5794 Utility Improvements - Welling's AdditionI� u 1 ORDIUNCE NUMBER 5794 C ;NSOLI. .TLD -_>AL N., (Published in the Salina Journal , 1953) AN CIRDINANCE creating and defining a certain lateral sanitary sewer district in the City of Salina, Kansas, designated as Lateral Sanitary Sewer District Number 297 and providing for the construction of a lateral sanitarysewer in said Lateral Sani- tary Sewer District Number 297, so created, and providing for the payment of the cost thereof and for the levying of special assessments against the property in said district for the payment of the cost of such construction and for the issa.ing of bonds to pay the cost thereof. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. Lateral Sanitary Sewer District Number 297. That there be and there is hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District Number 297 and which district shall include all the following described property in the City of Salina, Kansas, to -wit: a point 30 feet south of Benefit Distxict inning at/the center of Section 23, Township Fourteen,ange 3 West of the Sixth Principal Meridian, thence south 2W feet; thence west 382.22 feet; thence north 240 feet. -,thence east to the point of beginning; and Lots 19 2, 3 and 4, in Wellingfs Addition to the City of Salina, Kansas Section 2. It is necessary and it ishereby ordered that an eight inch V. C. P. lateral sanitary sewer with all necessary connections, manholes, flushing tanks and other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District Number 297 as created by Section 1 of this ordinance along the following course, to -wit: An 8 inch clay pipe sewer beginning at an existing sewer 75 feet south of an existing manhole which is 130 feet north of the north property line of Republic Avenue and 110 feet west of the west property line of Seminole Avenue, thence south 11.0 feet where a manhole will be constructed; thence west with branch No. 1, 296 feet to a manhole which will be constructed, thence with branch Number 2 from the manhole that will be constructed 15 feet south of the center line of Republic Avenue and 140 feet west of the center line of Seminole Avenue, 385 feet east to a manhole which will be constructed, which will be the terminus of Lateral Number 297 Section 3. That the City Engineer shall on or before July 27th , 1953, prepare and file in the office of the City Clerk, plans and specifications for the construction of the }a teral sanitary sewer provided for in the preceding sections of thisordinance which shall be of the proper character to serve the property lying within the district which such sewer is to be constructed and shall on or before the same date prepare and submit to the Board of Commissioners a detailed estimate under oath of the cost thereof. That thereafter the City Clerk shall advertise for three consecutive days in the official city paper for sealed proposals for the building and construction of such sewer according to such plans and specifications, which proposals shall be filed with the City Clerk on or before the time fixed in such notice, at which time the Board of Commissioners may let a contract for the building and construction of such sewer to the lowest and best responsible bidder SCO N SOL I D A T.-, 11 1,1NA or bidders therefor, if there be any hose bids do not exceed the estimated cost thereof, but said Board shall reserve the right to reject any or all such proposals, and if no bid shall be received within such estimate, the Board ofCommissioners shall have the power to do such work and make such improvements within the estimated cost thereof as provided by law. section 4, That for the cost of building and constructing such sewer, special assessments shall be madefor the full cost thereof on all lots and pieces of land within and for which such sewer shall be built, according to the appraised value thereof, without regard to the buildings or ng improvements thereon Section 5. After the passage and publication of this ordinance, the Board of Commissioners shall appoint three disinterested appraisers, who after having taken oath to make a true and impartial appraisement of all lots and pieces of land liable to taxation for the cost of such improvements, shall within five days after having been notified of their appointments proceed to appraise all of the lots and pieces of land within such district liable to assessment and taxation as aforesaid, without regard to the buildings or improvements thereon, and after making such appraisements, shall return to the Board of Comi.ssioners of said city and said Board shall designate a time for a special meeting of said Board for the purpose of hearing any complaints that may be made as to the value of any lot or piece of land appraised as aforesaid, of which special sessiandue notice shall be j given in the official city paper, at which special session said Board may alter any i valuation of any lot or piece of land if, in their opinion, the same has been appraised too high or too low. Section 6. The special assessment herein provided for may be paid by the per- son liable therefor in four approximately equal, annual installments but the owner of any property liable to such assessment may within thirty days from the date of determining the amount assessed against the property, pair the same in full and his property shall not be liable for any assessments for the cast of such improvements, and bonds as hereinafter provided for shall be issued in the amount of the cost of such improvements remaining unpaid at the end of the thirty days from the time such assessment is fixed. x Section 7. For the purpose of paying for the work and improvements in this i ordinance provided for, the Board of Commissioners may and are hereby authorized and directed to issue imprmvementa bonds of the City of Salina, Kansas, in an amount not to exceed the total cost of such improvement, and to run for a period of Ecus years and be payable in four approximately equal annual installments, together with interest not to exceed five per cent per annum, which bonds shall be issued and payable according to law; and for the purpose ofa p ging the principal and interest on said bonds as they severally become due and payable the Board of Commissioners shall i �CONSOL7T],',TED-SATAN �. 1 C 1 apportion and assess against the lots and pieces of land within the taxing district of such improvements, special assessments covering the cost of such improvement and apportionment therein contained shall hold good for all of the installments that are to be collected from the specific property chargeable,with such improvements; such assessment and apportionment ordinance shallcantain the total amount of tax apportioned to such tract, piece or parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually, at the same time that other taxes are certified, certify to the County Clerk of Saline County, Kansas, a full listA of all property liable for such Work and improvements, together with the respective numbered amounts due on each of said tracts, pieces or parcels of land, which amounts shall include the annual installments and interest on all unpaid balances for one year at the rate of not to exceed five per cent per annum, on such amounts so certified, which shall be collected as other taxes are collected. Section 8. This ordinance shall take effect and be in force fromand after its publication once in the official city paper.
