ORDINANCE NUMBER 5712

AN ORDINANCE providing for the inclusion of certain, land within the corporate limits
of the City of Salina, Kansas, prescribing the corporate limits of said city and
repealing Section 3 of Ordinance Number 5689.
WHEREAS, all conditions precedent to the inclusion of certain land in the City of
Salina, Kansas, have come to pass, AND NOW,
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That a certain tract of land adjoining the corporate limits of the
City of Salina, Kansas, in Section 17, in Township 14 south, Range 2, west of the
Sixth principal meridian in Saline County, Kansas, described as follows: Beginning
at the NE corner of the 1* of said Section 17, thence south along the north south
4 section line in said Section 17, eight hundred sixty five (865))feet; thence crest
three hundred ten (310) feet; thence southwesterly four hundred twenty-seven and

three tgenths (427.3) feet to a point five hundred ten (510) feet west of and thirty
feet north of the SE corner of the N2 NYF of Section 17, thence west parallel with and

thirty (30) feet north of the south line of said N2 NVF42- one hundred. twenty (120) feet;
thence northwesterly three hundred thirty seven and three tenths (337.3) feet to the

southwest corner of the Cora Shelton property, the same being the southeast corner
of the J. E. Miller tract; thence northeasterly along the south line of the said Cora
Shelton property one hundred fif# (150) feet; thence northwesterly along the east
line of the Cora Shelton property, extended, to its intersection with the center line
of Overhill Road; thence northerly along the center line of Overhill Road, sometimes
known as Hilldale Road, to its intersection with the north line of said Section 17,
thence east along the north line of said Section 17, seven hundred thirty seven (737)
feet to the point of beginning, be and it is hereby included within the corporate
limits of said city, the owner of said tract having petitioned for the inclusion
thereof.
Section 2. That certain tract of land adjoining the corporate limits of the City
of Salina, Kansas, in Section 17, Township 14 south, Range 2 west of the Sixth Princi-
pal Meridian in Saline County, Kansas, described as follows: all that part of the

north half of the aovthwest quarter of Section 179 Township 1.4 south, Range 2, west
of the Sixth Principal Meridian in Saline County, Kansas, except Country Club Heights
Addition Number 1 and Country Club Heights Addition Number 2, be and it is hereby
included within the corporate limits of the said city, said tract containing less
than 20 acres and more than two-thirds (2/3) of the north, north and west boundaries
of said tract adjoining the boundary line of said city, and for the purpose of making
the boundary line of said city straight and harmonious.
Section 3. That a certain tract of land adjoining the corporate limits of the
City of Salina, Kansas, in Section 180 Township 14 south, Range 2 west of the Sixth
Principal Meridian in Saline County, Kansas, described as follower Upper Mill Heights,
a subdivision of Saline County, Kansas, being the Northwest Quarter of the southeast
quarter of Section 18, Township 14 south, Range 2 west of the Sixth Principal Meridian
in Saline County, Kansas, be and it is hereby included within the corporate limits of
the City of Salina, Kansas, said tract having been subdivided into lots and blocks.
Section 4. That a certain tract of land adjoining the corporate limits of the
City of Salina, Kansas, in Section 18, Township 14 south, Range 2 west of the Sixth
Principal Meridian, in Saline County, Kansas, described as follows: Lott 2 in
Surveyorts Plat #49, in Saline County, Kansas, be and it is hereby included within
the corporate limits of the City of Salina, Kansas, said tract containing less than
20 acres and more than two-thirds of the north, east, south and west boundaries of
said tract adjoining the boundary line of said city and for the purpose of making the
boundary line of said city straight and harmonious.
Section 5. That a certain tract of land adjoining the corporate limits of the
City of Salina, Kansas in Section 180 Township 14 souhh, Range 2 west of the Sixth

