5714 Eminent Domain - EasementCO�'LI�IJEC-5ALIN 1 ORLINANCE NO (Published in the Salina Journal AN ORDINANCE condemning an easement in certain land within Saline Countyp Kansas* for the use of said city in extending a certain storm and drainage sewer DA from the intersection of the center line of Viemont Avenue with the center line of Haven Avenue northward 883.7 feet to a certain outfall structure xammaemb 11 Scand providing for the payment of the cost thereof* IAMBUS$ the governing body of the City of Salina, Kansas' on the 25th day of August, 1952 found it necessary to appropriate an easement in certain private property in Saline County, Kansas for the use of said city for the extensiontpf a certain stoma and drainage sewer D A from the intersection of the center line of Viemont Avenue with the center line of Haven Avenue, northward 883.7 feet to a certain outfall structure now existing and directed the City Engineer of Salina, Kansas to file a survey and description of the easement so required and; I WHEREAS, on the 5th day of September, 1952, a survey and description of the land so required was duly filed with the City Clerk, SO NOW THEREFORE BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas. Section 1. The following described easement is hereby condemned and appropriatAed for the use of the City of Salina, Kansas,, in the land described, for the extensior0of a r '' certain storm and drainage sewer D -A from the intersection of the center line of Viemont Avenue with the center line of Haven Avenue northward 883.7 feet to a certain outfall structure new -existing to wit s Easement #1• An easement in the southwest quarter of Section 114, Towns"hip 11.4 south, Range 3 west of the Sixth Principal Meridian in Saline County, Kansas, more particularly described as follows 151 Beginning at a point 558 feet north of the south line and 166 feet east of the west line of said Section 14, thence north 60 parallel with said west line 683.7 feet, thence east -X feet, thence south parallel to said west line 683.7 feet, thence 60 westX3D feet to point of beginning. Easement #2• An easement in the southwest quarter of Section 14, Township 114, south, Range 3 west of the Sixth Principal Meridian in Saline County, Kansas, more particularly described as follows Beginning at a point 12141.7 feet north of the south line and 151 feet east of the west line of said Section 114, thence north 60 60 200 feet, thence east -3& feetp thence south 200 feet, thence west VO feet to point of beginning. Section 2. That C. L. Clark, City Attorneys is hereby ordered to forwith prepare and present in the name of the Board of Commissioners of the City of Salina, Kansas, a written application to the Judge of the District Court of Saline County, Kansas, praying for an order appointing commissioners to make appraisement and assessment of damages arising from the appropriation of said easement in said real estate described in Section 1 hereof, and do and preform all things in and about procuring and recording of said order of appointment required by law. 00 1_10 i -I EITLD- SALlliI 1 C w , , Section 3. That for the payment of the cost thereof the Board of Commissioners shall issue general obligation and improvement bonds of the City of Salina, Kansas, in an amount not to exceed thetotal cost of such work and :Uiprovements, except as here- in provided, to be payable in ten approximately equal annual installments and to bear interest at not to exceed 5% per annum and from the date of such bonds, and for the purpose of paying such bonds and interest as they several mature, the Board of Com- missioners shall annually levy a tax upon all real and personal property in the City of Salina in an amount sufficient to pay the annual installments of such principal and interest, and that pending the issuance of such bonds, temporary notes shall be issued according to law, to pay the cost of such work* Section 4* This ordinance shall take effect and be in force from and after its publication in the official city paper.
