5722 Sewer and Drainage Improvements - Ohio StreetORDINANCE NUMBER 5722 (Published in the Salina Journal 1952 __- AN ORDINANCE providing for the construction of a certain storm sewer and drainage in the City of Salina, to be designated as Ohio Street Storm Sewer, and providing for the letting of contract for such construction and for the payment of the cost thereof. j WHEREAS, at all time heretofore, the entire City of Salina has constituted a storm sewer and drainage district and bonds issued to pay the cost thereof are payable by a general tax as provided by law; and BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: I Section 1. Section 2. That it is necessary 'and it is hereby ordered that a storm sewer i (described as a main sewer and certain laterals for convenience only), which is hereby I I, designated as Ohio Street Storm Sewer, together with all necessary inlets, inlet connections, manholes, connecting lines, sluice gates and other appurtenances, be constructed in the City of Shcina along the following course, to -grit: Main Sewer: A 42 inch concrete pipe sewer beginning at a point 10 feet east and 885 feet more or less, north of the SVP corner of Section 13, Town— ship 14 south, Range 3 west, which is the center line of Ohio Avenue extended south, this being a point on the south bank of the Smoky Hill River, thence south with a 42 inch concrete pipe parallel and 10 feet east of the east line of sgid section, 1910 feet; thence proceeding south along same line with a 36 inch concrete pipe sewer 680 feet to a point 10 feet south of the center line of Martin Avenue, which is the junction of Lateral No. 5; thence west with a 24 inch concrete pipe sewer parallel to and SO feet south of the center line of Martin Avenue 340 feet to a manhole which will be junction of Lateral No. 1, thence west along said line of said Martin Avenue with an 18 inch concrete pipe sewer 320 feet to a manhole which will be the junction of Latefal Noe 2; thence west along said line of said Martin A'v'enue with an 18 inch concrete pipe sewer 326 feet to a manhole which shall be the junction of Lateral No. 3; thence west along said line of Martin Avenue with a 12 inch concrete pipe sewer 329 feet to a manhole which shall be the junction of Lateral Number 40 which will be the terminus of Main Sewer. Lateral No. 1. Beginning at a manhole in main sewer at the intersection of Martin Avenue and Beatrice Avenue thence south 10 feet east of center line of Beatrice Avenue with a 12 inch concrete sewer 240 feet to a manhole to be constructed which will beh t e terminus of Lateral No. 1• Lateral No. & Beginning at a manhole in main sewer at the intersection of Martin Avenue and Lewis Avenue; thence south10 feet east of the center line of Lewis Avenue with a 12 inch concrete pipe seller 240 feet to a manhole to be constructed which will be the terminus of Lateral No. 2. Lateral No. 3. Beginning at a manhole in main sewer at the intersection of Martin Avenue and Pearl Avenue; thence southoIM 10 feet east of the center line of Pearl Avenue with a 12 inch concrete pipe sewer 240 feet to a manhole to be constructed which will be the terminus of Lateral No. 3. Section 3. That on or before the day of 1952, the City j Engineer shall prepare and file in the office of the City Clerk, detailed plans and specifications for the construction of the storm sewers provided for in Section 2 of this ordinance with vitrified and/or corrugated metal pipe, bituminous coated, and/or concrete sewer pipe or any combination of such types of sewer pipe and on or before 1 1 1 the same date shall prepare and file in the office of the City Cle*, under oath, a detailed estimate of the cost thereof. After such plans and specifications and est- imate of cost shall have been filed, the City Clerk shall advertise by advertisements published in the official city paper for at least three consecutive days for sealed I proposals for the building and construction of such storm sewers and at the time and place mentioned, the Board of Commissioners may let a contract with the lowest and best responsible bidder therefor for the building and construction of such storm and drainage sewers, but the right to reject any and all bids shall be and is hereby, I reservedi and provided further that if no responsible person shall purposeto enter I a contract at a price not exceeding the estimated cost, then the Board of Commissioners i may proceed to construct said improvements within the estimated cost thereof and shall purchase the necessarytools, , a pparatus and materials and employ the necessary labor for theur p pose of constructing the same. Section 4. That for the of the cost of such work, the Board of Commissioners shall issue General Obligation and Improvement Bonds of the City of Salina, Kansas, in am amount not to exceed the total cost of such work and improve- ment s, to be payable in 10 approximately equal annual installments and to bear interest at not to exceed five per cent per annum and from and from the date of such bonds, and for the purpose of paying such bonds and interest as they severally mature, the Board of Commissioners shall ann=ually levy a tax upon all real and personal property in the City of Salina in am amount sufficient to pay i the annual installments of such principal and interest and that s pending the issuance of such bonds, temporary notes shall be issued accordingto late to , pay t he cost of such work.