Principal Meridian described as follows: The south 20 feet of the west 586.67 feet
of Lot 1 in Surveyors Plat +49 in Saline County, Kansas, be and it is hereby included
within the corporate limits of the City of Salina, Kansas, said tract containing less
than 20 acres and the north, east, south and west boundaries thereof adjoining the
boundary line of said city.
Section 6. That the corporate limits of the City of Salina, be and the same are
hereby extended to include the territory added to, taken into and made parts of the
said city under the provisions of the proceeding sections of this ordinance, and that
all of the land lying within the following described boundary be and the same is
hereby declared to be within the corporate limits of said city and made a part of
said city, and that such corporate limits be and the same are hereby defined, as
follows;
Commencing at a point on the center line of Ninth Street extended south,
770 feet south of the intersection of the center line of Ninth Streit,
with the center line of Cloud Avenue, said intersection being the corner
common to Section 23, 24, 25, 26, Township 14 South, Range 3 west of the
Sixth Principal Meridian in Saline County, Kansas, thence west 920 feet,
thence north 770 feet to a point 6n the center line of Cloud Avenue,
thence west along the center line of Cloud Avenue 741 feet, thence north
to the northwest corner of Park View Addtion to said city; thence west
along the south line of Highland eaurt Addition to the southwest corner
of said Addition; thence north to the center line of Jewell Avenue, thence
west 2700 feet to the west line of Section 23, Township 14, south, Range
3 west of the Sixth Principal Meridian, thence north 1280 feet to the
northwest corner of the southwest quarter of Section 23, Township 14,
south, Range 3 west of the Sixth Principal Meridian; thence west 993.3
feet, thence north 2640 feet to a point on the north line of Section 22,
Township 14 south, Range 3 west of the Sixth Principal Meridian, thence
east 993.3 feet to the northwest corner of Section 23, Township 14 south,
Range 3 west of the Sixth Principal Meridian, thence north 62D feet;
thence east 1417 feet to a point 165 feat west of the west right-of-eay of
US 81 bye -pass; thence north parallel to the west right-of-way line of
US 81 by-pass to a point on the center line of Walnut Street 165 feet
west of the west right-of-way line of US 81 by-pass; thence west along
the center line of Walnut Street to the center line of Dry Creek, thence
in a northerly direction down the center of Dry Creek to the intersection
of the center line of said creek with the center line of the channelof
the Dry Creek cut-off channel as now established, being the first point
of intersection of said lines lying north of Walnut Street, thence north
along the center line of the channel of said Dry Creek cut-off channel
as noir established to its next intersection with the center line of Dry
Creek as originally existing; thence down the center line of the channel
of Dry Creek as originally existing to the point of intersection of said
line with the center line of the channel of Dry Creek cut-off channel as
j noir established; being the first point of intersection of said lines lying
north of the main line right-of-way of the Union Pacific Railroad and lying
adjacent to Block 10 in Chicago Addition; thence northeasterly down the
center line of the channel of the Dry Creek cut-off channel as now established
to the next intersection of said line with the center line of Dry Creek;
thence down the center line of Dry Creek as originally existing to its

of the northwest quarter of the northeast quarter of Section 110, Township
14, Range 3, thence north along said line to the north line of said Section
11, thence east along said line of Pacific Avenue to the intersection of
said line of Pacific to the intersection of said line with the southwesterly
line, extended southeasterly of Lots 1, 3 and 5 of Block 32 in Military
Addition, thence northeasterly along said line and along the west line of
Lots 7 and 9 in said Block 32, being the westerly boundary of said Block
32 in Military Addition, to the northwest quarter of said Lot 9, in Block
32, thence due west 40 feet to a point; thence due north 152 feet to a
point; thence due east 170 feet to the east line of the alley in said
Block 329 thence due north to the north line of Harsh Avenue in Military
Addition; thence east along the north line of Harsh Avenue to the west
line of Twelfth Street in Military Addition; thence north along the west
line of Twelfth Street to the southwesterly line of the abandoned rail-
road right-of-way running through said Military Addition; thence east
to a point in said abandoned right-of-way due south of the intersection
of the northegsterly line of said right-of-way with the south line of
Antrim Avenue; thence north through said point of intersection to the
north line of Antrim Avenue; thence east along the north line of Antrim
Avenue to the west line of Eleventh Street in Military Addition; thence
north along said line, and said line extended north, through Tucker Parks
to the intersection of said line with the center line of Euclid Avenues
being the center line, running east and west of Section 2, Township 14,
Range 3, thence east along the center line of said Section 2 to a point
159.6 feet of the southeast corner of the northeast quarter of said
Section 2, Township 14, south, Range 3 west of the Sixth Principal Meri-
dian; thence north 395 feet, more or less, to a point in the center of
the original channel of Dry Creek (as heretofore existed) thence north-
erly and westerly up the center of the original channel of Dry Creek
to its intersection with the north line of the south half of the north-
east quarter of said Section 2; thence east to a point 106.1 feet west
of the east line of the northeast quarter of said Section 2; thence south
237.8 feet; thence east 45 feet; thence south 512 feet; thence east 5
feet; thence south 413 feet; thence west 30 feet; thence south to a point
in the south line of the northeast quarter of said Section 2 which lies
84.6 feet west of the southeast oorher of the northeast quarter of said

