5698 Utility Improvements - Pacific AdditionCONS LIDATE,� 1 J oninnCE YwBER 5698 --------- ------------ (Published in the Salina Journal19b2) AN ORDINANCE creating and defining a certain lateral sanitary sewer district in the City of Salina, Kansas, designated as Lateral Sanitary Seger District Number 289, and providing for the construction of a lateral sanitary sewer in said Lateral San- itary Sewer District Number 289, so created, and providing for the pay4ent of the cost thereof and for the levying of special assessments against the property in said district for the payment of the cost of such construction and for the issuing of bonds to pay the cost thereof* BE IT ORDAINED by the Board of Coni.ssioners of the City of Salina, Kansast Section le Lateral Sanitary Seger District 289. That there be and there is here- by created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District Number 289 and which district shall include all the following described property in the City of Salina, Kansas, to -Witt lots 1 to 13, inclusive, and Lot 15, all in Block 9, Pacific addition to the City of Salina, Kansas Section 2e It is necessary and it is hereby ordered that an eight inch Q.C.P. lateral sanitary sewer with all necessary connections, manholes, flushing tanks, and other appurtenances be constructed and built in and to serve said Laterdl Sanitary Sewer District Number 289 as created by Section 1 of this ordinance along with the following course, to -wit: An 8 inch clay pipe sewer beginning at an existing manhole in Woodland Avenue and the center line of alley first east of Twelfth Street extended north; thence west 330 feet to first alley east of Thirteenth Street; thence south in said alley east of Thirteenth 390 feet where a manhole will be constructed which will be the terminus of Lateral 289. Section 3s That the City B$ginser shall on or before _-4Aj 1952 k prepared and file in the office of the City Clerk, plans and specifications for the construction of the lateral sanitary soarer provided for in the preceding sections of this ordinance which shall be of proper character to serve the property lying within the district which such soarer is to be constructed and shall on or before the same date prepare and submit to the Board of Commissioners a detailed estimate under oath of the cost thereof. That hereafter the City Clerk shall advertise for three consec• utive days in the official city paper for sealed proposals for the building and oonstr- uction of such sewer according to such plans and specifications, which proposals shall be filed with the City Clerk on or before the time fixed in such notice, at which time the Board of Commissioners may let a contract for the building and construction of such soarer to the lowest and best responsible bidder or bidders therefor, if there be any whose bids do not exceed the estimated cost thereof, but said Board shall reserve the right to reject any or all such proposals, and if no bid shall be received within such estimate, the Board of Comdasioners shall have the power to do such work and make such improvements within the estimated cost thereof as provided by laws Section 4e That for the cost of building and constructing such se er,special assessments shall be meads for the fall cost thereof on all lots and pieces of land within and for which such sewer shall be built, according to the appraised value thereof, without regard to the improvements or buildings thereon. After the passage and publication of this ordinance, the Board of Commissioners shall appoint three disinterest appraisers, who having taken oaht io make a true and impartial appraiseaent of all lots and pieces of land to taxation for the cost of such improvements, shall within five days afrer having been noti#ied for their appointments proceed to appraise all of the lots and pieces of land within such district liable to assessment and taxation as aforesaid, without regard to the buildings or improvements thereon, and after making such appraiaements, shall return to the Board of Connissioners of said city and said Board shall designate a time for a special meeting of said Board for the purpose of hearing any complaints that may be made as to the value of any lot or piece of land appraised as aforesaid, of which special session due notice shall be given in the official city paper, at which special session said Board may alter any valuation of any lot or piece of land, if, in their Opinions the same has been appraised too high or too low. Section 6. The special assessment herein provided for may paid id by the person liable therefor in four approximately equal annual installments but the owner of any property liable to such assessment may within thirty days from the date of determing the amount assessed against the property, pay the same in full and his property shall i not be liable for any assessments for the cost of such improvements, and bonds as hereinafter provided for shall be issued in the amount of the cost of such improvements remaining unpaid at the and of the thirty days from the time such assessment is fixed. Section ?. For the purpose of paying for the work and improvements in this ord- mance provided for, the foard of Comodasioners may and are hereby authorised and directed to issue improvement bonds of the City of Salina, Kansas in an amount not to i exceed the cost of such improvement bomft, and to run for a period of four years and be payable in four approximately egual asmual installments, together ether with interest � g rest not to exceed five per cant per annum, which bonds shall be issued and payable according to law; and for the purpose of paying the principal and inters t on said bonds as they severally become due and payable for the Board of Commissioners shall apportion and assess against the lots and pieces of land within the taxing district of such improvements,: special assessments covering the cost of such improvement and apportionment therein contained shall hold good for all of the installments that are to be collected from the specific property chargeable; such assessment and laic apportionment ordinance shall con- tain the total amount of tax apportioned to such tract, piece or parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually, at the same timethat other taxes are certified, certify to the County Cierk of Saline County, Kansas, a full list of all property liable for such work and improvements, together with the respective I numbered amounts due on each of said tracts, pieces or parcels of land, which amounts shall include the annual installments and interest on all unpaid balances for one year at the rate of not to exceed five per cent per annum, on such amounts so certified, COM1'CC'_ IDATEE- S%1 -1 4A which shall be collected as other taxes are collected. Section 8. This ordinance shall take effect and be in force from and after its publication once in the official city paper.
