5734 TV & Radio Tower RegulationsORDINANCE NUMBER. 5731 FE ,-:<, (Published in the Salina Journal b 1952) AN ORDINANCE regulating the construction and erection of television and radio towers and antennas, providing for permits for construction and fees for permits and inspection, and providing penalties for the violation thereofe BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. PERMITS FOR ERECTION OF RADIO AND TELEVISIOIJTOVifEERS AND ANTENNAS: i No person, corporation or company shall erect or cause to be erected or re -erected within the limits of the City of Salina, Kansas, any radio or televisi!ion tower or antenna, without first, before proceeding with the erection of any radio or tele- vision tower which would extend more than ten (10) feet above the roof of the build- ing upon which it is located or twenty-five (25) feet above ground level where it is i to be supported on the earth, obtaining a permit for such construction or erection I from the Building Inspectors All such antennas, towers or antenna supports here- after erected shall comply with and be erected in a ccordna.ce with the provisions of II i i this ordinances Section 2. APPLICATION FOR Pr;MIT AND PERMIT FEES Before a permit is issued i by the Building Inspector, the applicant therefore shall sign an application in I writing which shall show the proposed location, size, nature and detail of construction of such antenna and tower, and any other information which the Building Inspector may require in connection therewith. If the antenna and tower to be erected as shown by such application, conforms with the provisions of this article, the Building Inspector shall, upon the payment of the fee of Three (3) Dollars therefor, issue such permit. All such fees collected by the Building Inspector shall be by him paid into the City Treasure or to the City Clerk between the first and tenth of the month j following their collection, together with a report to the City Clerk showing from whom and for what purpose such fees were collected. Section 3. CONSTRUCTION OF TELEVISION AND RADIO TOWERS AND ANTENNAS: All tele- vision and radio towers hereafter erected on the roof of a building within the City limits of Salina, Kansas, shall not exceed a heighth of seventy (70) feet from earth ground level to the highest point of the antenna erected thereon, except, on a build- ing having four (4) or more stories in heighth, the highest point of the antenna shall not be greater than twenty-five (25) feet above the roof which, supports such tower and antenna. All roof towers shall be guyed in complianee with the provisions for guying television and radio towers in this p ordinance, and shall be supported on the roof by suitable frame work to distribute the tower load structurally safe for the roof. No such tower shall be erected on a roof except where the roof be designed or reinforced to safely support the imposed load of the tower and the thrust of the guy wires. Except self-supporting towers, all such towers shall be guyed with not less than three (3) cable guys for each thirty-five (35) feet or fraction thereof of the heighth from its support and all such towers shall be designed to safely resist a wind velocity of one hundred (100) miles per hour. All television and radio towers shall be grounded, to the earth through a conductor having a current carrying capacity equal or greater than No. 8 copper wire having a ground resistant at all times not 1 1 1 greater than twenty-five (25) ohms* and the lead-in to the receiver, if not bonded to the metal tower, shall provide lightning arrestors approved for such usage* out- side of the building near the entrance to the wall, through a conductor as here.n I I provided for the tower, having a ground resistance of not more than twenty-five (25) ohms. Section 4. CODE. The installation of all television and radio lmttta wiring or conductors shall be made in accordance with the current issue of the National Electrical Code of the National Board of Fire Underwriters. Section 5, RADIO AND TELEVISION TOWERS, INSPECTION AND AfEPROVAL: The install- ation of such facilities shall be completed within 60 days following, the issuance of a permit therefor. Upon completion of the installation the permit holder shall immediately report the fact to the Building Inspector. Thereupon, the installation shall be finally inspected by the Building Inspector. Section 6. ALL RA.DIOY OR TELEVISION TO47ERS SUBJECT TO INSPECTION, UNSAFE TOWERS REP,DVED: All radio or television towers now or hereafter erected shall be, at all times, subject to the inspection of the Building Inspector or whenever any complaint has been made to him, or whenever he deems such inspection necessary. If the inspector at any time, finds such tower insecurely anchored or in any manner unsafe or in such conditition that it m any support or part thereof is liable to fall or break, he shall have authority to either order the same to be repaired or entirely removed, whichever in his opinion is necessary to make the tower safe and secure from falling. Any person whether the owner of the tower or premised on which it is erected, or in charge of such premises as the occupant thereof, or agent, representative, officer or member of any firm or corporation owning such tower or i owning or occupying such premises, or in charge thereof, who refuses to comply with such order shall be deemedguilty of a violation of this ordinance. I Section 7. If the installation complies with the provisions of this ordinance then the Building Inspector shall issue a certificate of approval. If the install- ation does not comply with the requisites of the application for a permit and -h is i ordinance, then the deficiency shall be corrected forthwith or the installation xKk shall be wholly removed. Section 8. PENALTY. Any person who violates or refuses to comply with or who resists or opposes the enforcement of any of the provisions of this ordinance shall I be deemed guilty of a public offense and upon conviction thereof shall be fined not less than ten (10) dollars nor more than two hundred (200) dollars for each offense. 'Whenever in this ordinance the word "person" is used, the same shall be deemed to apply to any agent, representative, member or z29J3scKt officer of any firm or corporation owning or in charge of any such radio or television tower or on ' res p s�. b 1 e for the erection or maintenance of any such radio or television tower.
