AN ORDINANCE providing for the construction of certain storm sewers and drainage
in the City of Salina, to be designated as Storm Sewers Number D -A, D -B, D -C, and
D -D, and providing for the letting of contract for such construction and for the
payment of the cost thereof.
WMMEAS, at all time heretofore, the entire City of Salina has constituted a storm
sewer and drainage district and bonds issued to pay the cost thereof arePaYa ble by
a general tax as provided by law; and
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That the preamble of this ordinance is hereby incorporated herein.
That the entire City of Salina is hereby determined to be the benefit district as a
consequence of the installation of a system of storm sewerage and drainage as here-
inafter provided.
Section 2. That is is necessary and it is hereby ordered that a storm sewer
(described as a main sewer and certain laterals for convenience only), which is
hereby designated as Storm Sewer Number D -A, together with all necessary inlets,
inlet connections, manholes, connecting lines, sluice gates and other appurtenances,
be constructed in the City of Salina along the following course, to -watt
Storm and drainage Sewer D -,A includes the mein ewer running from
Dry Creek south to the intersection of Viemont Avenue and Crawford
Avenue, thence easterly and southerly through certain streets in the
Sunset Manor Addition and the Likine-Poster Addition and terminating
hear the southeast corner of the Likens -Foster Addition, and all
laterals which drain into Main Sewer D -A, being Laterals Number D -Al,
D -A2, D -A3, D --A4, D -AS aid D -A60 all being a part of Storm Sewer
Number D -A, more particularly described as followst
Main Sewer D -A: Beginning at a point on the south bank of Dry Creek
dMe iiorsecer tion of Viemont Avenue extended north; thence south
with a 72 -inch sewer pipe approximately 1,423 feet to a point in the
intersection of Vi wont Avenue and Crawford Street; thence east in
Crawford Avenue with a 72 -inch sewer pipe approximately 119 feet to
a point in the intersection of Seneca Avenue and Crawford Street;
thence south and southeasterly in Seneca Avenue with a 72-inoh sewer
pipe approximately 470 feet to a point in the intersection of Seneca,
Avenue and Cherokee Drive; thence continuing southeasterly in Senses,
Avenue with a 64 -inch sewer pipe approximately 1,250 feet to a point
in the intersection of Seneca Avenue and Franklin Avenue; thence east

to a point in the intersection of Franklin Avenue and Osage Drive;
thence south in Osage Drive with a 48-1noh sewer pipe approximately
2,152 feet to a point in the intersection of Osage Drive and Kiowa
Avenue; thence continuing south in Osage Drive with a 42 -inch sewer
pipe approximately 200 feet to a point in the intersection of Osage
Drive and Pawnee Avenue; thence continuing south in the easement
provided therefor with 42 -inch sewer pipe approximately 347 feet to
the terminus point approximately 13 feet north of the south boundary
line of the Likins-Poster Addition, and
Lateral Noe D -A3. Beginning at Manhole No. M -A3 in said described

Section 3. That it is necessary and it is hereby ordered that a storm and
drainage sewer (described as a main sewer and certain laterals for convenience only),
which is hereby designated as $town and Drainage Sewer No. D -B together with all
necessary inlets, inlet connections, manholes, connecting lines, sluice gates and
other appurtenances, be constructed within the City of Salina along the following
course, to -wits
Storm and Drainage Sewer D -B includes the main sewer running from
the intersection with Storm Sewer D -A at the intersection of Chero-
kee Drive and Seneca Avenue, southerly through certain streets in
the Sunset Manor and Likins-Foster Additions, and terminating at the
j intersection of Apache Brive and Pawnee Avenue, and all laterals
which drain into Mein Sewer D -B, being Laterals No. D -B1, D -B2, D -B%
D -B4, D -B5, D -B6 and D -B7, all being a part of Storm Sewer No. D -B,
More particularly described as followas
Main Sewer D -B. Beginning at Manhole No. A3 in the intersection of
Seneca Avenue and Cherokee Drive; thence southwesterly in Cherokee
Drive with a 60 -inch sewer pipe approximately 620 feet to a point
in the intersection of Cherokee Drive and Commanehe Avenue; thence
southeast in Commanche Avenue with a 36 -inch sewer pipe approximately
762 feet to a point in the intersection of Commanche Avenue and
Pontiac Avenue; thence south in Pontiac Avenue with a 36 -inch sewer
Pipe approximately 400 feet to Manhole Noe B7 in Pontiac Avenue;
thence continuing south in Pontiac Avenue with a 30 -inch sewer pipe
approximately 789 feet
to the intersection of Pontiac Avenue and
Republic Avenue; thence continuing south in Pbintiae Avenue with

