AN ORDINANCE relating to and apportioning and levying special assessments on certain lots
and pieces of ground in the City of Salina, Kansas, to pay the cost of curbing.,
guttering and grading of Martin Avenue from the center line of Sunrise Drive to the
center line of Roach Street; or�Fie curbing, guttering and grading of Norton Street
from the north line of Jewell Avenue to the south line of Ellsworth Avenue; or_�ie
curbing, guttering and grading of West side of Roach Street from the center line of
Kirwi.n Avenue to the center line of EllsworthAvenue; for the curbing, guttering and
grading of Sunrise Drive from the north line of Kirwin Avenue -to the south line of

assessments.

IBE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:

Section 1. That for the purpose of paying for that part of the cost of improving certain
I
'portions of certain streets as hereinafter set forth in the following sections of this ordin-
ance which is chargeable to the private property in the assessment districts for each of such
improvements, respectively, as set forth in the following sections of this ordinance with
;respect to each of such improvements, there are hereby levied and assessed on the property
i
liable therefor, being all of the lots and pieces of ground lying on either side of said
streets so improved, respectively, to the middle of the block for the distance improved,
with respect to the improvements in Sections 2, 3, 4 and 5 of this ordinance, according to
i
!the appraised value of such lots and pieces of ground with respect to each such improvement,
without regard to the buildings or improvements thereon, special assessments covering the
cost of such work and improvements, and special assessments being based on the special valua-
I
!tion and apprai.sement of said lots and pieces of ground heretofore made by three disinterested
i
;appraisers appointed by the Board of Commissioners of the City of Salina, Kansas, with respect
to each such improvements, which said appraisement are hereby referred tortand made pas of
this ordinance, and the several amounts levied, apportioned and assessed against the lots
;and pieces of ground for each of such ir-provements, respectively, for the purpose aforesaid
'as hereby found and determined to the amounts set forth in the following sections of this
;ordinance with respect to each of such improvements.
Section 2. For that part of the cost of curbing, guttering and grading of Martin
Avenueffrom the center line of Sunrise Drive to the center line of Roach Street, in which
'is chargeable against the

,cost is hereby determined to be $1795.57 there is hereby levied, apportioned and assessed

Section 6. Said amounts levied, apportioned and assessed aforesaid will be due and
collectible in four equal installments, the first becoming due with the taxes for the
1 Year 1953 and one of said installments falling due each and every Year thereafter until
all are paid, and all to be collected with interest as in this ordinance prov'd d

, HOWEVER, that the owner of any piece of property liable for any such assessment
may redeem his property from such liability by paying into the City Treasury the entire
amount chargeable against g the same, as in this ordinance designated, at any time withi

Y ys after the publication of this ordinance and before the issuance of bonds of
said city in payment of the balance of the cost of said improvements
and the property so
paid on shall not thereafter be liable for any further assessments for the cost of said
iMr'ovements nor for any part of said bonds.

Section 7. There is hereby further levied and assessed against each lot and piece of
ground described in this ordinance, interest at such rate per annum as shall be borne
i
by the bonds hereafter to be issued for the paz;ment of the remaining unpaid cost of such
improvements, to be hereafter determined and fixed by ordinance when such bonds are
issued, on all of said installments mentioned and provided for in this ordinance, from
the date of the bonds which may be issued at the end of thirty days as specified in the
preceding sections hereof, as by law provided, to the time of the collection of the last
i
installment, as provided by law, which said interest shall be collected annually at the
same time and in the same manner as said installments are collected, and after the taking
effect of this ordinance and the fixing of said interest rate when such bonds are author-
iized and issued, it shall be the duty of the City Clerk of said city to annually at the
same time other taxes are certified and until all of said assessments so apportioned and
levied herein have been certified, to the County Clerk of Saline County, Kansas, a full
list of all property on which the special assessment and taxation for such work and im-
provements is chargeable, except such property on which the special assessments afore-
said have been paid in full as hereinbefore provided, together with the respective amourYts
due on each of such lots and pieces of ground., which amounts shall include the annual
i
installments of such special assessments together with the interest for one year at the
rate to be fixed as provided for in this ordinance, on all unpaid balances of such assess-
ments., and such amounts so certified as herein provided for shall be placed upon the tax
i
roll by the County Clerk of Saline County, Kansas, and collected as other taxes are collected;.
Section_ 89 This ordinance shall
take effect and be in force from and after its
i
publication once in the official city paper.
