AN OR.DINANCE ratifying and confirming a contract with H. J. Taylor Construction Company
for the construction of a certain storm sewer and drainjage in the City of Salina, to
be designated as Ohio Street Storm Sewer, and providing for the issuance of temporary
j notes to pay the cost thereof, pending the issuance and sale of bonds.

I BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That the acceptance of the City of Salina, Kansas, of the proposal of

H. J. Taylor Construction Company, hereinafter referred to as the "Contractor" as sub-
mitted to the Board of Commissioner on November 3, 1952, which is hereby found to be
the lowest and best bid for such work, and the contract awarded by the Board of Commi-
ssioners of said city to said contractor and signed on behalf of the City by its Mayor

on November 10, 1952, for the construction of certain pbulic improvements in the City
of Salina, Kansas, to -wit:
Main Sewer: A 42 inch concrete pipe sewer beginning ata point 10 fRet
east and 885 feet, more or less, north of the SEPI corner of Section 13,
Township 14 south, Range 3 west, which is the center line of Ohio Avenue
extended south, this being a point on the south bank of the Smoky Hill
River, thence south with a 42 inch concrete pipe parallel and 10 feet
east of the east line of said section, 1910 feet; thence proceeding south
along same line with a 36 inch concrete pipe 680 feet to a point 10 feet
south of the center line of Martin Avenue, which is the junction of Lateral
No. 5; thence west with a 24 inch concrete pipe sewer parallel to and 18
(Ten) feet south of the center line of Martin Avenue 340 feet to a manhole
which will be junction of Lateral No. 1, thence west along said line of said
Martin Avenue with an 18 inch concrete pipe sewer 320 feet to a manhole which
will be the junction of Lateral No. 2; thence west along said line of said
Martin Avenue with an 18 inch concrete pipe sewer 326 feet to a manhole which
shall be the junction of Lateral No. 3; thence west along said line of
Martin Avenue with a 12 inch concrete pipe sewer 329 feet to a manhole
which will be the junction of Lateral Number 4, which will be the terminus
of Main Sewer.
Lateral No. 1. Beginning at a manhole in main sewer at the intersection
of Martin Avenue and Beatrice Avenue thence south 10 feet east of center
line of Beatrice Avenue with a 12 inch concrete sewer 240 feet to a manhole to
be construction which will be the terminus of Lateral No. 1,
Lateral No. 2. Beginning at a manhole in main sewer at the intersection of
Martin Avenue and Lewis Avenue; thence south 10 feet east of the center line
of Lewis Avenue with a 12 inch connate pipe sewer 240 feet to a manhole to b e
constructed which will be the terminus of Lateral No. 2.

Lateral No. 3. Beginning at a manhole in main sewer at -the intersection of
Martin Avenue and Pearl Avenue; thence south 10 feet east of the center line
of Pearl Avenue with a 12 inch conrete pipe sewer 240 feet to a manhole to
be constructed which will be the terminus of Lateral Noe, 3.
Lateral No. 4. Beginning at a manhole in main sewer at -the intersection of
Martin Avenue and Roach Street; thence south and 10 feet east of the center
line of Pearl Avenue with a 12 inch concrete pipe sewer 240 feet to a manhole
to be constructed which will be the terminus of Lateral No. 4.
Lateral No. 5. Beginning at a manhole in Main Sewer at the intersection of
j Martin Avenue and Ohio Avenue, thence south and 10 feet east of the center
line of Ohio Avenue with a 24 inch concrete pipe sewer 240 feet to a manhole
to be constructed which will be the terminus of Lateral No. 5*
at and for the unit price for said cork contained in said proposal, which proposal and
contract are hereby referred to and made parts of this ordinance, be and the same is
hereby ratif*ed and confirmed, said proposal being within the estimated cost of said
improvements as shown by the sworn estimate of the City Engineer on file in the office

of the City Clerk, which estimate is hereby referred to and made a part of this ordinance.
Section 2. Said improvements shall be built and constructed in accordance with
the plans and specifications therefor prepared by the City Engineer on file in the office
of the City Clerk and in accordnace with the proposal of said contractor and under the
terms of said contract, all of which are hereby referred to and made a part of this

Section 3. That temporary notes signed by the Mayor and attested by the City Clerk
be issued from time to time as the work progresses in the manner and form as required j

by law, the total amount thereof not to exceed the contract price for such work, such

j notes to bear interest at not to exceed 4—,'
per cent per annum and to mature not later

j than December 1, 1953, and to be issued in such amoufts and at such times as may the

money for the payment of the cost of such work be requiredg such notes to be issued b
j
said contractor and to be redeemed and cancelled at the time that Internal Imppovement
Bonds are issued in lieu thereof.
Section 4. That this ordinance shall take effect and be in full force from and
after its publication once in the official city paper.
