AN ORDINANCE ratifying and confirming a contract with the L. W. Rexroad and Son Con—
struction Company for the construction of certain curbing, guttering and grading
improvements on certain streets in the City of Salina, and providing for the issuance
of temporary notes to pay the cost thereof pending the issuance and sale of bonds.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That the acceptance by the City of Salina of the proposal of the
L. W. Rexroad and Son Construction Company, hereinafter referred to as the "Contractor"

as submitted to the Board of Commissioners on November 3, 1952, which is hereby found

to be the lowest and best bid for such work, and the contract awarded by the Board of

Commissioners of said city to said contractor and signed on behalf of the city of
Salina by the Mayor on November 10, 1952 for the construction of certain public
improvements in the City of Salina, Kansas, to—wit:
Curbing, guttering and grading of Martin Avenue from the center
line of Ruch Street to the center line of Lewis Avenue, as pro—
vided by Ordinance Number 5725.
Curbing, guttering and grading of Minneapolis Avenue from the west
line of Quincy Street, west 200 feet, as provided by Ordinance
Number 5725.
Curbing, guttering and grading of Morningside Drive from the center
line of Sunrise Drive to the center line of Roach Street as provided
by Ordinance Number 5725.
Curbing, guttering and grading of Sunrise Drive from the center liras
of Wilson Street to the south line of McAdams Road, as provided by
Ordinance Number 5725.

Curbing, guttering and grading of Sunrise Drive from the north side of
Republic Avenue to the center line of Morningside Drive as provided
by Ordinance Number 5725.
Curbing, guttering and grading of Wilson Street from the center line
of Sunrisd Drive to the center line of Roach Street as provided by
Ordinance Number 5725*
at and for the unit price for said work contained in said proposal, which proposal
and contract are hereby referred to and made a part of this ordinance, be and the
same is ratified and confirmed, said proposal being within the estimated cost of said
improvements as shown by the sworn estimates of the City Engineer on file in the
office of the City Clerk, which estimates are hereby referred to and made a part of
this ordinance.
Section 2. Said improvements shall be built and constructed in accordance with
the plans and specifications therefor prepared by the City Engineer on file in the
office of the City Clerk and in accordance with the proposal of said contractor and
undeb the terms of said contract, all of which are hereby referred to and made parts
of this ordinance.
Section 3. That temporary notes signed by the Mayor and attested by the City
Clerk be issued from time to time as the work rpogresses in the manner and form as
required by law, the total amount thereof not to exceed the contract price for such
work, such notes to bear interest not to exceed 471
per cent per annum and to mature
not later than December 1, 1953, and to be issued in such amounts and at such time
as money for the payment of the cost of such notes to be issued to said contractor
and to be redeemed and cancelled at the time that permanent bonds are issued in lieu

thereof.

Section 4. This ordinance shall be in force from and after it s publication
once in the official city paper.
