AN ORDINANCE authorizing and providing for the issuance of Improvement Bonds of the
City of Salina, Kansas, in the sum of $107,625.97, to pay the cost of improving cer-
tain streets in said city to be designated as Series Number 3P-157.
WHEREAS, pursuant to proceedings duly had according to law, contracts have been let
j and performed for the construction of the following street improvements in the City
of Salina, Kansas, to -wits
Paving and grading of Johnstown Avenue from the east line of
Penn Avenue to the west line of Columbia Avenue, as provided
j by Resolution Number 1199 and Ordinance Number 5544.

Paving and grading of Lincoln Street from the west line of
Reynolds Street to the east line of -Broadway Boulevard, as
provided by Resolution Number 1198 and Ordinance Number 5544•
Paving and grading of Pershing Street from the north line of
Beloit Avenue to the center line of Republic Avenue, as
provided by Resolution Number 1208 and Ordinance Number 5544.
Paving and grading of Smoky Hill Drive from the east line of
Oakdale Avenue to the east line of Penn Avenue, as provided
by Resolution Number 1196 and Ordinance Number 5544•
Paving and grading of Eleventh Street from the north line
of Wilson Street to the north line of Republic Avenue, as
provided by Resolution Number 1230 and Ordinance Number 5573.
Paving and grading of Grand Avenue from the west line of
Tenth Street to the west line of Eleventh Street, as provided
by Resolution Number 1245 and Ordinance Number 5573.
Paving and grading of Kirwin Avenue from the west line of
Pershing Street to the east line of Funston Street as pro-
vided by Resolution Number 1229 and Ordinance Number 5573.
Paving and grading of Lamar Street -from the east Line of
Fourth Street to the west line of Third Street, as provided
by Resolution Number 1226 and Ordinance Number 5573•
lPaving and grading of Penn Avenue from the south line of
Gypsum Avenue to the north line of Smoky Hill Drive as pro-
vided by Resolution Number 1218 and Ordinance Number 5573.

Paving and grading of Twelfth Street from the north line of
Lincoln Avenue to the south line of Grand Avenue, as provided
by Resolution Number 1236 and Ordinance Number 5573.
Paving and grading and curbing and guttering for a width
of Twenty feet (20 feet), east side of Fourth Street from
the north line of Crawford Avenue to the south line of Prescott
Avenue as provided by Resolution Number 1225 and Ordinance
Number 55724.
Curbing, guttering, paving and grading of Grand Avenue from
the west line of Eleventh Street to the west line of Twelfth
Street, as provided by Resolution 1242 and Ordinance Number
5574.
Curbing, guttering, paving and grading of Grand Avenue from
the west line of Twelfth Street to the east line of Thirteenth
Street, as provided by Resolution Number 1214 and Ordinance
Number 5574.
Curbing, guttering, paving and grading of Tenth Street from
the north line of Grand Avenue to the south line of Woodland
Avenue, as provided by Resolution Number 1219 and Ordinance
Number 5574.
Curbing, guttering, paving and grading of University Street
from the Missouri Pacific Railroad Tracks to the east line
of Clark Street as

Curbing, guttering, paving and grading for a width. of
twenty-eight (28) feet, Fifth Street from the north line of
Pacific Avenue to the north line of Harsh Avenue, as provided.

of quincy Street to the east line of Sunrise Drive, as pro-
vided for by Resolution Number 1251 and Ordinance Number 5599.

Paving and grading of Sheridan Street from the south line of
Venango Street to the north line of Illinois Street, as pro-
vided by Resolution Number 1252 and Ordinance Number 5599.
jWHEREAS,
the total cost of said improvements has been ascertained and the portion thereof
in the amount of $20,713.00 to be paid by general taxes to be levied upon all taxable
j property within said city for the improvement of squares and areas formed by the cross-
ing of streets and alleys and for the improvement of any of said streets, where the same
is through or adjacent to property of the cityfor which the city is liable, and for
which bonds are to be issued; and
WHEREAS, the total cost of said curbing, guttering, paving and gradin of said streets

