Highland Avenue in Kraft Manor Addition from the south line of Cloud Avenue to the north line of Charlotte Street$ as provided by Resolution Number 1205 and Ordinance Number 5543. Curbing, guttering and grading of Jewell Avenue from the east line of Quincy Street to the east line of Sunrise Drive, as provided for by Resolution Number 1193 and Ordinance Number 5543. Curbing, guttering and grading of Lamar Street frcm the west line of Third Street to the center line of Fourth Street, as provided by Resolution Number 1194 and Ordinance Number 5543. Curbing, guttering and grading of Cloud Avenue from the west line of Simmons Street to the west line of the Union Pacific Railroad right- of-way, as provided by Resolution Number 1235 and Ordinance Number 5572. Curbing, guttering and grading of Sunrise Drive from the south line of Beloit Avenue to the south line of Ellsworth Avenue, as provided for by Resolution Number 1211 and Ordinance Number 5572. i IMERE,A."S, the total cost of said improvements has been ascertained and the portion thereof in the amount of 30,917.99 to be paid by the general taxes to be levied upon all taxable property within said city for the improvement of squares and areas formed by the crossing of streets and alleys and for the Improvement of any of said streets where the same is through or adjacent to property of the city for which the city is liable, and for rich bonds are to be issued; and WHEREAS, the total cost of said curbing, guttering and grading of said streets, which are to be paid by special assessments are to be levied upon lots and pieces of ground liable for the payment of said curbing, guttering and grading in said streets has been ascertained and has been found and determined to be the sum of $33,130.31, which amount bas been heretofore duly assessed and apportioned to the several lots and pieces of ground liable therefore according to law provided for in the ordinance of the City of i Salina, Kansas, relating thereto, duly passed and approved, of which amount the sum of $5,962.29 has been duly paid by the property owners liable therefore, leaving a balance of $27,168.02, for which bonds are to be issued;, and WEBS, bonds in the aggregate sum of $58,085.99 are to be issued to pay the actual net cost thereof= BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the foregoing preambles be and they are hereby authorized as a part of this ordinance and that for the purpose of providing funds to pay the cost o f the improvements herein above referred to oad described in the Ordinances and Resolutions hereinbefore referred to, there shall be issued Internal Improvement Bonds of the City of Salina, Kansas, in the total principal sum of $58,085.99, which shall consist of fifty-eight bonds numbered 1 to 58, inclusive, all dated December 1, 1952,whioh shall bear interest at the rate of One and one-half per cent per annum from and after said date until the respective maturity of said bonds, payable August 1, 1953, and thereafter semi-annually on February 1st and August lst, of each year, said interest to be evidenced by interest coupons as herein provided for and said bonds shall become due as follows Bonds numbered 1 to 16, for $1,000.00 each except Number 1 is for $19085.99 due August 1, 1954. Said bonds shall be signed by the Mayor and shall be attested by the signature of the City Clerk and corporate seal of the city shall be affixed thereto, and said bonds shall have attached thereto interest coupons representing the interest thereon, which coupons shall be in the form provided by law and shall bear the printed or lithographed facsimile signature of the Mayor and City Clerk of said city and said bonds and interest coupons shall be registered in the office of the City Clerk and in the office of the Auditor of State, as required by lay. Section 3. Said bonds shall be designated as Series PP -156 and shall be in the form and shall cont ain recitals substantially as follows: UNITED STATES OF AMERICA STAT E OF KANSAS COUNTY OF SALINE CITY OF SALIN& r-- ,AIDI ;• No* Series P-156 $ KNOff ALL MEN BY THESE ]?RESENTS, That the City of Salina in the County of Saline, State of Kansas, acknowledges itself to be inde'b'ted and for value received hereby promises to pay to the bearer the sum of DOLLARS in lawful money of the United States of America, on the first day of 19 with interest thereon from the date hereof at the rate of per cent per annu, payable August 1, 1953, and thereafter semi-annually on the first day of February and ,August in each year, on presentation and surrender of the interest coupons hereto annexed as said coupons severally became due, both principal and interest of this bond being payable at the office of the State Treasurer of the State of Kansas, in the City of Topeka, Kansas, and said City of Salina, Kansas, is held and firmly bound by these presents and the full faith, credit and resources of said city are hereby irrevocably pledged fat the payment of said principal and interest at maturity. This bond is one of a series of 58 bonds of like date and tenor, excepting denomination, an maturity, aggregating the principal sum of $58,085.99 issued by the City of Salina, sas, for the purpose of paying the cost of constructing certain ourbing, guttering and grading improvements in said city by the authority of and in full compliance with the provisions, restrictions and limitations of the constitution of and the laws of the State of Kansas, including Sections 10-101 to 10-128, 12-601 to 12-608 and 13-1011 and 13-1011x, all of the General Statutes of Kansas, 1949, and amendements thereto, and all other provisions of the laws of said state applicable thereto, and this bond and all other bonds of this series, and all interest thereon are to be paid by the City of Salina, Kansas. And it is hereby declared and certified that all acts, conditions, and things required to be done and to exist precedent to and in the issuance of this bond have been properly done and performed and do .exist in due aid regular form and manned as required by the constitution and laws of the State of Kansaq and that the total indebtedness of said city, including this series of bonds, does not exceed any constitutional or stat- utory limitation..
