AN ORDINANCE ratifying and confirming a contract with Le Ce Peddicord for the
construction of certain storm sewers and drainage in the City of Salina, Kansas,
heretofore designated as Storm Sewers Number D -A, D -B, D -C and D -D, and provid-
ing for the issuance of temporary notes to pay the cost thereof, pending issuance
and sale of bonds.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansast
Section 1. That the acceptance by the City of Salina of the proposal of
L. C. Peddicord,-hereinafter referred to as the "contractor" as submitted to the
Board of Commissioners on August 18, 19520 which is hereby found to be the lowest
and best bid for such work, and the contract awarded by the Board of Commissioners
of said city to said contractor and signed on behalf of the City by its Mayor on
August 18, 1952, for the construction of certain public improvements in the City
of Salina: Kansas, to -mitt
Storm and drainage sewer D -A includes the main sewer running from
Dry Creek South to the intersection of Viemont Avenue and Crawford
Avenue, thence easterly and southerly through certain streets in
the Sunset Manor Addition and the Likins-Foster Addition and term-
inating near the southeast corner of the Likens -Foster Addition
and all laterals which drain into Main Sever D -A, being Laterals
Number D -A1, D -A22 D -A3, D A4, D -A5, D -A6, all being a part of
Storm Sewer D -A, more partictilarly described as follows
Main Sewer D-Ae Beginning at a point on the south bank of Dry
Creek and the intersection of Viemont Avenue extended north;
thence south with a 72 inch sewerpipe approximately 1423 feet
to a point in the intersection of Vismiont Avenue and Crawford
Street; thence east in Crawford Avenue with a 72 inch sewer
pipe approximately 119 feet to a point in the intersection of
Seneca Avenue and Crawford Street; thence south and southeast-
erly in Seneca Avenue with a 72 inch sewer pipe approximately
470 feet to a point in the intersection of Seneca Avenue and
Cherokee Drive; them* continuing southeasterly in Seneca Ave-
nue with a 54 inch sewer pipe approximately 1250 feet to a point
in the intersection of Seneca Avenue and Franklin Avenue; thence
east in Franklin Avenue with a 54 inch sewer pipe approximately
300 feet to a point in the intersection of Franklin Avenue and
Osage Drive; thence south in Osage Drive with a 48 inch sewer
pipe approximately SSE 2152 feet to a point in the intersection
of Osagi Drive and Kiowa Avenue! thence continuing south in Osage
Drive with a 42 inch sewer pipe approximately 200 feet to a point
in the intersection of Osage Drive and Pawnee Avenue; thence
continuing south in the easement provided therefor With 42 inch
sewer pipe approximately 307 feet to the terminus point approx-
imately 13 feet north of the south boundary line of the Likins-
Foster Addition; and
Lateral No. D -A1. Beginning at manhole No, i, -A3 in said described
main server in the intersection of Seneca Avenue and Cherokee Drive;
thence northeasterly in Cherokee Drive with a 12 inch sewer pipe
approximately 420 feet, being the terminus of Lateral Noe DA1, and
Lateral No. D -A2, Beginning at manhole Noe A-5 in said described
main sewer in Seneca Drive; thence northeasterly in the easement
provided therefor with a 15 inch sewer pipe approximately 284
feet to a point in Osage Avenue, being the terminus of Lateral D -A2,
and
Lateral Noe D -A39 Beginning at manhole No. A10 in said described
main surer in the intersection of Osage Drive and Ponca Avenue;
thence west with a 15 inch sewer pipe approximately 300 feet to a
point in the intersection of Ponca Avenue and Seneca Avenue, being
the terminus of Lateral Noe D -A3, and
Lateral No. D -A4. Beginning at manhole nos A14 in said described
main sewer in the intersection of Osage Drive and Cheyenne Avenue;
thence westerly in Cheyenne Avenue with a 12 inch sewer pipe approx-
imately 710 feet, being the terminus of Lateral No, D -A4, and
Lateral No. D -A5. Beginning at manhole no. A16 in said described
main sewer in the intersection of Osage Drive and Kiowa Avenue;
thence westerly in Kiowa Avenue with a 15 inch sew ran abproa-
imately 700 feet, being the terminus of Lateral No, D -A5, and

Lateral No. D-A6e Beginning at manhole No. A17 in said described main sewer in
Osage Drive; thence southwesterly and westerly in Pawnee Avenue with a 15 inch
sewer pipe approximately 820 feet, being the terminus of Lateral Noe L-A 6.

