AN ORDINANCE ratifyingaand confirming a contract with the H. J. Taylor Construction
Company for the construction and installation of certain paving and grading impeove-
ments on certain public alleys in the City of Salina, and providing for the issuance
of temporary notes to pay the cost thereof pending issuance and sale of bonds.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section L. That the acceptance by the City of Salina, Kansas, of the proposal
of the H. J. Taylor Construction Company, hereinafter referredt to as the "contractor"
as submitted to the Board of Commissioners on August 18, 1952, which is hereby found
to be the lowest and beat bid for such work, and the contract awarded by the Board
of Commissioners of said city to said contractor and signed on behalf of the city
by its Mayor on August 25, 1952, for the construction of certain public improvements
in the City of Salina, Kansas, to -writs
Paving and grading of a certain alley between Third Street and
Fourth Street, from the north line of Walnut Street, 400 feet
more or loss to the Smoky Hill River, as provided by Ordinance
Number 5686.
at and for the unit prices for said work contained in said proposal, which proposal
and contract are hereby referred to and made parts of this ordinance, be and the
same is hereby ratified and confirmed, said proposal being within the estimated cost
of said improvements as shown by the sworn estimates of the City Engineer on file
in the office of the City Clerk which estimates a*e hereby referred to and made a
part of this ordinance.
Section 2. Said improvements shall be built and constructed in accordance
with the plans and specifications therefor prepared by the City Engineer on file in
the office of the City Clerk and in accordance with the proposal of said contractor
and under the terms of said contract, all of which are hereby referred to and made
parts of this ordinance.
Section 3. That temporary notes signed by the Mayor and attested by the
City Clerk be issued from time to time as the work progresses in the manner avid
form as required by law, the total amount thereof not to exceed the contract price
for such works such notes be bear interest not to exceed 42 per cent per annum and
to mature not later than Decembdr let, 1953, and to be issued in such amounts and
at such time as money for the payment of the costs of such work may be required,
such notes to be issued to said contractor and to be redeemed and cancelled at the
time that permanent bonds are issued in lieu thereof.
Section 4. This ordinance shall take effect and be in force from and after
its publication in the official city paper.