along the east line of the alley which lies along the east side of said
addition, and which is the east line of said Addition to the intersections
with the center line of Harsh Avenue as shown by the recorded plat of
said addition; thence east along the center line of Harsh Avenue, extended
east, to the intersection of said line extended with the east line of the
southwest quarter of Section 1, Township 14, Range 3, being the center
line of said Section, thence south along the center line of Section 1 and
the center line of Section 12, Township 140 Range 3, being the center line
of Front Street, to the south line of the main line right-of-way of the
Union Pacific Railroad Company, thence northeasterly along the southerly
line of said railroad right-of-way to the east line of said Section 12,
thence south along said line, being the center line of the Ohio Avenue
to the center of the Channel of the Smoky Hill River; thence south-
easterly down the center of the channel of said river to its intersection
with the east line of Lot 2 in Surveyor's Plat No. 18; thence south along
said east line of said Lot 2 to the north line of Section 18, Township 14,
Range 2; thence east along the north line of said Section 18 to a point
417.2 feet west of the northeast comer of said Section.UV thence north
417.2 feet, thence east 417.2 feet to the eastline of Section 7, Township
14, South, Range 2, west of the Sixth Principal Meridian; thence south
along the east line of said Section 7, 417.2 feet to the northeast lorner
of Section 18, Township 14 south, Range 2 west of the Sixth Principal
Meridian; thence east along the north line of Section 17, Township 14,
Range 2, to the northeast corner of the northwest quarter of said Section

thence north along the west line of Upper Mill Heights to the north--
east corner of the southwest quarter of Section 18, Toumship 14
South, Range 2 most of the Sixth Principal Meridian; thence west xbmg
along the south line of the northwest quarter of Section 18# Township
14, South, Range 2 West of the Sixth Principal Meridian to a point 250
feet east of the southwest corner of the northwest quarter of said
Section 180 Township 14# south, Range 2 west of the Sixth Principal
Meridian, thence south 2,340 feet to a point on the south line of sand

250 feet east of the southwest corner of said Section, thence south and
parallel to the east line of Section 24, Township 14 south, Range 3 west
of the Sixth Principal Meridian, 4,635 feet; thence west 1576 feet to the
center line of Roach Street; thence south along the center line of Roach
Street to its intersection with the center line of Cloud Street, being
the southeast corner of the addition to the Grounds of Kansas Wesleyan
University; thence west along said line being the south line of said
Section ; to its intersection with the west line of the right-of'racay of
the Union Pacific Railroad; thence south along said west line 1320
feet, thence east 17 feet, thence south 280 feet along said west right-
of- my, thence west 1527 feet to the east right -of -sway line of US 81
Highway, thence north 830 feet along said east right-of-way line of US
81 Highway; thence west 57.3 feet to the center line of Ninth Street
being the point of beginning.
Section 7. That Section 3 of Ordinance Number 5689 be and it is hereby repealed.
Section 8. That this ordinance shall be in full force and effect from and after
its adoption and publication once in the official city paper.
