5699 Utility Improvements - Sunset Manor Additione ORDINANCE NUMBER 5699 ATE C S%LIIA (Published in the Salina Journal a, 2. . 195? _ AN ORDINANCE creating and defining a certain lateral sanitary sewer districts in the City of Salina, Kansas, designated as Lateral Sanitary Sewer Districts Numbered 286, 2870 and 288, and providing for the construction of lateral sanitary sewers in said Lateral Sanitary Sesser Districts numbered 288,287, and 288 so created, and providing for the payment of the cost thereof and for the levying of special assessments against the property in said district for the payment of the cost of such construction and for the issuing of bonds to pay the cost thereofe BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: I Section 1. Lateral Sanitary Sewer District 286. That there be and there is i hereby created lateral Sanitary Sewer District in the City of Salina, Kansas, which i shall be and it is hereby designated as Lateral Sanitary Seater District Number 286, j and which district shall include all the follows described ng property in the City jof Salina, Kansas, to-oait: All of Block b, Sunset Manor Addition to the City of Salina, Kansas* Section 2. It is necessary and it is hereby ordered that an eight inch V.C.P* i i lateral sanitary sewer with all necessary oonnections, manholes, flushing tanks, and other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District 286 as created by Section 1 of this ordinance, along the following course, to -wit: An 8 inch clay pipe sewer, beginning at a manhole in the right- of-way of U. S. 81 Bypass and 85 feet south of the south line of Franklin Street extended west; thence east 286 feet where a manhole will be constructed on right-ofoeay for utilities; thence south on said right-of-way to the northeast corner of Lot 42, Block 5, Sunset Manor Addition; thence east along right-of-nmy for utilities 240 feet to the northwest corner of Lot 2, Block 50 Sunset Manor Addition where a manhole will be built which will be the terminus of Lateral 286* Section 3. Lateral Sanitary Sewer District 287. That there be and there is hereby created Lateral Sanitary Server District in the City of Salina, Kansas, which shall be and it is hereby designated as Lateital Sanitary Server District 287, and which district shall include all the following described property in the City of Salina I i Kansas, to -wit: All of Block 3, Sunset Manor Addition to the City of Salina, Kansas* Section 4. It is necessary and it is hereby ordered than an eight inch V. Cope lateral sanitary sewer with all necessary connections, manholes, flushing tanks, and other appurtenances be constructed and built in and to serve said Lateral Sanitary District 287 as created by Section 3 of this ordinance along the following course, to- Witt An 8 inch clay pipe sewer beginning at an 8 inch stub at the j southwest comer of Lot 21, Block 50 Sunset Manor Addition; thence east 243 feet to r ight-of n y for utilities; thence south 600 feet along said right -of -nay to the southwest cor- ner of Lot 2, Block 30 Sunset Manor Addition where a manhole will be constructed which will be the terminus of Lateral 287. i Section 5. Lateral Sanitary Sewer District 288. That there be and there is I I hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District 288 and which district shall include all the following described property in the City of Salina, Kansas, to -wits . . v CON°C_,DATEu-SALINA I All of Block 1, Sunset Mahor Addition and tract of land west of Missouri Pacific Railroad from the south line of Franklin Avenue to the north line of Republic Avenue, said tract being 150 feet wide fro m east to gest and 1,197 feet long from north to south. I Section 6. It is necessary and it is hereby ordered that an eight inch V.C.P. lateral sanitary sewer with all necessary � ry connections, manholes, flushing tanks, and I other appurtenances be constructed and built in and to serve said Lateral Sanitary I jSewer District 288 as created by Section 5 of this ordinance along the following course to -Vitt An 8 inch clay pipe sewer, beginning at an 8 inch stub at the southwest corner of Lot 12, Block 39 Sunset Manor Addition; thence east 240 feet to right-of-way for utilities; thence south along said right of way 18142 feet to the center line of Republic Avenue where a manhole will be constructed which shall be the terminus of Lateral 288. j Section 7. That the City Eagineer shall on or before ,..w�J prepare „ and file in the office of the City Clerk, plans and specifications for the construction of the lateral sanitary sewers provided for in thep receding sections of this ordinance which shall be of proper character to serve the property lying ,within the district which such sewer is to be constructed and shall on or before the same date prepare and submit to the Board of Commissioners a detailed estimate under oath of the cost thereof. That hereafter the City Clerk shall advertise for three consecutive days in the official city paper for sealed proposals for the building and construction of such surer accord- ing to such plans and specificatione,vhioh proposals shall be filed with the City Clerk on or before the time fixed in such notice, at which time the Board of Commissioners may let a contract for the building and construction of such sewer to the lowest rind best responsible bidder or bidders therefor, if there be any whose bids do not exceed the estimated cost thereof, but said Board shall reserve the right to reject any or all such proposals, and if no bid shall be received within such estimate, the Board of Commissioners shall have the power to do such work and make such improvements within the estimated cost thereof as provided by law. Section 8. That for the cost of building and constructing such sewer, s pecial assessments shall be made for the full cost thereof on all lots and pieces of land within and for which such sewers shall be built, according to the appraised value there. ofsidthout regard to the improvements or buildings thereon. Section 9. After the passage and publication of this ordinance, the Board of Commissioners shall appoint three disinterested appraisers, tho having taken oath to make a true and impartial a a pa ppr isement of all lots and pieces of land liable to taxation i for the cost of such improvements, shall within five days after having been notified for their appointments proceed to appraise all of the lots and pieces of land within such district liable to assessment and taxation as aforesaid, without regard to the buildings or improvements thereon, and after making such appraisements, shall return to the Board. of Commissioners of said city and said Board shall design to gnu a time for a special meeting of said Board for the purpose of hearing any complaint that may be CO!JSD_I DATED -S ALI i made as to the value of any lot or piece of land appraised as aforesaid, of which special session due notice shall be given in the official city paper, at which special ses$ion j said Board may alter any valuation of any 16t or piece of land, if in their opinion, � I the same has been appraised too high or too lox• Section 10. The special assessment herein provided for may be paid by the per. son liable therefor in four approximately equal annual installments but the �oxner jof any property liable to such assessment may within thirty days from the date of j 1 I determining the amount assessed against the property, pay the same in full and his property shall not be liable for any assessments for the cost of such improvements, and bonds as hereinafter provided for shall be issued in the amount of the cost of such improvements remaining unpaid at the end of the thirty days from the time such assess- I went is fixed. Section 11. For the purpose of paying for the work and improvements in this I � ordinance provided for, the Board of Commissioners may and are hereby authorized and dirbcted to issue improvement bonds of the City of Salina, Kansas, in an amount not to emceed the cost of such improvement, and to run for a period of four years and be j equal payable in four approximately/annual installments, together with interest not to exceed five per cent per annum, which bonds shall be issued and payable according to law; and for the purpose of paying the principal and interest on said bonds as they severally become due and payable the Board of Commissioners shall apportion and assess against the lots and pieces of land within the taxing district of suchimprovements, special assessments covering the cost of such improvement and apportionment therein contained shall hold good for all of the installments that are to be collected from the specific property chargeable with such improvements; such assessment and apportionment ordinance shall contiin the total amount of the apportioned tax to such tract, piece or parcel of Rand within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually, at thji same time that other taxes are certified= certify to the County Clerk of Salina County, Kansas, a full list of all property liable for such work and imppmvemente, togheter with the respectDre numbered amounts due on each oP said tracts, pieces of land or parcels of land, which ampunts shall include the annual installment and interest on all unpaid balances for one year at the rate of not to exceed five per cent per annum, on such amounts so certified, which shall be collected as other taxes are collectedi Section 12.