which are to be paid by special assessments and to be levied upon lots and of

ground liable for the payment of said curbing, guttering, grading and paving in said
streets has been ascertained and has been hereby found and determined to be the sum
of $96,674.91, which amount has been heretofore duly assessed and apportioned to the
several lots and pieces of ground liable therefor according to law provided for in the
ordinance of the City of Salina, Kansas, relating thereto, duly ;gassed and approved of
which amount the sum of $$761.94 has been duly paid by the property owners liable there -
for, leaving a balance of $86,912.97 for which bonds are to be issued; and
WHEREAS, bonds in the aggregate sum of $107,625.97 are to be issued to pay the actual
cost thereof.
BE IT ORDAINED b�T the Board of Commissioners of the City of Salina, Kansas:
Section 1. That the foregoing preambles be and they are hereby authorised as a
part of this ordinance and that for the purpose of providing funds to pay the cost of
improvements herein above referred to and described in the ordinances and resolutions

of Salina, Kansas, in the total principal sum of $107,625.97, which shall consist of

Section 2. Said bonds shall be signed by the Mayor and shall be attested by the

which coupons shall be in the form provided by law and shall bear the printed or
lithographed facsimile signature of the Mayor and City Clerk of said city and said bonds

KNOW ALL MEN BY THESE PRESENTS, That the City of Salina in the County of Saline,
State of Kansas, acknowledges itself to be indebted and for value received hereby
promises to pay to the bearer the sum of DOLLARS
in lawful money of the United States of America, on the first day of
19 , with interest thereon from the date hereof at the rate of
per cent per annum payable August 1# 1953, and thereafter xt semi-annually on the first
days of February and August each year, on presentation and surrender of the interest
coupons hereto affixed as said coupons become severally due, both principal and interest
of this bond being payable at the office of the State Treasurer of the State of Kansas,
in the City of Topeka, Kansas. And siad City of Salina, Kansas, is held and firmly bound
by these presents and the full faith, credit and resources of said city are hereby
irrevocably pledged for the payment of said principal and interest at maturity.
This bond is one of a series of 107 bonds of like date and tenor, excepting denomination,
interest rate and maturity, aggregating the principal sum of $107,625.97, issued by the
City of Salina, Kansas, for the purpose of paying the coat of constructing, curbing,
guttering, paving and grading improvements in said city by the authority of and in full
compliance with the provisions, restrictions and limitations of the constitution and
laws of the State of Kansas, including Sections 10-101 to 10-128, 12-601 to 12-608 ani
15-1011 and 13-1011x, all of the General Statutes of Kansas, 1949, and amendments there-
to, and all other provisions of the laws of said state applicable thereto, and this bond
and all other bonds of this series, and all interest thereon are to be paid by the City
of Salina, Kansas.
And it is hereby declared and certified that all acts, conditions, and things
required to be done and exist precedent to and in the issuance of this bond have been
property done and performed and do exist in due and regular form and manner as required
by laws and the constitution and laws of the State of Kansas, and that the total
indebtedness of said city, including this series of bonds, does not exceed any con-
stitutional or statutory limitation.
IN WITNESS WHEREOF, the said City of Salina, Kansas, has executed this bond by causing
it to be signed by its Mayor and its corporate seal to be hereto affixed, attested by
its Clerk of the City and the coupons hereto attached to be signed with the facsimile
signatures of said officers, and this bond to be dated the first day of. December,
1952.

Section 4. The Mayor and City Clerk are her6by authorised and directed to prepare
and execute the bonds hereinbefore described and to advertise and sell the same in the
manner provided by law, and when duly executed and registered to deliver said bonds
to the purchaser or Xnu& purchasers thereof.
Section 5. The full faith, credit and resources of the City of Salina, Kansas,
shall b e and the
� same are hereby irrevocably pledged for the prompt payment of said
bonds and all interest thereon. The Board of Commissioners of the City of Salina, Kansas, !,
shall annually make provision for the payment � of the principal and interest on said
bonds as they severally become due by levying taxes and assessments upon the property
liable therefor as provided by law.
Section 6. This ordinance shall take effect and be in force from and after its