Stora and Drainage Sewer D -B includes the main setwer running from the intersection
with Stomr Sewer D -A at the intersection of Cherokee Drive and Seneca Avenue,
southerly through certain streets in the Sunset Manor Addition and Likins-Foster
Addition, and terminating at the intersection of Apache Drive and Pawnee Avenue,
and all laterals which drain into Main Sewer D -B, being Laterals Noe D -B1, D -B2,
D -B3, D -B4, D -B5, D -B6 and D -B7, all being a part of Storm Sewer No. D -B, more
particularly described as follows:
Main Sewer D -Be Beginning at manhole No, A3 in the intersection of Seneca Drive
and Cherokee Drive; thence southwesterly in Cherokee Drive with a 60 inch sewer
Pipe approximately 620 feet to a point in the interweetion of Cherokee Drive and
Comanche Avenue; thence southeast in Commanehe Avenue with a 361ach sewer pipe
approximately 762 feet to a point in the intersection of Commanche Avenue and
Pontiac Avenue; thence south in Pontiac Avenue with a 36 inch sewer pipe approx-
imately 400 feet to Manhole No. B7 in Pontiac Avenue; thence oontinuing south in
Pontiac Avenue with a 30 inch sewer pipe approximately 789 feet to the intersection
of Pontiac Avenue and Republic Avenue; thence continuing south in Pontiac Avenue with
24 inch sewer pipe approximately 300 feet to a point in the intersection of Pontiac
Avenue and Arapahoe Avenue; thence west in Arapahoe Avenue with a 24 inch sewer
pipe approximately 403 feet to a point in the intersection of Arapahoe Avenue and
Apache Drive; thence south in Apache Drive with a 24 inch sewer pipe approximately
330 feet to a point in the intersection of Apache Drive and Cheyenne Avenue; thence

section of Plum Drive and. Hemlock Drive, and all laterals which drain into Main
Sewer D -C, being lateral Noe D-01 only, all being a part of Storm Sewer D -C, more
particularly described as follows;
Main Seaver D -Ce Beginning at Manhole Noe M -B2 in the intersection of Cherokee Drive
and Commanche Avenue; thence southerly in Cherokee Drive with, a 42 inch sewer pipe
approximately 510 feet to a point in the intersection of Cherokee Drive and Plum
Drive; thence west in Plum Drive with a 42 inch sewer pipe approximately 300
to a point in the intersection of Plum Drive and Hemlock Drive, befeet

mately 190 feet to a point in the intersection of Choctaw Avenue and Cypress Drive;
thence west in Cypress Drive with a 24 inch sewer pipe approximately 570 feet to
a point in the intersection of Cypress Drive and Birch Drive; thence south in
Birch Drive with an 18 inch sewer pipe approximately 800 feet to Manhole Noe
M D6, being the terminus of Main Sewer D -D, and
Lateral Noe D -D1, Beginning at Manhole Noe M -D4 in said described main soarer in
the intersection of Cypress Drive and Birch Drive; thence west in Cypress Drive
with a 12 inch sewer pipe approximately 280 feet to a point in the intersection
of Cypress Drive and Willow Drive; thence south in Willow Drive with a 12 inch
sewer pipe 200 feet to manhole Noe M -D8, being the terminus of Lateral No. D -Die
at and for the unit price for said work contained in said proposal, which proposal
and contract are hereby referred to and made parts of this ordinance, be and the same
is hereby ratified and confirmed, said proposal being within the estimated cost of said
improvements as shown by the sworn estimates of the City Engineer on file in the office
of the City Clerk, which estimates are hereby referred to and made a part of this
ordinance.
Section 2. Said improvements shall be built and constructed in accord ce
'Murray A. Wilson, a duly qualifieCivil Engineer
with the plans and specifications therefore prepared by, LAUMMon file in
the Office of the City Clerk and in accordance with the proposal of said contractor and
under the terms of said contract, all of which are hereby referred to and made a part
of this ordinance.
Section 3. That temporary notes signed by the Mayor and attest by the City
Clerk be issued from time to time as the wi*k progresses in the manner and form as
required by law, the total amount not to exceed the contract price for such work, such
notes to bear interest at not to exceed 41 per cent per annum and to mature not later
than December
1, 1953, and to be
issued in such amounts and
at such time
as may the
money for the
payment of the cost
of such work be required,
such notes to
be issued to
said contractor and to be redeemed and cancelled at the time that Interal Improvement
bonds are issued in lieu thereof.
Section 4. That this ordinance shall take effect and be in full force from
and after its publication once in the official city paper.