of approximately 380 feet, being the terminus of Lateral No. D -B6, and,

Section 4. That it is necessary and it is hereby ordered that a storm sewer
and drainage (described as a main sewer and certain laterals for convenience only),
which is hereby designated as Storm and Drainage Sewer No. D -C together with all
necessary inlets, inlet connections, manholes, connecting lines, sluice gates and
other appurtenances, be constructed within the City of Salina along the following
course, to -wits
Storm and Drainage Sewer D -C includes the main sewer running from
the intersection with Storm Sewer D -B in the intersection of Comman-
che Avenue and Cherokee Drive and extending south in Cherokee Drive
and west in Plum Drive, terminating at the intersection of Plum Drive
and Hemlook Drive, and all laterals which drain into Main Sewer D -C,
being lateral No. D -C1 only, all being a part of Storm Sewer D -C,
more particularly described as followsa
Main Sewer D -C. Beginning at Manhole No. M -B2 in the intersection of
Caerro etc e 1 eve and Commanohe Avenue; thence southerly in Cherokee
Drive with 42 -inch scorer pipe approximately 510 feet to a point in
the intersection of Cherokee Drive and Plum Drive; thence west in
Plum Drive with a 42 -inch sower pipe approximately 300 feet to a
point in the intersection of Plum Drive and Hemlock Drive, being
the terminus of Main D -C, and
Lateral No. D -C1. Beginning at Manhole No. 11-02 in said described
main sewer in the intersection of Plum Drive and Hemlock Drive; thence
west in Plum. Drive with a 12-inoh surer pipe approximately 660 feet
to a point in the intersection of Plum Drive and Willow Drive, being
the terminus of Lateral No. D --C1.
Section 5. That it is necessary and it is hereby ordered that a storm and
drainage sewer (described as a main sewer and certain laterals for convenience only),
which is hereby designated as Storm and Drainage Sewer No. D -D together with all
necessary inlets, inlet connections, manholes, connecting lines, sluice gates and
other appurtenances, be constructed within the City of Salina along the following

Storm Sewer D -D includes the main sewer running from the inter -ft
section of Viemont Avenue and Crawford Avenue, west in Crawford
Avenue, south in Choctaw Avenue, most in Cypress Drive and south
in Birch Drive, and all laterals which drain into Main Sewer D -D,
being lateral No. D -DI only, all being a part of Storm, Sewer D -D,
more particularly described as follaws:
Main Sewer D -D. Beginning at Manhole No. V4U in in the intersection
Of Viemant Avenue and Crawford Avenue; thence west in Crawford Avenue
with a 24 -inch sewer pipe approximately 170 feet to a point in the
intersection of Crawford Avenue and Chootaw Avenue; thence south in
Choctaw Avenue with a 24 -inch sewer pipe approximately 190 feet to
a point in the intersection of Choctaw Avenue and Cypress Drive;
thence west in Cypress Drive with a 24-inoh sewer pipe approximately
870 feet to a point in the intersection of Cypress Drive and Birch
Drive; thence south in Birch Drive with an 18-inoh sewer pipe approx-
imatelY 800 feet tv Manhole No. X -D6, being the tak inus of Main
Sewer D -D, and
Lateral No. D -Dl. Beginning at Manhole No. M -D4 in said described
main sewer in the intersection of Cypress Drive and Birch Drive;
thence west in Cypress Drive with a 12 -inch sower pipe approximately
280 feet to a point in the intersection of Cypress Drive and 'Willow
Drive; thence south in Willow Drive with a 12 -inch sewer pipe 200 feet
to manhole No. M -D80 being the terminus of Lateral No. D -DI.

Section S• That on or before the 11th day of August 1952
j Mammy A. Wilson, a duly qualified engineer, shall prepare and file in the office
of the City Clerk, detailed plans and specifications for the construction of the
storm sewers provided for in Sections 2, 31, 4 and 5 of this ordinance with vitrified
and/or corrugated metal pipe, bituminous coated, and/or concrete sewer pipe or any
combination of such types of sewer pipe and on or before the same date shall preps e
and file in the office of the City Clerk, under oath, detailed estimates of the
cost thereofe After such plans aid specifications and estimate of cost shall have
been filed, the City Clerk shall advertise by advertisements published in the official
city paper for at least three consecutive days for sealed proposals for the building
and construction of such storm sewers and at the time and place mentioned, the Board
of Commissioners may let a contract with the lowest and best responsible bidder
therefor for the building and construction of such storm and drainage sewers, but
the right to rejct any and all bids shall be and is hereby reserved; and, provided
further that if no responsible person shall }pose to enter a contract at a price
not exceeding the estimated cost, then the Board of Commissioners may proceed to
construct said improvements within the estimated cost thereof and shall purchase
the necessary tools, apparatus and mterials and employ the necessary labor for the
Purpose of constructing the same.
Section ?. That for the payment of the cost of such work, the Board of Comes-
issioners shall issue General Obligation and Improvement Bonds of the City of
Salina, Kansas, in an amount not to exceed the total cost of such work and improve
Mentes Mwept as herein provided, to be payable in ten ..�.approximately equal
Annual installments and to bear interest at not to emeed 5% per annum and from the
date of such bonds, and for the purpose pf paying such bonds and interest as they
sGrerally mature, the Board of Commissioners shall armually levy a tax upon all real
and personal property in the City of Salina in an amount sufficient to pay the
annual installments of such principal and interests and that pending the issuance
of such bonds, tanporary notes shall be issued according to law, to pay the cost of
such work.
Section 4. This ordinance shall take effect and be in force from and after its
Publication in the official city paper.
