AN ORDINANCE relating to and apportioning and levying special assessments on
certain lots and pieces of ground in the City of Salina, Kansas, to pay the
cost of construction of lateral sanitary sewer in Lateral Sanitary Sewer
Districts Number 292, 294, 295, and 296 and main sanitary sewer in Main Sani-
tary Sewer District "AB", and relating to and providing for the collection and
payment of such assessments.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That for the purpose of paying for the cost of building and
construting lateral sanitary sewers in Lateral Sanitary Sewer Districts Numbered
292, 294, 295, and 296 and main sanitary sewer in Main Sanitary Sewer District
"ABS', as authorized by Ordinances Numbered 5738, 5757, 5763, 5767 and 5770,
the cost of which has been duly ascertained as shown by the City Engineer's
Final Estimate of Cost, which has been duly approved by the Board of Commissioners,
there are hereby levied and assessed on the property liable therefor, being all
the lots and pieces of ground lying in the sewer districts 'mentioned above
as created by Ordinance Numbers 5738, 5757, 5763, 5767 and 5770, according to
the appraised value of such lots and pieces of ground without regard to the
buildings or improvements thereon, special assessments covering the cost of
such improvementsconstructed in said sewer districts, said special assessments
being based on the special valuation and appraisement made by three distinterested
appraisers appointed by the Board of Commissioners of the City of Salina, Kansas,
which said appraisement is hereby referred to and made a part of this ordinance,
and the several amounts levied, and apportioned against the lots and pieces of
ground in said sewer districts for the purpose of paying for the cost of improve-
ments constructed in such district being hereby found and determined to be as
set forth in the followingsections of this ordinance.
Section 2. That for the purpose of the payment of the cost of construction
of Lateral Sm itary Sewer Number 292, an eight inch clay pipe sewer beginning
at an ey.sting manhole in Roach Street and 20 feet west of the center lire of
right-of-way in Block 5, Claflin's Addition,; thence south 652 feet parallel
x and 2u feet from the east line of Roach Street; thence east along the center
line of right-of-way for utilities 1313 feet where a manhole will be constructed
which will be the terminus of Lateral Number 292, the am untss levied, apportioned
and assessed against the lots and pieces of ground in said district are found
and determined to be as follows:

Section 3. That for the purpose of thepayment of the cost of construction
of Lateral Sanitary Sewer Number 294, and eight inch clay pipe sewer beginning
at an existing manhole in the intersection of the center line of Lincoln Avenue
and the center line of the first alley east of Third Street; thence west 330
feet to the center line of first alley east of Fourth Street; thence south along
said alley east of Fourth Street, 220 feet to the north right-of-way line of
Atchison, Topeka, and Santa Fe Railway, there a manhole to be constructed and
beginning again at the intersectiin of the center line of Lincoln Avenue and the
center line of said first alley east of Fourth Street; thence north along center
line of said alley 315 feet to the south line of Union Pacific Railroad right -
Of -way where a manhole will be constructed uhich will be the terminus of Lateral
Sanitary Sewer District Number 294;, the amounts levied., apportioned and assessed

Section 4. That for the purpose of the payment of the cost of construction
of Lateral Sanitary Sewer Number 295, an eight inch clay pipe sewer beginning
at an existing manhole in the center line of Roach Street and the center line of
utility easement of Replat of Block 32 Claflin's Addition to the Grounds of Kansas
Wesleyan University, City of Salina, Saline County, kansas, thence east in utility
easement an approximate 600 feet, more or less, to a manhole to be constructed,
being the terminus of Lateral Sanitary Sewer Number 295, the amounts levied,
apportioned and assessed against the lots and pieces of land in said di4trict are
found and determined to be as follows:

Section 7. Said amounts levied, apportioned and assessed as aforesaid shall
be dueand collectible in four equalinstallments. the first becoming due with the
taxes for the year J 1954, and one of said installments falling due each and
every year thereafter until all are paid, all to be collected with interest as in

j this ordinance provided, provided however ,that the owned of anypiece of property
liable for any such assessment may redeem his property from such liability by paying
into the cit treasury sury the entire, amount chargeable against the same as in this
ordinance designated, at any time within thirty days after, the publicationof this
j ordinance, and before the issuance of the bonds of said city in payment of the
cost of said iiaprovements, and his property so paid on shall not thereafter � e fter be

liable for anyac further assessment for the cost of saidimprovements no for any
part of said bonds.

Section 8. There is hereby levied and assessed further against such lots
and pieces of ground described in this ordinance interest at such rate per annum
as shall be borne by the bonds hereafter to be issued for thea nt of

of the remaining unpaid cost of such improvements, such rate to be hereafter
determined and fixed byordinance When such bonds are issued, on all of said
installments mentioned and provided for in this ordinance, from the date of the
bonds which maybe issued at the end of thirty days, as specified in the preceding
section hereof by law provided, to the time of collectionof the last installment as
provided by law, which said interest shall be collected annually at the same time
and in the sate manner as said installments are collected, and after the taking

effect of this ordinance and the fixing of the interest rate when agix such bonds
are authorized and issued, it shall be the duty of the City Clerk of said city
j to annually at the same time other taxes are certified, and until all of said
installments so apportioned and levied herein have been certified, to certify to
I
the County Clerk of Saline County, Kansas, a full list of all property liable
to assessment and taxation for such work and improvements, except such property
on which thespecial assessment aforesaid have been paid n in full as hereinbefore
i
provided, together with the respective amounts due on each of such lots and pieces
of ground, which amounts shall include the armual installments of such special
i
assessments together with the interest for one year at the rate to be fixed and
jprovided for in this ordinance, being the rate borne by the bonds to be issued
on all unpaid balances of such assessments
,and such amounts so certified as herein
provided shall be placed upon the tax roll by the County Clerk of Saline County,
Kansas, and collected as all other taxes are collected.
Section9. This ordinance shall take effect and be in force from and after
its publication once in the official city paper.
